In an internal survey that June, nearly 70% of employees said they wanted to continue working-from-home (WFH) at least three days a week.\u00a0<\/span><\/p>\n<p>Twitter gave them further assurances this year. In <span style=\"font-weight: 400;\">March, the company <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/paraga\/status\/1499422876134371329\/photo\/1\"><span style=\"font-weight: 400;\">reiterated the pledge<\/span><\/a><span style=\"font-weight: 400;\"> to permit full-time remote work \u201cforever.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Musk, however, has been a vocal critic of the <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>roach. In May, the world\u2019s richest person <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2022\/06\/01\/technology\/elon-musk-tesla-spacex-office.html?smid=tw-nytimes&amp;amp;smtyp=cur\"><span style=\"font-weight: 400;\">demanded<\/span><\/a><span style=\"font-weight: 400;\"> that staff at SpaceX and Tesla spend a minimum of 40 hours in the office per week. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">A pro-Musk Twitter account, Whole Mars Blog, asked the entrepreneur what he\u2019d tell people who think coming into work is an antiquated concept.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThey should pretend to work somewhere else,\u201d he replied.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">They should pretend to work somewhere else<\/p>\n<p>\u2014 Elon Musk (@elonmusk) <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/elonmusk\/status\/1531867103854317568?ref_src=twsrc%5Etfw\">June 1, 2022<\/a><\/p>\n<\/blockquote>\n<p>\u00a0<\/p>\n<p><span style=\"font-weight: 400;\">Musk is far from alone in calling for obligatory returns to offices. Supporters of the switch argue that WFH negatively impacts productivity, morale, and communication. Yet moves are afoot to take the decision out of their hands.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Legal_rights\"><\/span>Legal rights<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">In Europe, many workers would balk at Musk\u2019s demands. A 2021 <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.okta.com\/sites\/default\/files\/2021-06\/Okta%20-%20The%20New%20Workplace%20Report%202.0.pdf\"><span style=\"font-weight: 400;\">survey<\/span><\/a><span style=\"font-weight: 400;\"> of over 10,000 office-based workers across eight European countries exposed extremely<\/span><span style=\"font-weight: 400;\"> negative feelings about ending WFH. While US federal labour laws don\u2019t yet include a right to flexible working, a range of countries in Europe are making moves to protect it by law.<\/p>\n<p>A recent <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.eurofound.europa.eu\/publications\/report\/2022\/telework-in-the-eu-regulatory-frameworks-and-recent-updates\">EU report<\/a>\u00a0found that 10 states in the bloc have adopted new regulation on telework since the start of the pandemic. Among them is the Netherlands, which is poised to make WFH legal right.<\/p>\n<p>In July, the lower house of the Dutch parliament<span> approved legislation that would establish home working as a legal right. Italy\u2019s rules were rarely used until the COVID-19 outbreak, when<\/span> the government used the regulation to combat the virus.<\/p>\n<p>\u201cBy no surprise, even after the \u2018return to the normality,\u2019 the majority of the illuminated employers have chosen \u2014 or, sometimes, been forced to by their employees \u2014 to consider the agile work as an essential part of their organization and a powerful tool to attract talent,\u201d said Michele Bignami, a partner at the law firm <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.advantlaw.com\/\">Advant<\/a>.<\/p>\n<p>In Germany, meanwhile, a new law is being drafted that would enshrine a right to request remote work. The<span style=\"font-weight: 400;\"> employer would only be allowed to decline because of operational reasons.<\/span><\/p>\n<blockquote class=\"c-richText__pullQuote\">\n<div class=\"c-richText__pullQuoteGradient\">\n<p class=\"c-richText__pullQuoteQuote\">Employees\u2019 enthusiasm for mobile working is decreasing.\n            <\/div>\n<\/blockquote>\n<p>Markus K\u00fcnzel, a Munich-based head of employment law at Advant, says acceptance of WFH in Germany varies between companies.<\/p>\n<p>\u201cThe possibility to work from anywhere, even from abroad, is a benefit that can satisfy existing employees as well as attract new professionals and highly qualified workers \u2014 also from abroad,\u201d he said.<\/p>\n<p>\u201cAt the same, however, we see that the employees\u2019 enthusiasm for mobile working is decreasing in the current crisis period and that many employees would like to return to the office also with regard to the increased costs at home.\u201d<\/p>\n<p>Indeed, not every move to protect remote working in Europe has been welcomed.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Mixed_reactions\"><\/span>Mixed reactions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>In the UK, a new<span style=\"font-weight: 400;\"> <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/mailstat.us\/tr\/t\/gsssemyla0y0xdu\/3\/https:\/\/bills.parliament.uk\/bills\/3198\"><span style=\"font-weight: 400;\">Flexible Working Bill<\/span><\/a><span style=\"font-weight: 400;\"> has raised concern from experts.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cGiving people the right to request flexible working from their first day of employment doesn\u2019t make a jot of difference when the reality of ways of working often aren\u2019t revealed till much later,\u201d said Molly Johnson-Jones, founder of the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/mailstat.us\/tr\/t\/gsssemyla0y0xdu\/2\/https:\/\/flexa.careers\/\">Flexa Careers<\/a>, which has advised Depop, Esports Technologies, and Carwow on flexible working policies.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIt also doesn\u2019t mean that employers have to respond, but may well create tension between employees who make flexible working requests, and companies who wriggle out of accommodating them.\u201d<\/span><\/p>\n<p>Johnson-Jones is particularly worried about the impact this will have on workers with caring responsibilities or disabilities.<\/p>\n<blockquote class=\"c-richText__pullQuote\">\n<div class=\"c-richText__pullQuoteGradient\">\n<p class=\"c-richText__pullQuoteQuote\">All employers have a duty of care.<\/p>\n<\/p><\/div>\n<\/blockquote>\n<p>Legal experts have emphasised that employees must provide a safe workplace for remote workers. This can encompass a range of requirements, from providing secure equipment to ensuring compliance with regulations, such as GDPR.<\/p>\n<p><span style=\"font-weight: 400;\">\u201cAll employers have a duty of care to provide their staff with a safe working environment, even if this is their home address,\u201d said <\/span><span style=\"font-weight: 400;\">Paul Kelly, head of the employment law team at <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/streaklinks.com\/BQ50VQsxcU15QKLmFwjlM6tz\/http%3A%2F%2Fwww.lawblacks.com\">Blacks Solicitors<\/a>.<\/span><\/p>\n<p>That might not be a priority for Elon Musk, but other bosses are more amenable.
