As a union member, he said the termination was \u201cin violation of the National Labor Relations Act\u201d and he wants to be compensated for damages.<\/p>\n<p>\u201cThis action also arises out of the breach by Plaintiff\u2019s union, Defendant Communications Workers of America, AFL-CIO (the \u2018Union\u2019), of the duty to provide fair representation, and of the breach by Plaintiff\u2019s employer, Defendant Verizon New York Inc. (\u201cVerizon\u201d), of the collective bargaining agreement,\u201d the document reads.<\/p>\n<div class=\"mobile outerAdHatch\">\n<div class=\"ad-border\">\n<div class=\"innerAdHatch\">\n<div id=\"contentUnit300\" class=\"adUnits\" inserted=\"shortcode\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>The docs go on to explain that the incident took place in April 2021 \u2013 when Kelly took a personal call on his work phone during his lunch break.<\/p>\n<p>\u201cIn discussing DMX\u2019s music Plaintiff used the word \u2018n####,\u2019 which is a word commonly used by the artist himself in his lyrics,\u201d the docs continue. \u201cUnbeknownst to Plaintiff, he had inadvertently answered a call on his company cellular phone, and a Verizon employee who listened to his private call for approximately forty-five seconds overheard him say the word \u2018n-gga.\u2019\u201d<\/p>\n<div class=\"mobile outerAdHatch\">\n<div class=\"ad-border\">\n<div class=\"innerAdHatch\">\n<div id=\"contentUnit400\" class=\"adUnits\" inserted=\"shortcode\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>After an investigation, Kelly was fired less than a month later for \u201cviolating Verizon\u2019s discrimination and harassment policy.\u201d<\/p>\n<p>Kelly and his attorney feel that the word flies all the time at work and he\u2019s unfairly being singled out.<\/p>\n<div class=\"mobile outerAdHatch\">\n<div class=\"ad-border\">\n<div class=\"innerAdHatch\">\n<div id=\"contentUnit500\" class=\"adUnits\" inserted=\"shortcode\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>\u201cDespite this alleged zero-tolerance policy, certain employees routinely use words like \u2018b####,\u2019 \u2018c###,\u2019 \u2018n-gger,\u2019 \u2018n-gga\u2019 and \u2018s###\u2019 in the workplace,\u201d the docs state. \u201cSuch language is used in the presence of management-level employees, yet when it is used by a female employee, an African American employee, and\/or a Hispanic employee, none is reprimanded or disciplined in any way.\u201d<\/p>\n<p>This isn\u2019t the first time a white fan has found themselves in hot water for using the n-word in relation to their favorite rapper.<\/p>\n<p>Back in August, a Wu-Tang Clan fan in the UK was fined \u00a3500 for using the n-word while rapping the lyrics to the group\u2019s debut single \u201cProtect Ya Neck.\u201d<\/p>\n<p>25-year-old Kyle\u00a0Siegel was recording himself rapping the 1993 song for TikTok while standing in a women\u2019s bathroom stall \u2013 unknowingly with a mixed-race\u00a0woman in the cubicle next to him who was left\u00a0\u201cseverely shocked\u201d by the incident.<\/p>\n<div class=\"mobile outerAdHatch\">\n<div class=\"ad-border\">\n<div class=\"innerAdHatch\">\n<div id=\"contentUnit600\" class=\"adUnits\" inserted=\"shortcode\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>While the defense said there were a few issues surrounding \u201cartistic freedom,\u201d he noted Siegel was not a \u201cperson of color.\u201d\u00a0He added that Siegel accepted \u201che crossed the line\u201d but didn\u2019t intend to harm anyone with his actions.\n<\/p><\/div>\n<p><\/p>\n<div class=\"author\" itemprop=\"author\" itemscope=\"\" itemtype=\"http:\/\/schema.org\/Person\"><meta itemprop=\"name\" content=\"Marisa Mendez\">by Marisa Mendez<\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
