I just don\u2019t see how there is a balance there on that,\u201d Judge Sallie Manzanet-Daniels\u00a0had said.<\/p>\n<p>The issue of \u201cprior bad acts\u201d was one of the arguments that Bill Cosby\u2019s lawyers used to\u00a0overturn his sexual assault conviction\u00a0in Pennsylvania. New York has its own set of more restrictive laws relating to this type of evidence.<\/p>\n<p>Weinstein\u2019s lawyer Barry Kamins told the appellate judges that the extra testimony went beyond what is normally accepted \u2014 and that Burke\u2019s rulings allowed a mountain of prejudicial evidence against his client, contributing to his decision to not testify in his own defense.<\/p>\n<p>\u201cThe jury was overwhelmed by such prejudicial, bad evidence,\u201d Kamins said. \u201cThis was a trial of Harvey Weinstein\u2019s character.
