Lindsey Graham said Sunday that the nation\u2019s top court \u201ccreated a constitutional right that didn\u2019t exist\u201d when it ruled to affirm abortion rights in Roe v. Wade.<\/p>\n<p>The South Carolina Republican\u2019s comment came amid controversy over last week\u2019s leaked draft decision penned by US Supreme Court Justice Samuel Alito suggesting the court is on the cusp of overturning the landmark 1973 ruling legalizing a woman\u2019s right to an abortion.\u00a0<\/p>\n<p>Graham said he agrees with Alito that Roe v. Wade was wrongly based on an inherent right to privacy.<\/p>\n<p>\u201c\u200b\u200bRoe v. Wade created a constitutional right that didn\u2019t exist in the writ constitution,\u201d Graham \u200bsaid on\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/video.foxnews.com\/v\/6305789777112#sp=show-clips\">\u201cFox News Sunday.\u201d <\/a>\u201cThis created division from the day it was decided until now.\u201d<\/p>\n<p>\u200bIn the decision, Alito wrote that Roe v. Wade was \u200b\u200b\u201degregiously wrong from the start.\u00a0<\/p>\n<p>\u201cIts reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division,\u201d wrote Alito, a member of the conservative wing of the court, while also citing a decision in another case that upheld Roe v.
