\n The NYPD officer caught shoving a female protester on video has been charged with assault, the Brooklyn DA\u2019s Office said Tuesday.<\/p>\n

Vincent D\u2019Andraia is charged with third-degree assault, fourth-degree criminal mischief, second-degree harassment and third-degree menacing over the May 29 incident near the Barclays Center.<\/p>\n

In the now-viral video, he can be heard calling Dounya Zayer a \u201cstupid b\u2014h\u201d before shoving her with his hands, sending her flying several feet and onto the pavement.<\/p>\n

D\u2019Andraia, 28, walks away, with a lieutenant immedia<\/a>tely behind him.<\/p>\n

Prosecutors said Zayer was in the street when D\u2019Andraia told her to move. When she asked why, he allegedly smacked her cellphone out of her hand and \u201cviolently shoved her to the ground,\u201d an investigation found.<\/p>\n

Zayer, 20, was hospitalized for a seizure and concussion. She had been taking part in massive protests over the police-involved death of George Floyd.<\/p>\n

\u201cI was peacefully protesting,\u201d Zayer said at a press conference last week. \u201cAnd when the police started stampeding toward the crowd, I was barely given an opportunity to move.\u201d<\/p>\n

D\u2019Andraia has been suspended without pay. He will be arraigned in Brooklyn Criminal Court on Tuesday afternoon.<\/p>\n

Brooklyn DA Eric Gonzalez said he stands behind peaceful protests.<\/p>\n

\u201cAs District Attorney I cannot tolerate the use of excessive force against anyone exercising this Constitutionally guaranteed right,\u201d he said in a statement. \u201cThis is especially true of those who are sworn to protect us and uphold the law. I am deeply troubled by this unnecessary assault. We will now seek to hold this defendant accountable.\u201d<\/p>\n

A police source defended D\u2019Andraia and accused Zayer of being an instigator.<\/p>\n

\u201cThat girl is all over the internet. That\u2019s what she does \u2014 she gets in people\u2019s faces to get a rise out of them. Look at her YouTube,\u201d the source said. \u201cIf you really watch the video, she faked it and she rolled.\u201d<\/p>\n

The criminal charges against D\u2019Andraia come amid criticism over the NYPD\u2019s handling of the riots and looting that took the city by storm last week.\n <\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/div>\n
