woman when she went to the store to trade-in her phone last September, a shocking new lawsuit alleges \u2014 as legal experts and advocates fear a rise in what\u2019s been dubbed the modern-day \u201cPeeping Tom.\u201d<\/p>\n<p>Karen Mun, now 24, waited patiently as the employee at the Northern Boulevard store took her device to a closed backroom to see if she was \u201celigible\u201d for the trade-in but when he emerged, her heart stopped after she caught a glimpse of his phone.\u00a0<\/p>\n<p>\u201cI saw his photo <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a> open with, like, a bunch of my photos on there,\u201d Mun told The Post, referencing dozens of intimate images of herself that she kept on her device.\u00a0<\/p>\n<p>\u201cI felt like a part of me was stolen,\u201d she said.\u00a0<\/p>\n<p>\u201cI wanted to scream.\u201d\u00a0<\/p>\n<p>Mun, a nail tech born and raised in Flushing, detailed the incident in a lawsuit she filed against T-Mobile on Thursday that alleges the company was negligent in their hiring, training and supervising of staff and created the environment that allowed her privacy to be violated.\u00a0<\/p>\n<p>The lawsuit alleges that T-Mobile is well aware that employees steal customers\u2019 sensitive data and hasn\u2019t done enough to stop it because Mun\u2019s case is not an isolated incident \u2013 it\u2019s happened numerous times in the past.\u00a0<\/p>\n<p>In November 2015, a T-Mobile employee downloaded a couple\u2019s intimate videos when they went in to upgrade their phone and in June 2017, a worker emailed a customer\u2019s intimate video to himself, the lawsuit says.\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" other store employees in Mays Landing, N.J. and in December 2020, a worker stole a customer\u2019s identity and accessed their bank account in Dartmouth, Mass., the lawsuit states.\u00a0<\/p>\n<p><a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">News<\/a> reports <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/abc13.com\/t-mobile-privacy-invasion-phone-store-employee-stealing-videos-intimate-stolen-cell\/11123348\/\">reveal a slew of other similar incidents<\/a> across the country that happened at not just T-Mobile stores, but other retail shops operated by <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/abc7ny.com\/verizon-stores-employee-wireless-send-nudes\/4530028\/#:~:text=Justin%20Devine%2C%2023%2C%20was%20charged,her%20phone%20to%20assist%20her.\">major cell phone providers<\/a> like <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.dailymail.co.uk\/news\/article-7785689\/AT-T-store-manager-35-charged-sending-sex-videos-customers-phone-himself.html\">AT&amp;T<\/a> and Verizon.\u00a0<\/p>\n<p>Many of the stories echo what happened to Mun.\u00a0<\/p>\n<p>When she first arrived at the store on Sept. 23, the employee told her he needed to hook her phone up to a computer in a backroom to see if she was approved for the trade-in and she obliged, figuring the request was a normal part of the process, according to Mun and the lawsuit.\u00a0<\/p>\n<p>\u201cWhat could possibly go wrong?\u201d she remembered thinking.\u00a0<\/p>\n<p>Some time later, the employee emerged and said he wasn\u2019t able to access her device because it was locked.\u00a0<\/p>\n<p>\u201cHe gave me a piece of paper with a pen, which he prepared from the back, and\u2026 said \u2018Listen, I need you to write your passcode on this paper for me so I can unlock it in the back and plug it into the computer to see if your phone is approved by the company,\u2019\u201d Mun recalled.\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" If my phone\u2019s locked, he can\u2019t plug it into a computer, because you do need to unlock your phone to plug into a computer. So I was like, \u2018okay, here\u2019s my passcode.\u2019 He\u2019s a worker, he\u2019s being professional\u2026 he\u2019s just doing his job.\u201d\u00a0<\/p>\n<p>But when Mun spotted her private photos and realized the request was a ruse to steal her naked images, she confronted him and he admitted to taking them, her lawsuit claims.\u00a0<\/p>\n<p>\u201cI trusted him because I would never think that an employee would, you know, take advantage of their job and do that to someone, it was just so crazy to me,\u201d Mun told The Post.\u00a0<\/p>\n<p>\u201cAlthough this has happened, you know, months back, I\u2019m still thinking about it every day. It\u2019s something that keeps me up at night. I\u2019m super anxious. Sometimes\u2026 I\u2019ll go outside and I\u2019ll be like, well, what if that person has seen those photos?\u201d\u00a0<\/p>\n<p>Mun said after the initial incident, she couldn\u2019t sleep, had difficulty working and now suffers from depression and anxiety.\u00a0<\/p>\n<p>\u201cIt\u2019s so embarrassing. Although I am the victim here, I feel like I did something wrong, just by letting this happen to me,\u201d she said.\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/t-mobile-4-1.jpg?w=1024\" alt=\"cell phone stock\" class=\"wp-image-22330871\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/t-mobile-4-1.jpg?quality=75&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/t-mobile-4-1.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/t-mobile-4-1.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>The unlawful dissemination of intimate images has been a crime in New York since 2019.<\/figcaption><figcaption><span class=\"credit\">Bloomberg via Getty Images<\/span><\/figcaption><\/figure>\n<p>\u201cIt\u2019s really hard to put into words how I feel.\u201d\u00a0<\/p>\n<p>Andrew Stengel, Mun\u2019s attorney, said there\u2019s likely thousands of other people who\u2019ve been victimized the same way and just aren\u2019t aware.\u00a0<\/p>\n<p>\u201cIt was luck that the guy\u2019s phone screen was facing Karen and the app was open,\u201d Stengel said.\u00a0<\/p>\n<p>\u201cFor every one of Karen and the other people who are victims, there\u2019s probably 100 or 1,000 people who don\u2019t know that their data, intimate images, and financial information was taken. They just don\u2019t know.<\/p>\n<p>\u201cT-Mobile likes to boast about their coverage area when they should focus on properly covering subscribers\u2019 data privacy.\u201d<\/p>\n<p>In a statement, a spokesperson for T-Mobile said the employee who took Mun\u2019s images was \u201cseparated\u201d from T-Mobile \u201cimmediately\u201d after the incident.\u00a0<\/p>\n<p>\u201cWe take customer privacy very seriously. This is against our policies,\u201d the spokesperson said.\u00a0<\/p>\n<p>\u201cWe are unable to share additional details.\u201d<\/p>\n<p>They declined to answer what measures they\u2019ve taken, if any, to prevent such events from happening again.\u00a0<\/p>\n<p>While nonconsensual image sharing, sometimes referred to as revenge porn, has long been an issue and is illegal in most states, it\u2019s typically something that happens between intimate partners, not strangers.\u00a0<\/p>\n<p>Lindsey Song, the co-chair of New York\u2019s Cyber Abuse Task Force and the deputy director of the Courtroom Advocates Project at Sanctuary for Families, said infiltrating a stranger\u2019s personal device is the \u201cnext level\u201d of gender based violence and sexual harassment.<\/p>\n<p>\u201cWith cell phones and our whole lives being on cell phones and laptops and electronic devices I think it\u2019s unfortunately the next frontier of these things being used to effectuate gender based violence and sexual harassment,\u201d Song said.\u00a0<\/p>\n<p>\u201cI do think it shows the ease at which these images can be grabbed from someone\u2019s phone or laptop or whatever electronic device they have and transferred without them knowing it.. there\u2019s so many ways with Airdrop and even remote bluetooth file sharing services that wouldn\u2019t leave any kind of trace.\u201d<\/p>\n<aside class=\"single__inline-module alignleft\">\n    <\/aside>\n<p>Dr. Marina Sorochinski, an investigative psychologist who studies behavioral patterns in violent, sexual crimes, likened the act to a modern day \u201cpeeping Tom.\u201d\u00a0<\/p>\n<p>\u201cWith these crimes, including the ones that happen in intimate relationships, the medium changes but the basic psychology of it is the same. People use different means to achieve the same kinds of goals: the control, the power and the sexual gratification,\u201d Sorochinski, a professor at St. John\u2019s University, explained.\u00a0<\/p>\n<p>\u201cIt\u2019s just now the offenders are using this kind of modern <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/technology\/\" data-internallinksmanager029f6b8e52c=\"4\" title=\"Technology\" target=\"_blank\" rel=\"noopener\">technology<\/a> and modern ways and modern media to get the same things. The legal system, the criminal justice system are trying to catch up with what the offenders are now using, again, to commit the same kinds of crimes. It\u2019s not different. It\u2019s just a different mode.\u201d\u00a0<\/p>\n<p>While the unlawful dissemination of intimate images has been a crime in New York since 2019, Song said officials need to do a better job of enforcing the law and raising awareness that such acts are a crime.\u00a0<\/p>\n<p>While Mun thought of calling police after the incident, she didn\u2019t, and didn\u2019t realize what had happened to her was a crime until she researched it later on.\u00a0<\/p>\n<p>Carrie Goldberg, a high-profile attorney whose practice is centered on representing digital sex crime survivors, said Mun\u2019s incident raises a host of terrifying questions about privacy in a digital world.<\/p>\n<p>\u201cThese devices break all the time. There needs to be more of a bill of rights. If somebody comes in that store, they should be told, there should be a sign or something saying we would never take this phone out of your eyesight,\u201d she continued.\u00a0<\/p>\n<p>\u201cThere\u2019s no way for a customer to know that something unusual is going on.\u201d\u00a0<\/p>\n<p>As for Mun, she hopes telling her story can help protect others from being victimized the same way she was.\u00a0<\/p>\n<p>\u201cI want everybody to know how big of an issue this is.
