These absurd demands say less about the ethics of Barrett than the bias of her critics, who have waged an unrelenting and vicious campaign against the jurist and her family.<\/p>\n<p>At issue is 303 Creative LLC v. Elenis\u2019 Dec. 5 argument.\u00a0Even before the court granted review, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/02\/26\/eliminating-ideas-is-the-very-purpose-the-court-accepts-major-free-speech-case-over-same-sex-marriage\/\">I noted it could be <\/a>one of the most important free-speech cases in history. It involves a web designer who declines jobs for same-sex marriages over her religious beliefs.<\/p>\n<p>Liberal academics and pundits have decried Barrett\u2019s participation in the case because she has been part of the Christian group People of Praise, which holds traditional views of marriage and homosexuality. The <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.theguardian.com\/law\/2022\/nov\/21\/amy-coney-barrett-people-of-praise-lgbtq-303-creative-v-elenis\">media are quoting former members<\/a> calling themselves \u201csurvivors\u201d saying the group holds views that make it impossible for her to judge the case fairly.<\/p>\n<p>Impossible, that is, if Barrett is willing to discard every principle of legal and judicial integrity she has maintained her entire career.<\/p>\n<p>Justices routinely rule for individuals or groups that they find objectionable and even sinful. A\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.thepetitionsite.com\/474\/228\/482\/demand-amy-coney-barrett-recuse-herself-from-an-upcoming-gay-rights-case\/\">petition with thousands of signatures declares<\/a>, \u201cBarett\u2019s [sic] extremist religious views should have disqualified her from serving on the Supreme Court at all; but when it comes to this case in particular, it is obvious that she is far too biased to issue an impartial ruling and must recuse herself.\u201d<\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/lindyli\/status\/1594790903230726144\">Commentator Lindy Li\u00a0objected<\/a>, \u201cAmy Coney Barrett refuses to recuse herself from an LGBT case, despite being paid 5 times by the anti-LGBT group involved,\u201d referring to the legal nonprofit representing the petitioner. \u201cKetanji Brown Jackson recused herself from a Harvard case cuz she sits on its Board of Overseers. Scott <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>lewhite, File<\/span><\/figcaption><\/figure>\n<p>The reference to the Harvard case is also telling because many liberal\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/03\/05\/why-judge-jackson-needs-to-recuse-herself-in-the-harvard-case-a-response-to-noah-feldman\/\">academics and commentators<\/a>\u00a0insisted Jackson did not have to recuse herself despite what some of us saw as an\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/03\/03\/the-crimson-tie-why-justice-jackson-may-have-an-ethical-problem-to-address\/\">obvious conflict of interest<\/a>: She sat on a board that advises on admissions and oversees the Harvard\u2019s operations. To her credit, Jackson recused herself.<\/p>\n<aside class=\"single__inline-module alignright\">\n    <\/aside>\n<p>This is different. Neither Barrett nor People of Praise has a connection to the case. Indeed, this is not even a religion-clause case. When the case came up from the US Court of Appeals for the Tenth Circuit, challengers raised claims under both the First Amendment\u2019s religion and free-speech clauses.\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/10\/03\/from-affirmative-action-to-andy-warhol-buckle-up-for-a-wild-supreme-court-term\/\">As some of us had hoped<\/a>, the court accepted only the free-speech claim for review.<\/p>\n<p>Notably, those comparing Barrett with Jackson ignore that the latter has similar religious connections in her background. Jackson sat on the Montrose Christian School board in Rockville, Md. The school proclaimed \u201cuncompromisingly\u201d the gift of gender is part of the goodness of God\u2019s creation,\u201d Christians must oppose \u201call forms of sexual immorality, including adultery, homosexuality, and pornography,\u201d marriage is the \u201cuniting of one man and one woman in covenant commitment\u201d and Christians should \u201cspeak on behalf of the unborn and contend for the sanctity of all human life from conception to natural death.\u201d<\/p>\n<p>Yet those same individuals aren\u2019t calling for Jackson\u2019s recusal (which would be equally absurd). Indeed,\u00a0the board position was a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/02\/10\/the-democratic-case-against-the-biden-nominee-will-republicans-apply-the-barrett-rule\/\">nonissue at Jackson\u2019s confirmation<\/a>.<\/p>\n<p>The double standard is nothing new for Barrett and her family, who have faced repeated protests at their home, including demonstrations that must upset her young children. Protesters have distributed information on where her kids attend school. And many on the left want to block Barrett from giving her views publicly: Writers and editors are seeking to\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/11\/03\/censoring-in-the-name-of-free-speech-publishers-and-editors-call-for-banning-barrett-book\/\">ban books by the jurist<\/a>.<\/p>\n<p>Some of the vilest abuse came in her confirmation as Democratic members and activists focused on her religion. Even her multiracial family was not spared offensive and racist attacks.\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2020\/09\/28\/boston-university-professor-denounces-barrett-as-white-colonizer-for-adopting-two-haitian-children\/\">Ibram X. Kendi, the director of the Center for Antiracist Research at Boston University,<\/a>\u00a0accused Barrett of acting like a \u201cwhite colonizer\u201d in adopting two Haitian children and suggested the kids were little more than props for their ambitious mother.\u00a0<\/p>\n<p>The <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a> have reacted to these racist attacks, book banning and doxxing of children with little more than a shrug when the target is a conservative jurist.
