{"id":51026,"date":"2020-08-21T04:56:00","date_gmt":"2020-08-21T01:56:00","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/double-trouble-entrepreneur-magazine-continues-beef-with-longtime-subscriber\/"},"modified":"2020-08-21T04:56:00","modified_gmt":"2020-08-21T01:56:00","slug":"double-trouble-entrepreneur-magazine-continues-beef-with-longtime-subscriber","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/double-trouble-entrepreneur-magazine-continues-beef-with-longtime-subscriber\/","title":{"rendered":"#\u2018Double\u2019 trouble: Entrepreneur magazine continues beef with longtime subscriber"},"content":{"rendered":"<p>&#8220;<strong>#\u2018Double\u2019 trouble: Entrepreneur magazine continues beef with longtime subscriber<\/strong>&#8221;<\/p>\n<div>\n                        Entrepreneur magazine skipped its June issue because of the pandemic \u2014 and it\u2019s getting static about it from a subscriber with a longstanding beef.<\/p>\n<p>As recently as 2017, the glossy book for small businesses was publishing monthly and charging $19.99 a year for a sub<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">script<\/a>ion. Then Entrepreneur began cutting back \u2014 to 10 issues last year and eight this year.<\/p>\n<p>The skipped issue in June \u2014 which the publisher said will be part of a \u201cdouble issue\u201d in September \u2014 means only seven issues this year.<\/p>\n<p>\u201cI suspect their September 2020 issue will be a \u2018double issue\u2019 in name only,\u201d griped subscriber Scott Smith. \u201cTheir last single-month issue was March 2020 issue, and it was about 110 pages. So a double issue would need to be around 200 pages. Not gonna happen.\u201d<\/p>\n<p>Accordingly, Smith says he is pushing parent company Entrepreneur <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Media<\/a> to offer either refunds or subscription extensions for the nearly 400,000 subscribers it claims to have.<\/p>\n<p>\u201cWe didn\u2019t publish in June, but we\u2019re not alone in that,\u201d said Entrepreneur Media president Bill Shaw, blaming the pandemic.<\/p>\n<p>Meanwhile, Shaw noted that Smith has a history with the magazine that goes back more than 20 years, when Entrepreneur Media sued and won a protracted legal battle against him over trademark infringement.<\/p>\n<p>\u201cHe still owes us nearly $2 million,\u201d Shaw said.<\/p>\n<p>Smith shoots back that Entrepreneur Media has aggressively sued anyone who uses the word \u201centrepreneur\u201d in their business. \u201cThey think they own the word,\u201d he said.<\/p>\n<p>Indeed, Entrepreneur has been so aggressive in patrolling its name that Businessweek magazine once wrote a story asking, \u201cWhy is Entrepreneur Magazine Bullying Entrepreneurs?\u201d<\/p>\n<p>Smith said his dispute started in 1999 when he started a public relations company called EntrepreneurPR. He put together a custom published booklet called Entrepreneur Illustrated, in which he wrote short puff pieces on the firm\u2019s small-business clients.<\/p>\n<p>Entrepreneur Media caught wind of it and sent a cease-and-desist letter on the company\u2019s name and the booklet. Smith ignored it and continued to use the name. Then he said he was hit with a lawsuit in federal court.<\/p>\n<p>At one point, Smith said the magazine\u2019s longtime owner, Peter Shea, flew from Entrepreneur\u2019s offices in Irvine, Calif., to meet Smith at the p.r. firm\u2019s small office in Sacramento and proposed a settlement. They came to an agreement, but Smith and his then-partner balked at changing the name of Entrepreneur Illustrated, so the suit went ahead.<\/p>\n<p>Smith said he lost Round 1 in court because the judge didn\u2019t get the difference between a p.r. firm and a publishing company and felt there could be confusion in the marketplace.<\/p>\n<p>The decision was reversed on appeal, with the higher court ruling that the magazine\u2019s claim to the trademark for Entrepreneur was \u201cweak.\u201d But the retrial landed back with the same judge and Smith lost again.<\/p>\n<p>Smith said the cost of the litigation \u201cbankrupted me.\u201d The judge ordered him to turn over $600,000 in profits \u2014 which he claims he did not have \u2014 plus pick up the legal fees of $700,000. The $1.3 million tab remains unpaid.<\/p>\n<p>\u201cIf you have a trademark, you have to protect yourself, otherwise you will lose your rights to it,\u201d said Entrepreneur CEO Ryan Shea, son of the magazine\u2019s owner. \u201cDo I want to go after everybody? No. I\u2019d rather have that money back in my pocket. Like everyone else, we\u2019re trying to survive.\u201d<\/p>\n<p>He said his 50-employee company has laid off only two people since the pandemic hit in March and advertising collapsed for everyone. Asked about the money owed by Smith, Shea said: \u201cIt\u2019s close to $2 million now with interest .\u2009.\u2009. but we\u2019ve never collected a dime from Scott Smith.\u201d<\/p>\n<p>Shaw, who has been president at Entrepreneur since 2015, said that ever since losing his court case, Smith \u201chas been like a troll,\u201d constantly trying to deride Entrepreneur Media. But Smith, who has a new firm called BizStarz, said Entrepreneur Media\u2019s ruthless trademark policing continues.<\/p>\n<p>Indeed, Entrepreneur currently has a lawsuit against a teacher who started a company called Teacherpreneur Type. It\u2019s also fighting various trademark applications for Kickass Entrepreneur, Entrepreneur Story Time and Entrepreneur Kid.<\/p>\n<p>Shaw said of the latest subscription dispute, \u201cAnyone who wants a refund can have a refund.\u201d Smith said that he actually has two paid subscriptions, one going to his home and one going to his office.
