Many \u201cNo Excuses\u201d charters, in particular, succeed in teaching low-income African-American and Hispanic children when many traditional public schools fail, as decades of research\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.simonandschuster.com\/books\/No-Excuses\/Stephan-Thernstrom\/9780743265225\">demonstrate<\/a>.<\/p>\n<p>Even traditional liberal Hillary Clinton got boos from a National Education Association audience during the 2016 presidential campaign when she made positive remarks about charter schools, despite\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.bing.com\/videos\/search?q=hillary+clinton+on+charter+schools&amp;docid=608000582911336087&amp;mid=7CE508DE5F695159CAE97CE508DE5F695159CAE9&amp;view=detail&amp;FORM=VIRE).%20(A%20few%20charters%20are%20managed%20by%20businesses\">criticizing<\/a>\u00a0for-profit schools of all kinds. (A few charters are managed by businesses.) With this and other remarks, Clinton showed that she supported low-income parents, even at the cost of some union support.<\/p>\n<p>But now, with Democrats going woke and a new president in town, the US Department of Education has declared war on charter schools, using obscure bureaucratic rulemaking to kill the federal charter-school program without having to explain why.<\/p>\n<p>On March 11, a Friday when <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a> attention was focused on Ukraine and the Senate\u2019s Thursday-night passage of the $1.5 trillion bill to fund federal-government agencies for the rest of the fiscal year, the Biden administration\u2019s Office of Elementary and Secondary Education issued 13 pages of rules designed to cut off charter schools from federal support and that will likely serve as a model for state regulations limiting charters.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"683\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/USA-BIDEN-BUDGET-2.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"Joe Biden\" class=\"wp-image-21694579\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/USA-BIDEN-BUDGET-2.jpg?quality=90&amp;strip=all&amp;w=2048 2048w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/USA-BIDEN-BUDGET-2.jpg?quality=90&amp;strip=all&amp;w=1536 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/USA-BIDEN-BUDGET-2.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/USA-BIDEN-BUDGET-2.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>The Biden administration has allowed just one month for input on the proposed charter-school rules.<\/figcaption><figcaption><span class=\"credit\">EPA<\/span><\/figcaption><\/figure>\n<p>The administration\u2019s proposals clearly took months to prepare, and their publication not even 24 hours after the key funding vote cleared the Senate, and after important House and Senate votes gave charter supporters in both parties less clout to bargain for changes, was timed to get as little notice as possible.<\/p>\n<p>The administration is also employing a truncated comment process. That may sound arcane, but here\u2019s why it matters for democratic governance. In accord with the 1946 Administrative Procedures Act, to ensure transparency, proposed new regulations are published in the\u00a0Federal Register, with lengthy public-comment periods before rules are finalized. This gives time for experts, interest groups and the public to offer input, making regulations both more legitimate and more realistic.<\/p>\n<p>For example, when Education Secretary Betsy DeVos rewrote Title IX sexual-assault investigation rules in 2020, she did so after an 18-month process that considered more than 124,000 public comments,\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.brookings.edu\/research\/analyzing-the-department-of-educations-final-title-ix-rules-on-sexual-misconduct\/\">producing better regulations<\/a>\u00a0because of this transparency.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"683\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/020222Prospect_Charter5GSB.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"Charter school students\" class=\"wp-image-21694585\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/020222Prospect_Charter5GSB.jpg?quality=90&amp;strip=all&amp;w=2048 2048w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/020222Prospect_Charter5GSB.jpg?quality=90&amp;strip=all&amp;w=1536 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/020222Prospect_Charter5GSB.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/020222Prospect_Charter5GSB.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>The rules require reporting on the \u201cracial and socio-economic diversity of students and teachers.\u201d<\/figcaption><figcaption><span class=\"credit\">Gabriella Bass<\/span><\/figcaption><\/figure>\n<p>For less-controversial proposals, a two-month public-comment process is the norm. Yet the Biden administration has allowed just one month for input on its proposed charter-school rules, from their publication March 11 to the closing of public comment April 13. For charter opponents, the fix is in, with devils in the details.<\/p>\n<p>Among other things, proposed rules strongly recommend that charter schools seeking federal funds \u201ccollaborate with at least one traditional public school\u201d and \u201cprovide a letter from each partnering traditional public school or school district demonstrating a commitment to participate in the proposed charter-traditional collaboration.\u201d This is like letting <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a> Motors veto where Honda can sell cars.<\/p>\n<p>Charters must also prepare a \u201ccommunity impact analysis\u201d demonstrating \u201cunmet demand for the charter school, including any over-enrollment of traditional public schools.\u201d Of course, the worst traditional public schools are\u00a0<em>under<\/em>-enrolled because parents of means left long ago. The proposed rules would require extensive reporting requirements for charter schools \u2014 but not district schools \u2014 that contract with for-profit companies providing anything from food service to tutoring.
