Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ointment of Jack Smith to oversee dual Justice Department investigations into the mishandling of records at Mar-a-Lago and efforts to block the 2020 transition of power comes as the public holds fresh memories of the attacks on special counsel Robert Mueller as he investigated Trump\u2019s ties to Russia.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>Special counsels are thrust into the public spotlight, but most work within the confines of an agency that largely restricts its employees to speaking through court filings.\u00a0<\/p>\n<p>It\u2019s a dynamic that worries some, who see the days of reverence for special counsels with even the most venerable reputations as long gone.\u00a0<\/p>\n<div class=\"nlp-ignore-block article-content rich-text\">\n<hr class=\"wp-block-separator\">\n<div class=\"wp-block-columns\">\n<div class=\"wp-block-column\">\n<h2><span class=\"ez-toc-section\" id=\"Black_Friday_and_Cyber_Monday_deals_from_BestReviews\"><\/span><strong>Black Friday and Cyber Monday deals from BestReviews: <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<\/div>\n<div class=\"wp-block-column\">\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1080\" height=\"1080\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/11\/Post-022.jpg?w=720\" alt=\"\" class=\"wp-image-3744575\" srcset=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/11\/Post-022.jpg 1080w, https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/11\/Post-022.jpg?resize=300,300 300w, https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/11\/Post-022.jpg?resize=768,768 768w, https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/11\/Post-022.jpg?resize=720,720 720w, https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/11\/Post-022.jpg?resize=645,645 645w, https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/11\/Post-022.jpg?resize=100,100 100w, https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/11\/Post-022.jpg?resize=200,200 200w, https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/11\/Post-022.jpg?resize=600,600 600w, https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/11\/Post-022.jpg?resize=50,50 50w, https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/11\/Post-022.jpg?resize=876,876 876w\" sizes=\"auto, (max-width: 899px) 100vw, 876px\"><\/figure>\n<\/div>\n<\/div>\n<\/div>\n<hr class=\"wp-block-separator\"><\/div>\n<p>\u201cOne lesson from the Mueller investigation is that the traditional Justice Department mantra \u2014 \u2018We try our cases in court\u2019 \u2014 can be taken too literally, with devastating consequences,\u201d Andrew Weissmann, one of the prosecutors on the Mueller team, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2022\/11\/22\/opinion\/trump-special-counsel-mueller.html\">wrote in an\u00a0o<\/a><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2022\/11\/22\/opinion\/trump-special-counsel-mueller.html\">p-ed in The New York Times<\/a>.\u00a0<\/p>\n<p>\u201cBut the mantra does not mean letting only one side shape a narrative and leaving the public with an abundance of unanswered questions,\u201d he added.\u00a0\u00a0<\/p>\n<p>Not all special counsels have been so mum, with Kenneth Starr facing blowback for offering many an update over his years-long investigations into President Clinton.\u00a0<\/p>\n<p>\u201cThere is surely a middle ground,\u201d Weissmann urged.<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>Trump frequently railed against the Mueller investigation, which was launched after Trump fired then-FBI Director James Comey, who had been overseeing an investigation into Russia\u2019s involvement in the 2016 presidential election. \u00a0<\/p>\n<p>On <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Twitter<\/a>, Trump repeatedly complained about \u201cthe Russia hoax,\u201d and \u201cdisgraced and discredited Bob Mueller.\u201d\u00a0He would go on to call Mueller \u201chighly conflicted,\u201d while the probe, like other inquiries, was often cast as a witch hunt.\u00a0<\/p>\n<p>\u201cRobert Mueller had such a sterling reputation in the legal community. And yet that wasn\u2019t enough to prevent people from making all kinds of wild allegations about his <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/watch-movies-tv-seriess\/\" data-internallinksmanager029f6b8e52c=\"8\" title=\"Watch Movies &amp; TV Series\" target=\"_blank\" rel=\"noopener\">movies<\/a>,\u201d Barbara McQuade, a former U.S. attorney, told The Hill.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>But adhering to Justice Department tradition and largely staying quiet about the case \u201callowed [then Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a>] William Barr and Donald Trump to distort the findings of Robert Muller,\u201d she said.\u00a0<\/p>\n<p>\u201cBecause Robert Mueller was so wedded to the rules and didn\u2019t speak out loud, I think it was in effective disservice to the American people. I think his intentions were good. But I think that he came up during a time when people in public life acted in good faith. And now we find ourselves in a time when people are willing to twist the facts to suit their purposes. And so the way to combat that tendency is with facts and education,\u201d McQuade added.\u00a0<\/p>\n<p>Mueller concluded his investigation in March of 2019, but the public heard little from the special counsel until May, telling reporters, \u201cThe report is my testimony.\u201d\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>He would later appear before Congress, but by that point Barr had already characterized Mueller\u2019s findings in a May letter to lawmakers that diminished report findings critical of Trump\u2019s behavior.\u00a0\u00a0<\/p>\n<p>It was a letter, it was later revealed, that Mueller took issue with; he said it \u201cdid not fully capture the context, nature, and substance of this office\u2019s work and conclusions.\u201d\u00a0<\/p>\n<p>Both McQuade and Weissmann cautioned that any public statements would need to be carefully tailored to avoid any complications for the investigations.\u00a0<\/p>\n<p>But Weissman wrote that he sees a role for providing \u201cpublic enlightenment.\u201d\u00a0<\/p>\n<p>\u201cNeither the current special counsel regulations nor Justice Department rules require Mr. Smith to take a vow of silence with the American public. His ability to explain and educate will be critical to the acceptance of the department\u2019s mission by the American public,\u201d he wrote.\u00a0<\/p>\n<p>\u201cIt will permit Mr. Smith to be heard directly and not through the gauze of pundits and TV anchors; it will allow the public to directly assess Mr. Smith, a heretofore little-known figure; and it will permit Mr. Smith to counteract those strong forces seeking to discredit or misleadingly shape the narrative about the investigations.\u201d\u00a0<\/p>\n<p>Matt Miller, who served as the Justice Department spokesperson under the Obama administration, said while Mueller may have been too reticent to speak, \u201cthere\u2019s a danger in overcorrecting.\u201d\u00a0<\/p>\n<p>He said Smith and the department should correct the factual record, but noted that anything beyond that \u201ccan do far more benefit than damage to the case.\u201d\u00a0<\/p>\n<p>\u201cThere\u2019s a big difference between [the Mueller] case and this one, which is this one can end in a prosecution. \u2026 So to some extent, a special counsel doesn\u2019t need to worry about the press coverage he\u2019s getting. He needs to worry about bringing a case that can stick,\u201d Miller said, a possibility he sees as aided by the \u201coverwhelming evidence of Trump\u2019s guilt\u201d in the Mar-a-Lago case.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>Trump has already railed against the appointment of a special counsel, complaining about Smith\u2019s wife, who in her work as a producer contributed to a film about Michelle Obama.\u00a0<\/p>\n<p>\u201cThis is just a small amount of information from the wife of the hard-line Radical Left Special Counsel (prosecutor), an acolyte of Eric Holder and Barack Hussein Obama,\u201d Trump wrote on his social media platform\u00a0on Tuesday.\u00a0\u00a0<\/p>\n<p>Smith\u2019s appointment came as a surprise to some, who had cautioned against the appointment of a special counsel.\u00a0<\/p>\n<p>Miller said it gives Trump \u201ca foil to rally against,\u201d but that he sees little value in trying to push back against Trump taunts.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>\u201cIt is a mistake to think that you can fight an information war with Donald Trump and convince the people who are listening to him that he\u2019s wrong. Getting out and doing battle with the former president \u2013 there\u2019s very little upside in doing it, and you risk ruining your own reputation,\u201d he said.\u00a0<\/p>\n<p>\u201cThe press can be annoying and people attacking you can be annoying. But at the end of the day, you have a more powerful tool than any of that. And that\u2019s to bring criminal charges against people. So when you\u2019re swinging that big a bat, you don\u2019t need to worry about some of the attacks you get along the way.\u201d\u00a0<\/p>\n<p>Smith has thus far issued one public statement vowing \u201cindependent judgement,\u201d released shortly after a press conference from Attorney General Merrick Garland in which he said he saw the appointment as necessary given the extraordinary circumstances of the case.\u00a0<\/p>\n<p>McQuade said she hopes Smith will embrace some communication with the public as a way to engrain faith in a process Garland hopes will help insulate the department ahead of what could lead to a history-making prosecution.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>\u201cThe more we hear from Jack Smith, the more the public will trust him and understand what it is he\u2019s doing. So I think he can do it in a way that still respects the rights of those under investigation,\u201d she said.\u00a0\u00a0<\/p>\n<p>She pointed to Justice Department rules that greenlight speaking about cases in limited circumstances if it\u2019s necessary to inform the public.\u00a0<\/p>\n<p>\u201cI think that exception comes into play here where the public needs a lot of assuring if there are critics who are criticizing [that] the Justice Department is acting for political motives.\u201d\u00a0\n<\/p><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
