Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>eals Court to reverse its March 21 ruling to have the letter unsealed due to their contention it would harm the organization\u2019s reputation as part of a since-dismissed lawsuit in which it was not involved.\u00a0<\/p>\n<p>In the Yankees\u2019 filing \u2014 which the team released to the press in full \u2014 they argued the organization is \u201cnot a party to this case\u201d and MLB mistakenly produced the letter in court.\u00a0<\/p>\n<p>The case \u2014 which was tossed last month \u2014 was a $5 million lawsuit by fantasy baseball players that used DraftKings against MLB, the Astros and Red Sox regarding the illegal sign-stealing scandals that occurred in 2017 and 2018.\u00a0<\/p>\n<p>The letter is said to deal with a pair of sign-stealing-related transgressions committed by the Yankees, including improperly using a dugout phone in a season before 2017, as well as referencing the fact some Yankees players stationed themselves in the team\u2019s replay room in an attempt to steal opponents\u2019 signs, then relayed that information to runners on second base so they could try to tell the hitter what was coming.\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/Yankees-Cole-Baseball-1.jpg?w=1024\" alt=\"Brian Cashman\" class=\"wp-image-21752005\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/Yankees-Cole-Baseball-1.jpg?quality=75&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/Yankees-Cole-Baseball-1.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/Yankees-Cole-Baseball-1.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Brian Cashman<\/figcaption><figcaption><span class=\"credit\">AP<\/span><\/figcaption><\/figure>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"683\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/Virus-Outbreak-MLB-Yankees-1.jpg?w=1024\" alt=\"Randy Levine\" class=\"wp-image-21752079\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/Virus-Outbreak-MLB-Yankees-1.jpg?quality=75&amp;strip=all&amp;w=2048 2048w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/Virus-Outbreak-MLB-Yankees-1.jpg?quality=75&amp;strip=all&amp;w=1536 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/Virus-Outbreak-MLB-Yankees-1.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/Virus-Outbreak-MLB-Yankees-1.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Randy Levine <\/figcaption><figcaption><span class=\"credit\">AP<\/span><\/figcaption><\/figure>\n<p>MLB previously released information about the use of the dugout phone and absolved the Yankees of any penalty for these actions, saying in a statement \u201cwe clarified the rules going forward to expressly prohibit such conduct.\u201d\u00a0<\/p>\n<p>In Friday\u2019s appeal, the Yankees noted the letter stemmed from an MLB investigation of the team and \u201csuch investigation was not subject to judicial review in this lawsuit.\u201d\u00a0<\/p>\n<p>The Yankees also called the lawsuit \u201cmeritless\u201d and also claim they are being singled out because of the franchise\u2019s high profile.\u00a0<\/p>\n<p>\u201cOne must wonder if both the district court and this Court\u2019s decisions would be different if the subject was a less famous party than the New York Yankees. Would it be less likely that such a document would be released?
