The expression of utter incredulity was classic Clinton \u2014 <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/09\/05\/hats-off-to-hillary-prosecuting-trump-in-the-shadow-of-clintons-emails\/\">she\u2019s selling hats<\/a> reading \u201cBut her emails\u201d for $30 a pop.<\/p>\n<p>But Hillary\u2019s denial of what was found on her server exposes something far more serious than signature hypocrisy. It reflects establishment figures\u2019 sense of license that they can literally rewrite history with little fear of contradiction by the <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a>. <\/p>\n<p>While <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/05\/05\/five-steps-to-free-speech-in-social-media-a-musk-roadmap\/\">calling for\u00a0limits on free speech <\/a>over \u201cdisinformation,\u201d\u00a0Hillary has no qualms about falsely denying what published government reports detail.<\/p>\n<p>\u201cAs Trump\u2019s problems continue to mount, the right is trying to make this about me again. There\u2019s even a \u2018Clinton Standard.\u2019 The fact is that I had zero emails that were classified,\u201d her but-my-emails <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/HillaryClinton\/status\/1567164268172173315\">tweet continued<\/a>. \u201cComey admitted he was wrong after he claimed I had classified emails. Trump\u2019s own State Department, under two different Secretaries, found I had no classified emails.\u201d<\/p>\n<p>Virtually everything about that claim is breathtakingly untrue.<\/p>\n<p>Let\u2019s quickly deal with the light lifting before getting back to the \u201cClinton Standard.\u201d<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%9CZero_emails%E2%80%9D_were_%E2%80%9Cclassified%E2%80%9D\"><\/span><strong>\u201cZero emails\u201d were \u201cclassified.<\/strong>\u201d <span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>A\u00a02018 Department of Justice inspector <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> report revealed \u201c81 email chains containing <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>roximately 193 individual emails\u201d were \u201cclassified from the CONFIDENTIAL to TOP SECRET levels at the time.\u201d Clinton is echoing her allies\u2019 <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.timesrepublican.com\/opinion\/columnists\/2022\/09\/how-many-of-her-emails-were-classified-actually-zero\/\">recent spin<\/a> that there were\u00a0only three documents with classification markings\u00a0among 33,000 emails. It is utter nonsense.\u00a0<\/p>\n<aside class=\"single__inline-module alignright\">\n    <\/aside>\n<p>The Clinton email scandal is a scandal because these were\u00a0<em>emails<\/em>. There is no classification automatically stamped on text being typed out and sent within minutes. While attachments can have classification markings, the whole point of using secure servers is that emails are created in the moment with inevitable slips in referencing classified material.<\/p>\n<p>Nevertheless, the emails had classified information, including top-secret information tied to\u00a0\u201cSpecial Access Programs.\u201d Yet\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/abcnews.go.com\/US\/fbis-trump-investigation-hillary-clinton-email-probe-heres\/story?id=89069046\">some allies emphasize<\/a>\u00a0the inspector general also noted that in some cases there was \u201cconscious effort to avoid sending classified information, by writing around the most sensitive material.\u201d It failed. The emails still contained classified information. <\/p>\n<p>That\u2019s why she was reckless to use her own server: Such mistakes on private servers are more vulnerable to capture by foreign intelligence services. Indeed, according to the FBI, \u201c<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.fbi.gov\/news\/press-releases\/press-releases\/statement-by-fbi-director-james-b-comey-on-the-investigation-of-secretary-hillary-clinton2019s-use-of-a-personal-e-mail-system\">hostile actors gained access<\/a>\u201d to some of the information through the emails of Clinton\u2019s associates and aides.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%9CComey_admitted_he_was_wrong%E2%80%9D\"><\/span><strong>\u201cComey admitted he was wrong.\u201d<\/strong> <span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>It\u2019s not clear what Hillary is referencing here. But Comey never said there was no classified information in her emails \u2014 he said the opposite. He condemned her handling of the classified material while saying it didn\u2019t warrant prosecution. <\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/abcnews.go.com\/Politics\/comey-admits-mistakes-describing-clintons-sloppy-handling-classified\/story?id=54487996\">Comey did\u00a0backtrack later<\/a>,\u00a0but not on this point. He said his \u201cmistake\u201d was in how he described her conduct: \u201cI should\u2019ve worked harder to find a way to convey that it\u2019s more than just the ordinary mistake, but it\u2019s not criminal behavior, and find different words to describe that.\u201d <\/p>\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/09\/james-comey.jpg?w=1024\" alt=\"Former FBI Director James Comey never said there wasn't any classified information in Clinton's emails.\" class=\"wp-image-23772743\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/09\/james-comey.jpg?quality=75&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/09\/james-comey.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/09\/james-comey.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Former FBI Director James Comey never said there wasn\u2019t any classified information in Clinton\u2019s emails.<\/figcaption><figcaption><span class=\"credit\">AP Photo\/J. Scott Applewhite, File<\/span><\/figcaption><\/figure>\n<p>However, she had \u201cdozens of conversations on email about secret topics\u201d and \u201cI think eight about top-secret topics,\u201d he added. \u201cSo if I\u2019m gonna be honest, I have to say somehow it\u2019s more than ordinary sloppiness.\u201d<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%9CA_Clinton_Standard%E2%80%9D\"><\/span><strong>\u201cA Clinton Standard.\u201d<\/strong> <span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Clinton objects that she\u2019s held to a different standard. That\u2019s true \u2014 but not for the reason she cites. She\u2019s long been subject to her own standard in brushing off alleged criminal conduct.<\/p>\n<p>Clinton has repeatedly avoided criminal charges even as close associates were charged. Many believe she used insider information from\u00a0a friend at Tyson Foods\u00a0to reap\u00a0a huge windfall on cattle futures in the 1970s. No charge. Then there was\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.vox.com\/2015\/4\/13\/8397309\/hillary-clinton-whitewater\">Whitewater<\/a>. Bill Clinton\u00a0later pardoned\u00a0Susan McDougal, who went to jail in connection to the fraudulent land scheme that involved both Clintons. For Hillary, no charge.<\/p>\n<aside class=\"single__inline-module alignleft\">\n    <\/aside>\n<p>Then there were the key long-sought Whitewater documents. After the case was effectively over, they\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.latimes.com\/archives\/la-xpm-1996-01-19-mn-26366-story.html\">suddenly appeared<\/a>.\u00a0The New York Times <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nytimes.com\/1996\/01\/06\/us\/elusive-papers-of-law-firm-are-found-at-white-house.html\">called the documents\u00a0\u201celusive,\u201d<\/a> \u00a0as if they moved by free will. Investigators specifically sought those records, and Clinton\u2019s team denied possession only for them to be found later outside her office. Sound familiar? No charge.<\/p>\n<p>The Clinton Standard is most evident in the email scandal. Clinton\u2019s staff\u00a0unilaterally destroyed thousands of emails\u00a0with BleachBit despite being aware in 2014 that Congress and the State Department were\u00a0seeking the evidence. I know few clients who would have the temerity to order such a unilateral destruction. Her lawyers turned over about 30,000 work-related emails to the State Department and deleted 33,000 others, unilaterally deeming them \u201cpersonal.\u201d<\/p>\n<p>For a surprisingly long period, Clinton and her staff\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/09\/05\/hats-off-to-hillary-prosecuting-trump-in-the-shadow-of-clintons-emails\/\">did not fully cooperate<\/a> with investigators in refusing to turn over her emails and other evidence to State and DOJ investigators, including laptops holding suspected classified information. That delayed efforts to estimate any national-security damage, but there was no raid. <\/p>\n<p>The FBI\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2016\/09\/28\/come-clinton-aides-refused-to-cooperate-without-immunity\/\">cut deals with her aides<\/a>\u00a0to secure their cooperation, and even then\u00a0more classified material was found\u00a0on the laptop of former Rep. Anthony Weiner (D-NY), who was married to top Clinton aide\u00a0Huma Abedin\u00a0\u2014 49,000 emails potentially relevant to the Clinton investigation. Again, no charges.<\/p>\n<p>So Hillary inadvertently hit upon one demonstrably true statement.
