It\u2019s not an unfamiliar position for the Supreme Court justice, but it generated surprising support at a leading law school. Thousands signed a\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.change.org\/p\/remove-clarence-thomas-from-teaching-at-gw\">petition<\/a>\u00a0calling for Thomas\u2019 removal as a law lecturer at George Washington University, where I teach. The reason? His vote to overturn Roe v. Wade and his concurring opinion in that momentous case.<\/p>\n<p>In a commendable decision standing by free speech and academic freedom, GWU declared it will not cancel Thomas. The controversy, however, highlights a much more serious problem for faculty who do not have the high profile of a Supreme Court justice.<\/p>\n<p>Within hours of the Dobbs decision overturning Roe, Thomas was again the focus of racist and profane attacks.\u00a0\u201cUncle Clarence\u201d trended on <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Twitter<\/a>, a reference to the racist pejorative \u201cUncle Tom.\u201d\u00a0Chicago Mayor Lori Lightfoot even led a \u201cF\u2013k Clarence Thomas\u201d chant at a pride\u00a0event.<\/p>\n<p>The petition declared that the justice (and his wife) is \u201cactively making life unsafe for thousands of students on our campus.\u201d It fretted the Dobbs decision \u201cs<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/trip-and-travel\/\" data-internallinksmanager029f6b8e52c=\"10\" title=\"Trip &amp; Travel\" target=\"_blank\" rel=\"noopener\">trip<\/a>ped the right to bodily autonomy of people with wombs\u201d and called on faculty and students to\u00a0\u201ckick Clarence\u00a0Thomas\u00a0out of Foggy Bottom.\u201d<\/p>\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22177751447516.jpg?w=1024\" alt=\"Protesters have made signs targeting Clarance and Ginni Thomas across the country.\" class=\"wp-image-22929593\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22177751447516.jpg?quality=75&amp;strip=all&amp;w=2048 2048w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22177751447516.jpg?quality=75&amp;strip=all&amp;w=1536 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22177751447516.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22177751447516.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Protesters have made signs targeting Thomas across the country.<\/figcaption><figcaption><span class=\"credit\">AP<\/span><\/figcaption><\/figure>\n<p>Nothing new for Thomas. His\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2018\/09\/05\/the-notorious-rbg-and-the-problem-with-the-celebrity-justice\/\">incredible life story<\/a> and career as one of our most accomplished African-American figures are routinely overlooked. The Smithsonian\u2019s African American museum even <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2016\/10\/19\/smithsonian-insists-that-clarence-thomas-simply-did-not-make-the-cut-of-great-african-americans-at-the-opening-of-the-african-american-museum-while-anita-hill-did\/\">skipped over<\/a> him in\u00a0its initial cut of great African Americans\u00a0at its opening. (His Senate confirmation-hearing accuser, Anita Hill, did make the cut.)<\/p>\n<p>Of course, if one thing is clear from decades of unfair and unrelenting attacks, Thomas does not walk away from a mob. He did the university a great service by not yielding to the campaign. He does not need this position or the aggravation.<\/p>\n<p>For many of us in teaching, these cancel campaigns have become a constant, looming threat. There have been drives to fire or discipline faculty who hold dissenting views on issues ranging from\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2021\/07\/30\/st-josephs-university-refuses-to-renew-contract-for-professor-who-prevailed-in-free-speech-fight\/\">racial justice<\/a>\u00a0to\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2020\/07\/09\/harvard-professor-under-fire-in-latest-attack-on-free-speech\/\">police abuse<\/a>\u00a0to\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/05\/27\/banning-incendiary-speech-and-rhetoric-boston-university-faces-new-free-speech-controversies-as-students-call-for-selective-censorship\/\">transgender identification<\/a>\u00a0to\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2021\/09\/14\/this-work-terrifies-me-virginia-tech-professor-triggers-free-speech-debate-over-who-i-am-statement\/\">gender statements<\/a>\u00a0to\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2021\/09\/26\/ohio-professor-wins-major-free-speech-victory-over-compelled-use-of-pronouns-in-classrooms\/\">pronoun usage<\/a>\u00a0to\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/01\/13\/university-of-washington-professor-triggers-free-speech-fight-over-schools-indigenous-land-acknowledgement\/\">native-land acknowledgment<\/a>. This includes a recent\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/06\/08\/shapiro-resigns-from-georgetown-after-the-law-school-reinstates-him-on-a-technicality\/\">campaign at Georgetown<\/a> that successfully secured a law professor\u2019s resignation over a tweet.<\/p>\n<p>Putting aside its\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/06\/27\/what-to-expect-in-a-post-roe-world\/\">flawed description<\/a> of the Dobbs decision, the petition makes the\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2017\/09\/18\/some-forms-of-speech-are-not-protected-berkeley-professors-call-for-boycott-of-free-speech-week\/\">familiar complaint<\/a>\u00a0that the presence of a faculty member or speaker with opposing views endangers students and faculty. Sometimes <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/03\/17\/yale-law-students-disrupt-conservative-speaker-then-object-to-the-presence-of-police-as-creating-an-unsafe-environment\/\">students even\u00a0object<\/a> that police protecting events\u00a0would create an unsafe environment. This includes figures who can share first-hand accounts of their roles in historic events, like former\u00a0Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a> Jeff Sessions, who was <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/01\/29\/university-of-illinois-student-government-demands-school-bar-jeff-sessions-from-campus\/\">effectively blocked<\/a>\u00a0from speaking at the University of Illinois; former\u00a0Vice President Mike Pence <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2021\/12\/07\/stanford-student-government-blocks-funding-for-pence-speech\/\">was targeted<\/a>\u00a0at Stanford University.<\/p>\n<p>The GW petition reflects a growing intolerance and orthodoxy sweeping universities. When I began teaching 30 years ago, universities were bastions of free speech where a wide array of views and values were steadfastly defended. Any attack on one was an attack on all.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"683\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22124116353010.jpg?w=1024\" alt=\"Protesters\" class=\"wp-image-22929596\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22124116353010.jpg?quality=75&amp;strip=all&amp;w=2048 2048w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22124116353010.jpg?quality=75&amp;strip=all&amp;w=1536 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22124116353010.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22124116353010.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>The conservative justices have faced cancel culture calls at pro-choice protests.<\/figcaption><figcaption><span class=\"credit\">AP<\/span><\/figcaption><\/figure>\n<p>Today, a palpable level of fear and intimidation exists among many faculty members that they could be the next target of one of these campaigns. Most professors are not protected by tenure, and universities can cite other reasons for not renewing their contracts.<\/p>\n<p>The percentage of tenured professors has been declining for half a century.\u00a0Roughly <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.aaup.org\/sites\/default\/files\/10112018%20Data%20Snapshot%20Tenure.pdf\">three of four<\/a> faculty today are what are called \u201ccontingent faculty,\u201d\u00a0or faculty who work contract to contract.<\/p>\n<p>The problem is that this contingency often seems to depend upon an adherence to a new orthodoxy on racial justice, police abuse, gender identification and other issues. When a professor voices a dissenting view, universities will often defend the same principles in the Thomas controversy but then simply fail to renew a contract on unstated grounds.<\/p>\n<p>That\u2019s what h<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ened to Greg Manco, a professor St. Joseph\u2019s University effectively terminated for criticizing calls for reparations, including\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.thecollegefix.com\/university-suspends-professor-for-tweets-criticizing-slavery-reparations-racial-bias-training\/\">three tweets<\/a>\u00a0from Manco\u2019s anonymous Twitter account, \u201cSouth Jersey Giants.\u201d The school\u2019s human-resources department informed Manco he was responsible for \u201cbiased or discriminatory\u201d statements and placed on administrative leave pending an investigation\u2019s outcome. After he was cleared, however, the university refused to renew his contract.\u00a0He has filed a\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.documentcloud.org\/documents\/21184787-manco-complaint-wm\">federal lawsuit<\/a>.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"683\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22181538833569.jpg?w=1024\" alt=\"Clarence Thomas\" class=\"wp-image-22929597\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22181538833569.jpg?quality=75&amp;strip=all&amp;w=2048 2048w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22181538833569.jpg?quality=75&amp;strip=all&amp;w=1536 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22181538833569.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/AP22181538833569.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Some criticisms of Thomas have been racially charged following his overturning of Roe v. Wade.<\/figcaption><figcaption><span class=\"credit\">AP<\/span><\/figcaption><\/figure>\n<p>Public campaigns are often designed to get dissenting faculty to cancel themselves or leave them marginalized in their own academic communities.<\/p>\n<p>For some, the constant hostility becomes too much and they leave teaching \u2014 which is the purpose of these campaigns. For others, the attacks only strengthen the resolve to remain. Recently, for example, Rep. Susan Wild (D-Pa.) used her address as GW\u2019s commencement speaker to accuse me of using law for \u201cwrongful ends\u201d for questioning the constitutional basis for former President Donald Trump\u2019s first impeachment, including a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/05\/16\/the-gw-commencement-controversy-a-response-to-rep-susan-wild\/\">demonstrably\u00a0false accusation<\/a> even her Democratic colleagues refuted in the hearing.<\/p>\n<p>The difference is that as a tenured faculty member, I remain protected from calls for termination. Of course, universities can make continuing on a faculty intolerable by shifting classes, keeping professors off academic panels and committees and subjecting them to public ridicule, including\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/05\/21\/chasing-katz-princeton-moves-to-fire-classics-professor-who-criticized-anti-racism-measures\/\">citing them as examples of intolerance<\/a>.<\/p>\n<aside class=\"single__inline-module alignright\">\n    <\/aside>\n<p>University of North Carolina criminology professor Mike Adams spent years in university proceedings and litigation successfully fighting for his right to express conservative views. The investigations and attacks never stopped. Indeed, they resumed with new fervor after he condemned Gov. Roy Cooper (D-NC) for his pandemic rules with a\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.starnewsonline.com\/story\/special\/2020\/06\/29\/under-fire-for-racist-tweets-mike-adams-to-retire-from-uncw\/113356488\/\">tweet<\/a>\u00a0that compared eating in cramped quarters with a slave ship. It was a stupid and offensive tweet. But we\u2019ve seen extreme comments on the left \u2014 including calls to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2021\/04\/28\/barnard-professor-triggers-free-speech-controversy-after-writing-about-detonating-and-gassing-white-people\/\">gas<\/a>\u00a0or\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2021\/02\/02\/more-of-this-please-professor-tweets-call-for-the-death-of-trump-supporters\/\">kill<\/a>\u00a0or\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2021\/01\/30\/republicans-need-to-suffer-drake-professor-triggers-free-speech-debate-with-hateful-tweets-against-men-and-conservatives\/\">torture<\/a>\u00a0conservatives \u2014 tolerated and even celebrated at universities. Adams was hammered incessantly over the tweet until he finally\u00a0relented and took a settlement to resign. He killed himself\u00a0a few days before his final day as a professor.<\/p>\n<p>Tenure remains a difficult, though not insurmountable, protection for schools trying to rid themselves of dissenting voices. Indeed, recently a Princeton professor survived a campaign for termination after questioning special faculty perks based on race. After\u00a0classics professor Joshua Katz\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.wsj.com\/articles\/princeton-president-asks-board-to-fire-tenured-classics-professor-citing-sexual-misconduct-investigation-11653013224\">was cleared<\/a>, the university dug up a prior complaint over a consensual relationship with a student for which he was previously punished. It then fired him on the previously closed case.<\/p>\n<p>Most teachers are contractual or adjunct faculty like Justice\u00a0Thomas but do not have a \u201cday job\u201d like\u00a0Thomas\u00a0if they are forced off faculties.<\/p>\n<p>The targeting of Thomas was a relatively easy fight for academic-freedom advocates given his position. Barring a Supreme Court justice from teaching is not like\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2019\/02\/05\/gw-panel-to-discuss-the-need-to-drop-the-colonials-as-school-mascot\/\">getting rid of the university\u2019s \u201cColonial\u201d mascot<\/a>. The latter changes what publicly we are called while the former changes who we are as an educational institution.
