Wade, handing the issue back to the states.\u00a0<\/p>\n<p>The law was triggered by the Supreme Court\u2019s ruling, and barred all abortions except when the life of the mother is in danger. While it was retroactively blocked from going into effect by a separate preliminary injunction, the state Court of <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>eals ruled that it only applied to the attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a>\u2019s office \u2013 allowing county prosecutors to still charge abortion providers.\u00a0\u00a0\u00a0<\/p>\n<p>Oakland County Judge Jacob Cunningham ruled against that decision Friday, saying that restrictions regarding the medical procedure must be made by residents of the state \u201cat the ballot box,\u201d according to the Associated Press.\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/08\/judge-jacob-cunningham.jpg?w=1024\" alt=\"Circuit Court Judge Jacob Cunningham\" class=\"wp-image-23538928\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/08\/judge-jacob-cunningham.jpg?quality=75&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/08\/judge-jacob-cunningham.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/08\/judge-jacob-cunningham.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Oakland County Judge Jacob Cunningham made the ruling.<br \/>\n<\/figcaption><figcaption><span class=\"credit\">FOX2 Detroit<\/span><\/figcaption><\/figure>\n<p>Michigan\u2019s board of canvassers is scheduled to meet and announce whether a constitutional amendment protecting abortion rights in the state will be included on the Nov. 8 ballot.\u00a0<\/p>\n<p>Until then, Cunningham said it was imperative to issue an injunction blocking enforcement of the law.\u00a0<\/p>\n<p>\u201cThe harm to the body of women and people capable of pregnancy in not issuing the injunction could not be more real, clear, present and dangerous to the court,\u201d he said.\u00a0<\/p>\n<aside class=\"single__inline-module alignleft\">\n<\/aside>\n<p>The judge\u2019s ruling stems from Gov. Gretchen Whitmer\u2019s month\u2019s long effort to protect the medical procedure in the state. In April, the Democrat asked the state Supreme Court to determine if abortion is constitutionally protected. The court has yet to release a decision.\u00a0<\/p>\n<p>At the beginning of August, attorneys representing Whitmer requested a preliminary injunction to block the ban.\u00a0<\/p>\n<p>Whitmer <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.michigan.gov\/whitmer\/news\/press-releases\/2022\/08\/19\/whitmer-statement-on-winning-a-preliminary-injunction-against-extreme-1931-law-banning-abortion\">praised the Friday ruling<\/a>, saying it \u201cwill protect women and ensure nurses and doctors can keep caring for their patients without fear of prosecution.\u201d<\/p>\n<p>\u201cWhile today is welcome <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">news<\/a>, my team and I will remain vigilant in protecting reproductive freedom,\u201d Whitmer continued.\u00a0<\/p>\n<p>\u201cThe sad reality is that a number of leaders in the state are actively looking for ways to make sure Michigan\u2019s draconian 1931 law, which bans abortion for all women, doesn\u2019t include exceptions for rape or incest, and criminalizes nurses and doctors who offer reproductive care, is the law of the land. I am proud of my team today, but our work continues.\u201d<\/p>\n<p>David Kallman, an attorney representing two Republican county prosecutors, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/apnews.com\/article\/abortion-health-michigan-gretchen-whitmer-state-courts-52cdc0f365267808fb0832987a662309\">told the Associated Press on Friday<\/a> that an appeal to Cunningham\u2019s decision has been planned.\u00a0<\/p>\n<p>\u201cThe judge ignored all of the clear legal errors and problems in this case, it appears to me, simply because the issue is abortion,\u201d he told the outlet.<\/p>\n<p>In his closing arguments, the attorney reportedly emphasized that preliminary injunctions should not be how laws are changed.\n                        <\/p><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
