\n The National Rifle Association\u2019s lawsuit fighting the closure of gun stores during the pandemic was tossed out by a judge Friday.<\/span><\/p>\n

The gun rights advocacy group filed a federal lawsuit in the Northern District of New York in April claiming that Gov. Andrew Cuomo\u2019s March 20 executive order deeming gun stores \u201cnon-essential\u201d \u2014 therefore keeping them closed during the coronavirus crisis \u2014 was a violation of the group\u2019s constitutional rights.<\/p>\n

But federal Judge Mae D\u2019Agostino wrote in a ruling that the organization \u201cfailed to establish that the alleged conduct by Defendants caused any \u2018perceptible impairment\u2019 to its ordinary advocacy operations,\u201d which it must do in order to sue on behalf of its membership.<\/p>\n

The NRA planned to argue in an amended lawsuit that the gun-store closures forced it to dedicate staff and resources to fielding calls from members looking for advice. This diverted its attention from its \u201ccore functions of advocacy, safety and training,\u201d the group said. For example, the NRA had to \u201ccancel firearm education and training events\u201d in the Empire State because of the executive order, it said in a proposed amended lawsuit.<\/p>\n

But D\u2019Agostino said the NRA couldn\u2019t amend its lawsuit again because the proposed changes are \u201ccompletely devoid of any allegation detailing how the general<\/a> support that was purportedly provided by Plaintiff, which consisted of fielding phone calls and providing advice to its members, was inconsistent with Plaintiff\u2019s ordinary operations of advocating its members\u2019 rights.\u201d<\/p>\n

D\u2019Agostino said the NRA didn\u2019t prove the gun-store closures \u201cburdened Plaintiff\u2019s ability to carry out its usual activities.\u201d<\/p>\n

Senior Cuomo adviser Rich Azzopardi said in response to the judge\u2019s decision, \u201cIt\u2019s no surprise that yet another frivolous suit by the NRA has been laughed out of court.<\/p>\n

\u201cTheir brand of destructive political game<\/a>s are bad enough in normal times and are completely beyond the pale during a pandemic.\u201d<\/p>\n

Last week, New York Attorney General Letitia James filed suit seeking to break up the organization, claiming that top execs mismanaged the NRA\u2019s funds, using the money instead to live lavishly.<\/p>\n

The group filed its own lawsuit against James, claiming she misused her office to go after the gun group for political reasons.<\/p>\n

The NRA didn\u2019t immedia<\/a>tely return a request for comment.\n <\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/div>\n
