{"id":48449,"date":"2020-08-17T18:34:00","date_gmt":"2020-08-17T15:34:00","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/kim-foxx-engaged-in-substantial-abuses-letting-jussie-smollett-walk-free-prosecutor\/"},"modified":"2020-08-17T18:34:00","modified_gmt":"2020-08-17T15:34:00","slug":"kim-foxx-engaged-in-substantial-abuses-letting-jussie-smollett-walk-free-prosecutor","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/kim-foxx-engaged-in-substantial-abuses-letting-jussie-smollett-walk-free-prosecutor\/","title":{"rendered":"#Kim Foxx engaged in \u2018substantial abuses\u2019 letting Jussie Smollett walk free: prosecutor"},"content":{"rendered":"<p>&#8220;<strong>#Kim Foxx engaged in \u2018substantial abuses\u2019 letting Jussie Smollett walk free: prosecutor<\/strong>&#8221;<\/p>\n<div>\n                        Cook County State\u2019s Attorney Kim Foxx engaged in \u201csubstantial abuses\u201d in her handling of the Jussie Smollett case, including speaking with his sister eight times after the actor turned from victim to suspect, a special prosecutor assigned to the case announced Monday.<\/p>\n<p>Shortly after Smollett told police he was the victim of a brutal hate crime in January 2019, his sister Jurnee Smollett reached out to Foxx for assistance, concerned private information about the case was being leaked, said Dan Webb, the special prosecutor assigned to re-investigate the case.<\/p>\n<p>Foxx repeatedly claimed those discussions ended when police started investigating Jussie for allegedly faking a hate crime against himself but it turns out she\u2019d lied \u2014 and continued speaking with Jurnee well after Jussie was considered a suspect, Webb said.<\/p>\n<p>\u201cState\u2019s Attorney Foxx learned by February 8, 2019 that Mr. Smollett had become a suspect in CPD\u2019s investigation, yet she continued communicating with Ms. Smollett through February 13, 2019, including via five text messages and three phone calls. State\u2019s Attorney Foxx then made false statements to the <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a> claiming she ceased all communications with Ms. Smollett as soon as she learned that Mr. Smollett was a suspect in CPD\u2019s investigation and no longer merely a victim,\u201d Webb said in a statement.<\/p>\n<p>The blunder is just one of many found by Webb\u2019s office after he was t<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ed by Chicago Judge Michael Toomin last summer to re-probe the case amid widespread outcry over how it was handled.<\/p>\n<p>Despite insistences from Foxx\u2019s office that they had a strong case against Smollett, 16 felony disorderly conduct charges against the actor were suddenly dropped on March 26 last year without any acknowledgement of guilt.<\/p>\n<p>Toomin later ruled the case was rife with \u201cunprecedented irregularities\u201d and a special prosecutor was needed to investigate the case from the start in order to restore the public\u2019s faith in the criminal justice system.<\/p>\n<p>Webb, a private attorney, was asked to determine if new charges against Smollett were warranted and if Foxx and her office acted illegally or improperly.<\/p>\n<p>Smollett was slapped with new charges earlier this year, but the investigation into Foxx didn\u2019t wrap up until Monday.<\/p>\n<p>While there\u2019s no evidence Foxx and her office broke any laws, Webb and his team, drawing from 53 interviews, 50 subpoenas and more than 120,000 pages of documents, found five instances of abuse committed by her office.<\/p>\n<p>The first instance was dropping charges against Smollett when no new evidence arose between his indictment and the decision to vindicate him.<\/p>\n<p>\u201cAlmost across the board, lawyers who currently work in or previously worked in the CCSAO\u2019s criminal division who were interviewed by the OSP \u2014 including State\u2019s Attorney Foxx \u2014 were \u2018surprised\u2019 or \u2018shocked\u2019 by at least some facet of the dismissal terms,\u201d Webb wrote.<\/p>\n<p>Further, Acting State\u2019s Attorney Joseph Magats and lead prosecutor Risa Lanier, the two people in charge of the case, had \u201csignificantly and meaningfully\u201d conflicting accounts for how the decision to drop charges was reached, Webb said.<\/p>\n<p>He added Lanier\u2019s decision to draft a statement on the dismissal in conjunction with Jussie\u2019s counsel was \u201catypical.\u201d<\/p>\n<p>The second instance of \u201csubstantial abuse of discretion\u201d was the reason Foxx\u2019s office gave for the dismissal, saying Jussie\u2019s case was similar to 5,700 others referred for \u201calternative prosecution.\u201d<\/p>\n<p>\u201cThere were not thousands of (or, arguably any) similar cases that the CCSAO resolved in a similar way to the Initial Smollett Case. The CCSAO could not identify any specific similar CCSAO cases it relied upon when resolving the Initial Smollett Case,\u201d Webb said.<\/p>\n<p>Foxx\u2019s office also lied when they said the $10,000 in restitution Jussie paid was the maximum amount they could request, Webb said. No such cap exists in any existing statutes, he said.<\/p>\n<p>The third finding of abuse was related to Foxx\u2019s decision to recuse herself and appoint her number two, Magats, to act in her stead instead of a special prosecutor, even though the attorney knew the choice was \u201clegally defective,\u201d Webb said.<\/p>\n<p>\u201cInstead of implementing the proper legal course to carry out the recusal once this defect was brought to their attention, the CCSAO and State\u2019s Attorney Foxx made the decision to ignore this major legal defect seemingly because they did not want to admit that they had made such a major mistake of judgment regarding State\u2019s Attorney Foxx\u2019s recusal,\u201d Webb wrote, adding Foxx and her office went on to lie to the media, including The Post, about it.<\/p>\n<p>Finally, Webb\u2019s office found the decisions made by Foxx, her office and Magats \u201cmay rise to the level of a violation of legal ethics\u201d and they\u2019ll be reporting their findings to the Illinois Attorney Registration and Disciplinary Commission, which can bring action against them.<\/p>\n<p>Foxx\u2019s office said in a statement that Webb\u2019s report rightfully clears them of illegal actions and \u201cputs to rest\u201d implications of outside influence.
