Belgium says BTC, ETH and other decentralized coins are not securities &#8220;<span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><img decoding=\"async\" src=\"https:\/\/images.cointelegraph.com\/images\/840_aHR0cHM6Ly9zMy5jb2ludGVsZWdyYXBoLmNvbS91cGxvYWRzLzIwMjItMTEvZmI4ODA2Y2MtNDRmNC00ZDBkLWFkMTUtZDRiYTFjMWFkYWQ3LmpwZw==.jpg\" \/><\/p>\n<div class=\"post-content\" data-v-5129e2ea>Belgium\u2019s financial regulatory body has confirmed its position that Bitcoin (BTC), Ether (ETH) and other cryptocurrencies that are issued solely by computer code do not constitute securities.<\/p>\n<p>The explanation came from Belgium&#8217;s Financial Services and Markets Authority (FSMA) in a Nov. 22 <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.fsma.be\/sites\/default\/files\/media\/files\/2022-11\/fsma_2022_25_en.pdf\">report,<\/a> a draft of which was opened for comment in Jul. 2022. <\/p>\n<p>The clarification comes following an increase in demands for answers as to how Belgium\u2019s existing financial laws and regulations <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ly to digital assets, according to the FSMA.<\/p>\n<p>While not legally binding under Belgium or European Union law, the FSMA stated that under its \u201cstepwise plan,\u201d cryptocurrencies would be classed as a security if it was issued by an individual or entity\u201d:<\/p>\n<blockquote><p>\u201cIf there is no issuer, as in cases where instruments are created by a computer code and this is not done in execution of an agreement between issuer and investor (for example, Bitcoin or Ether), then in principle the Prospectus Regulation, the Prospectus Law and the MiFID rules of conduct do not apply.\u201d<\/p><\/blockquote>\n<p>The Belgian regulatory body noted that cryptocurrencies which are not categorized as securities may still be subject to other regulations if a company uses the digital asset as a medium of exchange:<\/p>\n<blockquote><p>\u201cNevertheless, if the instruments have a payment or exchange function, other regulations may apply to the instruments or the persons who provide certain services relating to those instruments.\u201d<\/p><\/blockquote>\n<p>FSMA also noted that its stepwise plan is neutral to the <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/technology\/\" data-internallinksmanager029f6b8e52c=\"4\" title=\"Technology\" target=\"_blank\" rel=\"noopener\">technology<\/a> \u2014 suggesting that it\u2019s irrelevant whether digital assets exist and are facilitated on a blockchain or through other traditional means. <\/p>\n<p>The FSMA first drafted the report in Jul. 2022 as a means to address frequently asked questions by Belgian-based issuers, offerers and service providers of digital assets. <\/p>\n<p>FSMA stated that the stepwise plan would serve as a guideline until the European Parliament\u2019s Markets in Crypto Assets Regulation (MiCA) is adopted, which is <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.sygna.io\/blog\/what-is-mica-markets-in-crypto-assets-eu-regulation-guide\/\">expected<\/a> to take effect at the start of 2024..<\/p>\n<p><strong><em>Related: <\/em><\/strong><strong><em>Not taking the time to learn about BTC is \u2018Europe\u2019s biggest risk,\u2019 says Belgian MP<\/em><\/strong><\/p>\n<p>Belgium\u2019s clear guidelines are in contrast to the \u201cregulation by enforcement\u201d approach taken by the U.S. Securities Exchange Commission\u2019s (SEC) which is currently vying for digital asset regulatory control with the U.S. Commodity Futures Trading Commission (CFTC). <\/p>\n<p>While SEC chairman Gary Gensler has long considered BTC to constitute a commodity, he\u2019s recently argued that post-Merge ETH and other staked coins may constitute a security under the Howey test. <\/p>\n<p>Belgium hasn\u2019t been a huge adopter of digital assets to date, with a recent study from blockchain data platform Chainalysis <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blog.chainalysis.com\/reports\/2022-global-crypto-adoption-index\/\">ranking<\/a> Belgium 94th in its Global Crypto Adoption Index.<\/p>\n<p>Residents in the European country have access to 10 crypto exchanges, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.bitrawr.com\/belgium\">according<\/a> to data from crypto data resource Bitrawr. <\/p>\n<p><template data-name=\"subscription_form\" data-type=\"law_decoded\"><\/template><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
