Because they believe they know what is best for us, they are dismayed by any attempt to limit their influence or restrain their power.<\/p>\n<p>Fauci did vaguely criticize the substance of <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/reason.com\/wp-content\/uploads\/2022\/04\/Health-Freedom-Defense-Fund-v-Biden-ruling-4-18-22.pdf\">US District Judge Kathryn Kimball Mizelle\u2019s\u00a0decision<\/a>, calling her reasoning \u201cnot sound\u201d and \u201cnot particularly firm.\u201d But his main point was that she had no business determining whether the CDC had complied with the law because courts should not be \u201cgetting involved in things that are unequivocally public-health decisions.\u201d<\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/press-briefings\/2022\/04\/19\/press-gaggle-by-press-secretary-jen-psaki-april-19-2022\/\">White House Press Secretary Jen Psaki\u00a0concurred<\/a>: \u201cPublic-health decisions shouldn\u2019t be made by the courts. They should be made by public-health experts.\u201d<\/p>\n<p>But Mizelle did not make a public-health decision; she made a\u00a0<em>legal<\/em>\u00a0decision, based on her understanding of the relevant statute. Contrary to Psaki\u2019s implication, courts are not only authorized but obligated to make such decisions, as she surely would have conceded had Mizelle ruled in the CDC\u2019s favor.<\/p>\n<p>The Justice Department is\u00a0appealing\u00a0Mizelle\u2019s ruling, but it\u00a0did not seek a stay\u00a0that would have restored the mask requirement while the case is pending. Although that omission may seem puzzling <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cdc.gov\/media\/releases\/2022\/s0420-masks-public-transportation.html\">given the CDC\u2019s\u00a0claim<\/a>\u00a0that the mandate \u201cremains necessary for the public health,\u201d it makes sense if the administration\u2019s goal is to\u00a0facilitate future power grabs\u00a0by keeping the agency\u2019s statutory authority as vague as possible.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/mask-sign.jpg?w=1024\" alt=\"Fauci said that he was \u201csurprised and disappointed\u201d by US District Judge Kathryn Kimball Mizelle's ruling.\" class=\"wp-image-22047121\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/mask-sign.jpg?quality=75&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/mask-sign.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/04\/mask-sign.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Fauci said that he was \u201csurprised and disappointed\u201d by US District Judge Kathryn Kimball Mizelle\u2019s ruling.<\/figcaption><figcaption><span class=\"credit\">REUTERS\/Alyssa Pointer<\/span><\/figcaption><\/figure>\n<p>If there is \u201cno place for the courts\u201d to assess the legality of disease-control edicts, as Fauci maintains, it follows that the Supreme Court erred not only by\u00a0blocking\u00a0the CDC\u2019s nationwide eviction moratorium but even by taking up the issue. Evidently, it also should have stayed out of the\u00a0dispute\u00a0over the federal vaccination-or-testing requirement for private employees, which it likewise\u00a0deemed illegal.<\/p>\n<aside class=\"single__inline-module alignright\">\n    <\/aside>\n<p>Fauci\u2019s impatience with legal niceties has been\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/reason.com\/2020\/12\/28\/is-anthony-fauci-right-that-federalism-undermined-the-u-s-response-to-covid-19\/\">apparent for some time<\/a>. \u201cThe states are very often given a considerable amount of leeway in doing things the way they want to do it,\u201d he\u00a0complained\u00a0in a 2020 interview with BBC Radio 4, \u201cas opposed to in response to federal mandates, which are relatively rarely given.\u201d<\/p>\n<p>The result, Fauci explained, was \u201ca considerable disparity, with states doing things differently in a nonconsistent way.\u201d That \u201cdisparity,\u201d he averred, \u201chas been a major weakness in our response\u201d to the pandemic.<\/p>\n<p>The \u201cleeway\u201d that bothers Fauci is required by the Constitution, which leaves states with the primary responsibility for addressing public-health threats under a broad \u201cpolice power\u201d that the federal government was never given. So his beef is not simply with the way COVID-19 policy happened to play out in the United States; it is an objection to our system of government.<\/p>\n<p>That system limits the federal government to specifically enumerated powers, which do not include a <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> mandate to fight communicable diseases or protect public health. If Fauci is right that such policies should be left to government experts, all those interventions were misbegotten, regardless of their legal merits.<\/p>\n<p>\u201cIt\u2019s a bad precedent when decisions about public-health issues are made by people [who] don\u2019t have experience or expertise in\u00a0public health,\u201d <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.foxnews.com\/media\/fauci-wants-courts-defer-public-health-experts-public-health\">Fauci<\/a> <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.foxnews.com\/media\/fauci-wants-courts-defer-public-health-experts-public-health\">told Fox News Saturday<\/a>.
