rel=\"noopener\">app<\/a>ellate judge has ruled that state prosecutors can seek the death penalty for Jamell Demons (YNW Melly) if he\u2019s convicted of first degree murder. The ruling came Wednesday, November 9 and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.billboard.com\/pro\/ynw-melly-death-penalty-florida-appeals-court-ruling\/\"><i>Billboard<\/i> broke the news<\/a> Thursday afternoon. It arrived four months after a lower court\u2019s opposite ruling on the grounds that the prosecution failed to properly notify Demons\u2019 team of their intent to seek the death penalty against him. Judge Andrew L. Siegel wrote in his opinion this week that \u201cthe state complied with its statutory obligations when it filed its notice of intent to seek the death penalty within 45 days of arraignment.\u201d<\/p>\n<div class=\"\" style=\"padding-bottom: 20px; margin-top: 20px; text-align: left;\">\n<\/div>\n<p>            Siegel concluded his opinion, however, by compelling Florida\u2019s Supreme Court to reassess the applicability of the death penalty in Demons\u2019 case when the trial resumes. \u201cIn addition,\u201d he wrote, \u201cwe certify the following to the supreme court as a question of great public importance: Whether the filing of a superseding indictment, which adds only a statutory sentencing enhancement, requires re-notice of an already timely filed notice of intent to seek the death penalty?\u201d<\/p>\n<p>            In a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/pitchfork.com\/news\/ynw-melly-potentially-facing-death-penalty-after-appeals-court-ruling\/\">statement to Pitchfork<\/a>, Demons\u2019 attorney, Phillip R.
