LOUIS (AP) \u2014 A Missouri judge has ruled that a pardon from the governor doesn&#8217;t mean the St. Louis lawyer and his wife who gained national attention for <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/apnews.com\/article\/crime-george-floyd-gun-politics-st-louis-missouri-abdbb0285f3a940ef7dd5038b3474fe9\" data-ylk=\"slk:waving guns at racial injustice protesters\" class=\"link rapid-noclick-resp\">waving guns at racial injustice protesters<\/a> in 2020 should get back the weapons they surrendered and fines they paid after guilty pleas last year.<\/p>\n<p>Mark McCloskey sued last year to have returned a Colt AR-15 rifle and a Bryco .380-caliber pistol that he and his wife, Patricia McCloskey, surrendered when they pleaded guilty to charges stemming from the confrontation with protesters. McCloskey said he was entitled to the guns and remitted fines because Republican Gov. Mike Parson pardoned him and his wife weeks after their guilty pleas.<\/p>\n<p>On Wednesday, Circuit Judge Joan Moriarty ruled that the pardon had no bearing on the plea agreement, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.stltoday.com\/news\/local\/crime-and-courts\/judge-pardoned-gun-waving-lawyer-mark-mccloskey-wont-get-his-guns-or-money-back\/article_8d84af3f-e6f2-5038-b860-1c64a458847e.html\" data-ylk=\"slk:The St. Louis Post-Dispatch reported\" class=\"link rapid-noclick-resp\">The St. Louis Post-Dispatch reported<\/a>.<\/p>\n<p>\u201cPlaintiff and his wife are required to follow through with their end of the bargain,\u201d she wrote.<\/p>\n<p>Mark McCloskey said he plans to <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>eal.<\/p>\n<p>The McCloskeys <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/apnews.com\/article\/st-louis-indictments-racial-injustice-3bbed2ea6c982581e51b16123a785cfc\" data-ylk=\"slk:have said they felt threatened by protesters\" class=\"link rapid-noclick-resp\">have said they felt threatened by protesters<\/a> who walked on their private street past their home during global protests that followed the death of George Floyd in Minneapolis. They emerged from their home waving guns.<\/p>\n<p>They were each indicted on felony charges of unlawful use of a weapon and evidence tampering. Mark McCloskey later agreed to plead guilty to misdemeanor fourth-degree assault and was ordered to pay a $750 fine. Patricia McCloskey pleaded guilty to misdemeanor harassment and was ordered to pay a $2,000 fine.<\/p>\n<p>Earlier this year, the court <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/apnews.com\/article\/gun-politics-st-louis-missouri-3b17340363d269d9cf489f00ca72c542\" data-ylk=\"slk:suspended Mark and Patricia McCloskeys\u2019 law licenses\" class=\"link rapid-noclick-resp\">suspended Mark and Patricia McCloskeys\u2019 law licenses<\/a> but delayed the suspension and put the two on probation for a year. The order means the couple can still practice, but the suspension will take effect if they violate their probation by breaking any more laws.<\/p>\n<p>During <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/apnews.com\/article\/michael-brown-st-louis-5d8c0dd118abef6df4a4214becd2f30a\" data-ylk=\"slk:the 2021 sentencing hearing\" class=\"link rapid-noclick-resp\">the 2021 sentencing hearing<\/a>, Judge David Mason asked Mark McCloskey if he acknowledged that his actions put people at risk of personal injury. He replied, \u201cI sure did your honor.\u201d Afterward on the courthouse steps, McCloskey, at the time a Republican candidate for the U.S. Senate, said he&#8217;d do it again if faced with similar circumstances.<\/p>\n<p>Richard Callahan, the special prosecutor who investigated the case said his investigation determined that the protesters were peaceful.<\/p>\n<p>\u201cThere was no evidence that any of them had a weapon and no one I interviewed realized they had ventured onto a private enclave,\u201d he said in a news release after the McCloskeys pleaded guilty.<\/p>\n<\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
