It alleged that Clearview AI had failed to comply with the Illinois biometric information privacy act (BIPA).<\/p>\n<div class=\"corona-wrapper neural-cta hs-embed-tnw\">\n<div class=\"neural-cta-wrapper\">\n<div class=\"neural-cta-img\"><img decoding=\"async\" src=\"https:\/\/s3.amazonaws.com\/events.tnw\/hardfork-2018\/uploads\/companies\/neural-newsletter_header.gif\"\/><\/div>\n<p><noscript><img decoding=\"async\" src=\"https:\/\/s3.amazonaws.com\/events.tnw\/hardfork-2018\/uploads\/companies\/neural-newsletter_header.gif\"\/><\/noscript><\/p>\n<div class=\"neural-cta-input\">\n<h2 class=\"neural-cta-title\"><span class=\"ez-toc-section\" id=\"Greetings_humanoids\"><\/span>Greetings humanoids<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"neural-cta-tagline\">Subscribe now for a weekly recap of our favorite AI stories<\/p>\n<p><!--[if lte IE 8]><![endif]--><\/div>\n<\/div>\n<\/div>\n<p>As Tech Crunch\u2019s Taylor Hatmaker <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/techcrunch.com\/2022\/05\/09\/clearview-settlement-bipa\/\">recently wrote<\/a>:<\/p>\n<blockquote><p>According to the terms of the Clearview settlement, which is still in the process of being finalized by the court, the company will be nationally banned from selling or giving away access to its facial recognition database to private companies and individuals.<\/p>\n<\/blockquote>\n<p>This, of course, doesn\u2019t stop Clearview from working with\u00a0government entities outside of Illinois.<\/p>\n<p>Many members of the <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a> see this as a win for privacy. But, as Clearview AI CEO Hoan Ton-That <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/edition.cnn.com\/2022\/05\/09\/tech\/clearview-ai-aclu-settlement\/index.html\">told CNN in a statement<\/a>, it makes little difference to the company:<\/p>\n<blockquote><p>Clearview AI\u2019s posture regarding sales to private entities remains unchanged. We would only sell to private entities in a manner that complies with BIPA. Our database is only provided to government agencies for the purpose of solving crimes.<\/p>\n<\/blockquote>\n<p><strong>Background:<\/strong> Clearview AI\u2019s legal team has been fighting off lawsuits like this since day one. And its CEO is certainly aware of the ever-dwindling stomach for public-facing facial recognition systems.<\/p>\n<p>That\u2019s why it <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.wsj.com\/articles\/clearview-ai-agrees-to-limit-sales-of-facial-recognition-database-11652129564\">had already stopped<\/a> third-party sales of its <i>databases<\/i><span> prior to the settlement. And, per the terms of that ruling, it will almost certainly continue to sell its <\/span><i>algorithms<\/i><span> to third-party companies.<\/span><\/p>\n<p><span>But Clearview AI was never set up to be the world\u2019s best company at selling facial recognition systems. Were its particular brand of easy-use-surveillance\u00a0a viable commercial industry, we can imagine Amazon\u2019s Ring division would have already bullied its way to the top of the space.\u00a0<\/span><\/p>\n<p><span>Arguably, the only out the company\u2019s ever had is snagging lucrative government contracts.<\/span><\/p>\n<p><span>And that\u2019s something it\u2019s also been doing since day one. It currently works with numerous law enforcement agencies across the world, CBP, ICE, the Pentagon, and more.<\/span><\/p>\n<p><span><strong>Lukewarm take:<\/strong> This is more of the same, and trending poorly for privacy. <\/span><\/p>\n<p><span>The gist of the problem is that Clearview AI provides a service the US government wants. And, color me shocked, but it turns out <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.jurist.org\/features\/2022\/01\/10\/will-washington-ever-get-around-to-regulating-artificial-intelligence\/\">the US doesn\u2019t regulate <\/a>AI.<\/span><\/p>\n<p><span>It\u2019s easy for the government to play along with\u00a0Clearview AI\u2019s pseudo-altruistic promises to keep its <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/technology\/\" data-internallinksmanager029f6b8e52c=\"4\" title=\"Technology\" target=\"_blank\" rel=\"noopener\">technology<\/a> out of civilian\u00a0hands. The suppression of civil rights and privacy requires <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.princeton.edu\/news\/2018\/08\/21\/militarization-police-fails-enhance-safety-may-harm-police-reputation\">an asymmetrical technological order<\/a>.<\/span><\/p>\n<p>The panacea for this is the recognition that privacy is just as important when you think you have nothing to hide as it is when a regime change results in the criminalization of freedoms previously taken for granted.<\/p>\n<p>Arguably, the ACLU\u2019s \u201cbig win,\u201d has gone a long way towards making people feel like Clearview AI is less dangerous than it actually is.<\/p>\n<p>And if you think you\u2019ve got nothing to hide, you should read this.\n                        <\/p><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
