US senator Toomey introduces stablecoin bill as congressional session wraps up &#8220;<span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><img decoding=\"async\" src=\"https:\/\/images.cointelegraph.com\/images\/840_aHR0cHM6Ly9zMy5jb2ludGVsZWdyYXBoLmNvbS91cGxvYWRzLzIwMjItMTIvYmI0NTIwMGUtYmY4ZC00NzE5LWI3NzEtMjkzYjdjZTBiZTI5LmpwZw==.jpg\" \/><\/p>\n<div class=\"post-content\" data-v-30a6cf80>Republican Senator Pat Toomey, who is set to retire from U.S. Congress at the end of the term, has used one of his last few weeks in office to introduce a new stablecoin bill, aimed at creating a regulatory framework for \u201cpayment stablecoins.\u201d<\/p>\n<p>Toomey \u2014 who also serves as the Ranking Member of the U.S. Banking Committee \u2014 <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.banking.senate.gov\/imo\/media\/doc\/stablecoin_trust_act_section-by-section.pdf\">said<\/a> the Dec. 21 bill, called the Stablecoin TRUST Act of 2022 would serve as a framework for stablecoin regulation for his fellow senators who are looking to push out stablecoin legislation in 2023.<\/p>\n<p>In a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.banking.senate.gov\/newsroom\/minority\/toomey-introduces-legislation-to-guide-future-stablecoin-regulation\">statement<\/a>, the senator called stablecoins an \u201cexciting technological development that could transform money and payments,\u201d adding: <\/p>\n<blockquote><p>\u201cBy digitizing the U.S. dollar and making it available on a global, instant, and nearly cost-free basis, stablecoins could be widely used across the physical economy in a variety of ways.\u201d<\/p><\/blockquote>\n<p>If passed by Congress, the bill would permit non-state and non-bank institutions to issue stablecoins, so long as they obtain a federal license that is created and issued by the U.S. Office of the Comptroller of the Currency (OCC) and that the stablecoins are backed up with \u201chigh-quality liquid assets.\u201d<\/p>\n<p>The stablecoin issuers must also comply with a new public disclosure standard, clearly outline redemption policies and provide regular attestations from authorized accounting firms. <\/p>\n<p>The bill would exempt stablecoin issuers from U.S. securities laws, so long as they don\u2019t offer interest-bearing products or services or otherwise act like an investment or advisory firm.<\/p>\n<p>Investor protection is also well embedded into the bill, with it stating that in the event of an issuer\u2019s insolvency, stablecoin holders will be the first to be reimbursed \u2014 which is perhaps the most notable difference between this bill and Toomey\u2019s earlier <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.banking.senate.gov\/imo\/media\/doc\/the_stablecoin_trust_act_-_section-by-section.pdf\">bill<\/a> that was introduced into Congress in Apr. 2022.<\/p>\n<p>The bill would also only <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ly to \u201cpayment\u201d stablecoins that can be directly converted to fiat by the issuer \u2014 such as the U.S. Dollar \u2014 not commodity-like or algorithmically-backed stablecoins. <\/p>\n<p><strong><em>Related: <\/em><\/strong><strong><em>Stablecoin regulations in the US: A beginner\u2019s guide<\/em><\/strong><\/p>\n<p>Toomey said he hoped the latest bill would lay the groundwork for his colleagues to pass legislation next year which would safeguard customer funds &#8220;without inhibiting innovation,\u201d the outgoing congressman said.<\/p>\n<p>However, it remains to be seen how Toomey\u2019s latest stablecoin will stack up against the Stablecoin Transparency Act, which was <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/3970\/all-info\">introduced<\/a> into Congress by fellow Republican Senator Bill Hagerty on Mar. 31. 2022. <\/p>\n<p>A key difference between the two is that the passing of the Stablecoin Transparency Act would categorize the issuance of stablecoins as securities under U.S. securities laws and\u00a0fully collateralized security repurchase agreements would need to be set in place.<\/p>\n<p>Toomey announced in a Dec. 16 speech to his fellow senators he will retire at the end of the Congressional session on Jan. 3. 2023.<\/p>\n<p>Replacing Toomey as the Senate Banking Committee\u2019s Ranking Member is Republican Senator Tim Scott, whose views on the digital asset industry haven\u2019t yet been publicized. <\/p>\n<p><template data-name=\"subscription_form\" data-type=\"law_decoded\"><\/template><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
