Prosecutors who work for DA Darcel Clark vowed to walk off the job unless working conditions improve, as The Post reported this week. \u00a0<\/p>\n<p>\u201cManagement . . . failed to protect Line assistants [prosecutors\u2019] mental health, h<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>iness, and financial status,\u201d read their email to Clark, forcing staff \u201cto flee in drastic numbers.\u201d They threatened to take sick time or paid time off as a group, all on a single \u201cday of our choosing\u201d and with no advance notice. \u00a0<\/p>\n<p>Such a strike would be disastrous, of course \u2014 and a violation of the state\u2019s Taylor Act. But the grievance is all too real.<\/p>\n<p>\u201cBail reform has contributed to the increase in crime,\u201d <em>left-leaning <\/em>Albany DA David Soares told The Post, but \u201cdiscovery reform has crippled operations in every [DA] office. Turnover is a challenge beyond The Bronx. We have lost more career prosecutors in the last 12 months than at any point in our history.\u201d\u00a0<\/p>\n<aside class=\"single__inline-module alignright\">\n    <\/aside>\n<p>Soares cites, for one, \u201cthe requirement to exchange thousands of documents [between prosecutors and defense lawyers] through incompatible technologies within the first few weeks of a case.\u201d That alone is \u201ca severe blow to the morale of prosecutors statewide.\u201d Tight deadlines for sharing all evidence and documents are also unrealistic.<\/p>\n<p>District Attorney Association of New York chief Tony Jordan notes that lawyers at DA offices are now obliged to provide even documents that have little connection to their cases \u2014 and can face penalties for missing one. The changes to discovery, he says, created \u201cexponentially more work that has nothing to do\u201d with cases or protecting those involved. <\/p>\n<p>Instead of litigating actual cases, prosecutors find themselves in court arguing over whether they filed all documents in \u201cgood faith.\u201d <\/p>\n<p>At the same time, the state failed to provide anything like sufficient funding to help with the heavy new workload.<\/p>\n<p>Yes, Albany made some small improvements to the discovery laws this year, but nothing even close to enough. As a result, staffers are quitting in droves and public safety is paying a price \u2014 with many cases dismissed or charges never brought in the first place, often over paperwork issues.<\/p>\n<p>Unless Gov. Kathy Hochul gets lawmakers to make <em>serious <\/em>fixes to the whole range of criminal-justice \u201creforms,\u201d including discovery, New York can expect more chaos in DA\u2019s offices.
