The company is seeking the withdrawal of a DOL compliance assistance <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.dol.gov\/agencies\/ebsa\/employers-and-advisers\/plan-administration-and-compliance\/compliance-assistance-releases\/2022-01#footnotes\">release<\/a> issued in March, citing the Administrative Procedure Act, which safeguards against arbitrary official encroachment on private rights.<\/p>\n<p>The DOL release warned that the department\u2019s Employee Benefits Security Administration is expected to \u201cconduct an investigative program\u201d aimed at 401(k) plans that contain cryptocurrency. ForUsAll CEO Jeff Schulte told Cointelegraph: <\/p>\n<blockquote><p>\u201cThe government is suddenly trying to restrict the type of investments Americans can choose to make because they\u2019ve decided today that they don\u2019t like a certain asset class. [\u2026] They\u2019re clearly trying to effect a ban and they don\u2019t have the legal authority to do so.\u201d<\/p><\/blockquote>\n<p>The DOL release has elicited a sharp response from several quarters. A group of 11 financial industry trade associations <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.napa-net.org\/sites\/napa-net.org\/files\/JointLtrDOLCrypto20220412.pdf\">sent<\/a> a letter to Acting Assistant Secretary Ali Khawar in April objecting to the \u201crulemaking nature\u201d of the release without stating a position on the presence of cryptocurrency in retirement plans. <\/p>\n<p>Later that month, 10 investor, consumer, worker and retiree organizations <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/piaba.org\/piaba-newsroom\/comment-letter-compliance-assistance-release-no-2022-01-401k-plan-investments\">sent<\/a> a letter to Khawar in support of the release, saying it is consistent with the Employee Retirement Income Security Act of 1974 that created the 401(k) program and imposed strict duties on plan fiduciaries. <\/p>\n<p><strong><em>R<\/em><\/strong><strong><em>elated:<\/em><\/strong> <strong><em>Senator\u2019s Financial Freedom Act would ensure Bitcoin can be in your 401(k)<\/em><\/strong><\/p>\n<p>Schulte said ForUsAll has about 150 companies that have signed up for 401(k) plans that include crypto, and ForUsAll intended to begin rolling out 401(k) plans that include crypto this summer.<\/p>\n<p>\u201cWe have met with the Department of Labor last year,\u201d Schulte said. \u201cWe have taken great pains to make sure that our program complies with all existing regulations and rules, and we are confident in the design of our program.\u201d<\/p>\n<p><template data-name=\"subscription_form\" data-type=\"law_decoded\"><\/template><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
