The late rapper, who was killed in a shooting early Tuesday at a billiards and bowling hall in Houston, had recently been requested to testify about the case next January.<\/p>\n<p><strong>Related: Takeoff\u2019s Chilling Statement About Death Just A Week Before The Shooting\u2026<\/strong><\/p>\n<p>According to court docs, the victim \u2014 referred to anonymously as\u00a0<strong>Jane Doe<\/strong> in the filing \u2014 went to a party at DJ Durel\u2019s house in Encino one evening in June 2020. Per <em>The U.S. Sun<\/em>, she claimed the hip-hop artist arrived \u201csometime later\u201d and allegedly began \u201cstaring\u201d at her, making her \u201cuncomfortable\u201d with his presence. She allegedly told Durel \u2014 whose real name is <strong>Daryl McPherson<\/strong> \u2014 that she \u201chad no desire to engage in any sort of intimate relationship\u201d with Takeoff.<\/p>\n<p>At one point, Jane Doe and Durel went upstairs where they allegedly had \u201can argument\u201d with the <em>Bad and Boujee<\/em> performer. The woman reportedly went into the DJ\u2019s bedroom alone. The court complaint states what allegedly happened next:<\/p>\n<blockquote><p>\u201cDefendant Takeoff began touching Plaintiff\u2019s buttocks. Plaintiff clearly and unequivocally refused Defendant Takeoff\u2019s advances and stated to Defendant Takeoff that she did not want to have sex with him.\u00a0Notwithstanding Plaintiff\u2019s express refusal, Defendant Takeoff grabbed Plaintiff, flipped her over face-down, and pulled down her clothing.\u201d<\/p>\n<\/blockquote>\n<p class=\"highlight\">OMG.<\/p>\n<p>The civil filing continued:<\/p>\n<blockquote><p>\u201cDefendant Takeoff then proceeded to have forceful sexual intercourse with Plaintiff from behind, without Plaintiff\u2019s consent. After Defendant Takeoff finished raping Plaintiff, he im<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a>tely left the room.\u00a0Plaintiff sought medical care at a nearby hospital that same day, where hospital staff observed physical evidence of forceful rape and notified the Los Angeles Police Department of the same.\u201d<\/p>\n<\/blockquote>\n<p>The LAPD investigated the case, but last year the Los Angeles District Attorney\u2019s Office declined to file criminal charges. The law enforcement organization cited \u201cinsufficient evidence\u201d of the alleged assault, per\u00a0<em>The U.S. Sun<\/em>.<\/p>\n<p><strong>Related: Migos\u2019 Record Label Releases Statement On Tragic Houston Shooting<\/strong><\/p>\n<p>In a response also noted with the court, Takeoff had denied all the allegations against him. Through his lawyers, the late rapper asserted as much in docs filed before his death:<\/p>\n<blockquote><p>\u201cThe damages and injuries, if any, suffered by Plaintiff were directly and proximately caused solely by the careless, reckless, negligent, and wrongful conduct of individuals or entities other than Defendant.\u201d<\/p>\n<\/blockquote>\n<p>The case has been working its way through the LA Superior Court system for months. Lawyers from both sides were arguing over whether Takeoff would testify in court or by video from his Georgia home. Those issues had yet to be resolved at the time of the Georgia native\u2019s death this week. The woman\u2019s attorney had recently filed a motion asking a judge to compel Takeoff to testify in mid-January 2023.<\/p>\n<p>That most recent motion states:<\/p>\n<blockquote><p>\u201cDefendant has failed to appear for his properly noticed deposition despite multiple meet and confer efforts between the parties regarding alternate dates.\u00a0After one year of meet and confer efforts, Defendant\u2019s inaction has forced Plaintiff to file this motion.\u201d<\/p>\n<\/blockquote>\n<p>Per the <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">news<\/a> outlet, a judge had also set a trial date in the civil suit for next June.
