Majority Leader Andrea Stewart-Cousins (D-Westchester) and Assembly Speaker Carl Heastie (D-The Bronx), transit chiefs noted that assaults on transit workers have \u201cgrown and grown in recent years.\u201d<\/p>\n<p>\u201cWe write to you asking that, before the 2022 Legislative Session adjourns, you address one of the egregious deficiencies in the New York State law protecting transit workers from attacks,\u201d MTA Chair and CEO Janno Lieber and six other transit chiefs said in the Saturday letter, obtained by The Post. <\/p>\n<p>Under current law, individuals who assault or harass certain transit workers \u2014 such as subway train operators or conductors \u2014 \u201cwith intent to cause physical injury\u201d can be charged with assault in the second degree. <\/p>\n<p>But the MTA wants Albany to tweak state law to include roughly 11,000 more transit employees such as station customer assistants, traffic checkers, ticket collection agents and their supervisors, who are not currently protected by statute. <\/p>\n<p>The change would also cover workers in these positions on the commuter rail lines, like the Long Island Railroad. <\/p>\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/janno-lieber-01.jpg?w=1024\" alt=\"Chair and CEO of the Metropolitan Transportation Authority (MTA) Janno Lieber\" class=\"wp-image-22457744\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/janno-lieber-01.jpg?quality=75&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/janno-lieber-01.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/janno-lieber-01.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>MTA Chair and CEO Janno Lieber believes employees need extra protection and should not have to be fear coming into work. <\/figcaption><figcaption><span class=\"credit\">Reuters\/Brendan McDermid<\/span><\/figcaption><\/figure>\n<p>Will Schwartz, the MTA\u2019s deputy chief of state and local government affairs, told The Post he and Lieber had a Zoom meeting with Heastie one week ago explaining the urgent need of the request ahead of June 2 \u2014 the last day of the legislative session. <\/p>\n<p>\u201cThe clock is running out, we don\u2019t want to see them going out without this piece,\u201d he said.<\/p>\n<p>MTA statistics <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/new.mta.info\/safety-and-security\/nyct-employee-assault-data\">published online<\/a> show subway workers sustain an average of two attacks every week this year alone. Dozens of worker harassment cases have also been reported.<\/p>\n<p>\u201cMTA frontline workers have been heroic during the COVID pandemic, keeping the New York City metropolitan region moving. Unfortunately, however, in recent years there has been an trend of increasing attacks on transit workers,\u201d reads the letter.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/subwat-employee-platform.jpg?w=1024\" alt=\"Canal street subway station\" class=\"wp-image-22457753\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/subwat-employee-platform.jpg?quality=75&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/subwat-employee-platform.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/05\/subwat-employee-platform.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Subway crimes are continuing to increase, reducing ridership. <\/figcaption><figcaption><span class=\"credit\">Paul Martinka<\/span><\/figcaption><\/figure>\n<p>\u201cOur employees should not be subjected to physical abuse on a day-to day basis, including punching, spitting, pushing and other violent behavior.\u201d <\/p>\n<p>The letter was also signed by Transport Workers Union Local 100 president Tony Utano; Mark Henry, president of the Amalgamated Transit Union Local 1056; Daniel Cassella, president of the Amalgamated Transit Union Local 726; Anthony Simon of the Long Island Railroad; Edward Valente of the Association of Commuter Rail Employees and Michael Carrube, president of the Subway Surface Supervisors Association.<\/p>\n<p>MTA officials also support <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/s6472\">a bill<\/a> sponsored by state Sen. Leroy Comrie (D-Queens) that would add a new crime to the books, making it a class A misdemeanor if a person strikes, shoves or kicks a transit worker.
