As always, find Frances at\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/FrancesYue_\" class=\"icon none\">@FrancesYue_<\/a>.  <\/p>\n<div data-layout=\"inline\n                \" data-layout-mobile=\"\" class=\"\n          media-object\n          type-InsetButton\n            inline\n  article__inset\n          article__inset--type-InsetButton\n            article__inset--inline\n  \"><\/p>\n<p>               Click to get Distributed Ledger in your inbox <\/p><\/div>\n<h6><span class=\"ez-toc-section\" id=\"Quote_of_the_week\"><\/span>Quote of the week<span class=\"ez-toc-section-end\"><\/span><\/h6>\n<div data-layout=\"inline\n                \" data-layout-mobile=\"\" class=\"\n          media-object\n          type-InsetPullQuote\n            inline\n    scope-web|mobileapps\n  article__inset\n          article__inset--type-InsetPullQuote\n            article__inset--inline\n  \"><\/p>\n<div class=\"wsj-article-pullquote article__inset__pullquote \">\n<p class=\"pullquote-content article__inset__pullquote__quote\">\n        <span class=\"l-qt article__inset__pullquote__mark--left\">\u201c<\/span>\u2018But looking at the current situation: We have a huge war going on, we have a huge financial crisis, we have FTX, we have Celsius, we have a lot of bear-market signals\u2019<span class=\"r-qt article__inset__pullquote__mark--right\">\u201d<\/span><\/p><\/div>\n<\/p><\/div>\n<h6><span class=\"ez-toc-section\" id=\"Cops_on_the_beat\"><\/span>Cops on the beat? <span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p> If anything has been made clear by the implosion of FTX, the digital-asset platform founded by Sam Bankman-Fried, it\u2019s that regulation is sorely lacking. <\/p>\n<p> As it stands now, the cops on the proverbial crypto beat are in need of clearer guidance from lawmakers. <\/p>\n<p>There is, indeed, <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>etite for consumer protections to guard against malicious actors, who intentionally (or unintentionally, if Bankman-Fried is to be believed) do harm to investors who unwittingly (or naively) place faith in crypto characters who don\u2019t deserve it. <\/p>\n<p>At a Thursday Senate hearing, Commodity Futures Trading Commission Chairman\u00a0Rostin Behnam said his agency didn\u2019t possess the authority to look into much of FTX\u2019s business, and said the CFTC didn\u2019t receive any indication that FTX was a simmering problem. <\/p>\n<p>The CFTC chairman put the onus on lawmakers to come up with rules to limit conflicts of interest and commingling of crypto funds. To Benham\u2019s point, such rules exist for traditional assets, where intermingling client and the firm funds, which FTX apparently did with loosely-affiliated hedge fund Alameda Research, are prohibited. <\/p>\n<p>Democratic Sen. Debbie Stabenow of Michigan, the chair of the Agriculture committee, who has teamed up with Republican Sen. John Boozman of Arkansas to promote a bill to regulate digital assets, acknowledges the difficulties of oversight. <\/p>\n<div id=\"cx-membership-tile\"><\/div>\n<p>\u201cBecause crypto assets can be used in many different ways, no single financial regulator has the expertise or the authority to regulate the entire industry,\u201d Stabenow said at <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/finance.yahoo.com\/news\/ftx-rapid-demise-stokes-us-143000388.html\" class=\"icon none\">Thursday\u2019s hearing<\/a>,  <\/p>\n<p>The challenge, of course, is the perceived complexity of blockchain and its uses, and lawmakers\u2019 ability to determine guidelines in a rapidly evolving area.<\/p>\n<p>Cryptocurrency and its associated platforms have grown at lightning speed, with debates raging about what constitutes a security in digital-asset land. Meanwhile, there may not be a sufficiently deep understanding of how crypto works among lawmakers, beyond a recognition that bitcoin<br \/>\n        BTCUSD,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/108573962\/realtime\" class=\"positive\">+0.10%<\/bg-quote><span>,<\/span><br \/>\n       and to lesser extent Ether, on the Ethereum<br \/>\n        ETHUSD,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/108573964\/realtime\" class=\"negative\">-0.23%<\/bg-quote><br \/>\n       blockchain, exist. <\/p>\n<p>Earlier this week, Sen. Cynthia Lummis, R-Wyo., <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ft.com\/content\/7a8e4c6e-f93b-4111-8b03-de8a2e464819\" class=\"icon none\">was quoted in the Financial Times<\/a> as saying she hoped the collapse of FTX \u201chighlighted with members of Congress who have not taken the time to learn more about this asset class, that it is time for them to learn more about it so we can engage in proper regulation.\u201d<\/p>\n<p>Securities and Exchange Commission Chairman Gary Gensler, who is widely seen as highly proficient in digital assets (<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/ocw.mit.edu\/courses\/15-s12-blockchain-and-money-fall-2018\/resources\/session-1-introduction\/\" class=\"icon none\">he taught a course on it at MIT<\/a>) has been adamant that the SEC is a \u201ccop on the beat\u201d when it comes to crypto regulation. <\/p>\n<p>On top of that, he has said new rule-making isn\u2019t necessary. <\/p>\n<p>\u201cNothing about the crypto markets is incompatible with the securities laws,\u201d Gensler said in prepared remarks to the Practicing Law Institute <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.sec.gov\/news\/speech\/gensler-sec-speaks-090822\" class=\"icon none\">back in early September.<\/a> \u201cInvestor protection is just as relevant, regardless of underlying technologies,\u201d he said.<\/p>\n<p>Notably, he offered a poignant quote to CoinDesk several months ago about his stance on crypto-lending platforms, which take collateral from clients:  <\/p>\n<blockquote><p>\u201cIt doesn\u2019t matter what you hand over to a platform, if you hand over gold, if you hand over bitcoin or you hand over any one of 1,000-plus alternative coins \u2014 frankly, if you hand over chinchillas. That the platform is taking those funds of value and doing something with it \u2014 they might be operating a hedge fund, they might be lending it out, they might be operating other investment schemes \u2014 but that platform is under the securities laws book because of how they\u2019ve taken that money from you.\u201d<\/p><\/blockquote>\n<p>But even Gensler\u2019s approach to oversight has drawn criticism from those who <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.foxbusiness.com\/markets\/sec-chairman-gary-gensler-met-with-head-ftx-months-before-collapse\" class=\"icon none\">question how he missed<\/a> the whirling dervish that was FTX. <\/p>\n<p>What remains unclear is if the apparent demise of FTX will lead to clear measures to prevent another FTX or another Celsius. Whether Bankman-Fried will be punished, at the very least for his mismanagement of his company, also stands as an open question. <\/p>\n<h6><span class=\"ez-toc-section\" id=\"See_no_evil\"><\/span>See no evil<span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>During a highly anticipated interview at the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2022\/12\/01\/business\/dealbook\/sam-bankman-fried-mark-zuckerberg-reed-hastings-sbf-summit.html\" class=\"icon none\">New York Times DealBook Summit in New York<\/a>, Bankman-Fried, wearing a black T-shirt and looking solemn, said Wednesday he <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.wsj.com\/articles\/sam-bankman-fried-says-he-didnt-know-about-scale-of-alameda-bets-11669847041?mod=hp_lead_pos7&amp;mod=article_inline\" class=\"icon none\">didn\u2019t intend to commit any fraud <\/a>or use customer funds to fund bets at Alameda Research, a cryptocurrency hedge fund he founded. <\/p>\n<p>John J. Ray III, who is tasked with presiding over the crypto platform\u2019s bankruptcy, described the management of the firm and its accounting as the worst he\u2019s seen in his career. <\/p>\n<p>\u201cI didn\u2019t know exactly what was going on,\u201d Bankman-Fried said during his interview, which was livestreamed from the Bahamas. \u201cI learned a lot of these things as they were going on.\u201d<\/p>\n<p>The FTX founder also was interviewed by George Stephanopoulos on Thursday on ABC\u2019s \u201cGood Morning America.\u201d <\/p>\n<p>\u201cAt the end of the day, it\u2019s not my call what happens, and the world will judge as it will,\u201d Bankman-Fried said during that interview.<\/p>\n<p>He said he understood why some might view him as a villain who perpetrated a fraud akin to Ponzi schemer Bernie Madoff. <\/p>\n<p>\u201cI don\u2019t think that\u2019s who I am at all,\u201d Bankman-Fried said. \u201cBut I understand why they\u2019re saying that. People lost money. according to FactSet. <\/p>\n<p>Ether\u00a0was up 6.5% over the same stretch to around $1,303, FactSet data shows. <\/p>\n<p> Meanwhile, FTX native coins, known as FTT tokens, were down nearly 6% over the past seven days, trading at $1.29,<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.coingecko.com\/en\/coins\/ftx-token\" class=\"icon none\"> according to data provider
