Russo and James C. Kelly are representing plaintiffs who believe they were misled by the sandwich sizes that Burger King displays in its advertisements.<\/p>\n<p>\u201cBurger King advertises its burgers as large burgers compared to competitors and containing oversized meat patties and ingredients that overflow over the bun to make it <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ear that the burgers are approximately 35% larger in size, and containing more than double the meat than the actual burger,\u201d the complaint states.<\/p>\n<p>It entered the FLSD docket on March 28, 2022.<\/p>\n<p>Attorney James Kelly told FOX Business that the complaint aims to get Burger King and other fast food\u00a0chains\u00a0to advertise their menu items in a way that reflects reality.<\/p>\n<p>\u201cWe are ultimately seeking changes to the photos for the materially overstated menu items and fairness across the industry on the issue,\u201d he said in an email.<\/p>\n<p>The menu items that are named in the complaint for being \u201coverstated\u201d in advertisements include the chain\u2019s iconic Whopper and King lines, the breakfast-time Croisann\u2019Wich (fully loaded and egg &amp; cheese) and Double Sausage sandwich, and other burger options that include bacon or cheese.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/burger-king-869.jpg?w=1024\" alt=\"Burger and fries.\" class=\"wp-image-21772307\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/burger-king-869.jpg?quality=75&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/burger-king-869.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/burger-king-869.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>The menu items that are named in the complaint for being \u201coverstated\u201d in advertisements include the chain\u2019s iconic Whopper and King lines.<\/figcaption><figcaption><span class=\"credit\">AP<\/span><\/figcaption><\/figure>\n<p>A spokesperson for Burger King told FOX Business in an email that the corporation \u201cdoes not comment on pending or potential litigations.\u201d<\/p>\n<p>The complaint requests a jury trial. It alleges that the discrepancy between the advertised sandwiches and the appearance of the menu items in real life is a \u201cdeceptive trade practice\u201d that could be interpreted as false advertising.<\/p>\n<p>Russo and Kelly name four plaintiffs in the complaint, one of whom is from Florida; the other three are from New York.\u00a0<\/p>\n<p>The plaintiffs claim they wouldn\u2019t have\u00a0purchased\u00a0sandwiches from Burger King if they were aware \u201cthat said burgers were much smaller than advertised.\u201d<\/p>\n<p>At least 100 plaintiffs are included in this pending class-action lawsuit, the complaint says.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"683\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/burger-king-873.jpg?w=1024\" alt=\"Customer holding sandwich.\" class=\"wp-image-21772358\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/burger-king-873.jpg?quality=75&amp;strip=all&amp;w=2048 2048w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/burger-king-873.jpg?quality=75&amp;strip=all&amp;w=1536 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/burger-king-873.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/burger-king-873.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Burger King says  it \u201cdoes not comment on pending or potential litigations.\u201d<\/figcaption><figcaption><span class=\"credit\">Bloomberg via Getty Images<\/span><\/figcaption><\/figure>\n<p>\u201cBurger King\u2019s advertisements for its burger and menu items are unfair and financially damaging consumers as they are receiving food that is much lower in value than what was promised,\u201d the complaint argues.\u00a0<\/p>\n<p>\u201cBurger King\u2019s actions are especially concerning now that inflation, food and meat prices are very high and many consumers, especially low income consumers, are struggling financially.\u201d<\/p>\n<p>The complaint goes on to list food reviewers, <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">YouTube<\/a>rs and consumers on Twitter who published content stating they also believe Burger King\u2019s menu items don\u2019t match its advertisements.<\/p>\n<p>\u201cThe matter in controversy exceeds the sum or value of $5,000,000, exclusive of interest and costs,\u201d wrote Russo of the Florida-based Russo Firm, and Kelly, of the New York-based Law Office of James C.
