\n Epic Games won a partial victory in its legal battle with Apple when a federal judge barred the Silicon Valley titan from kneecapping the \u201cFortnite\u201d maker\u2019s trademark development tool.<\/p>\n

US District Judge Yvonne Gonzalez Rogers barred Apple from restricting access to the Unreal Engine \u2014 which powers three-dimensional graphics in many video games \u2014 in retaliation for Epic circumventing Apple\u2019s App Store fees through its popular \u201cFortnite\u201d game.<\/p>\n

Apple had threatened to cut off Epic\u2019s developer tools this Friday, a move that could cause \u201csignificant damage to both the Unreal Engine platform itself, and to the gaming industry general<\/a>ly,\u201d Rogers said in her Monday ruling. She noted that the engine is used by small and large game developers and in other industries such as film, architecture and medical training.<\/span><\/p>\n

\u201cEpic Games and Apple are at liberty to litigate against each other, but their dispute should not create havoc to bystanders,\u201d Rogers wrote in the decision.<\/p>\n

But Rogers refused to force Apple to let \u201cFortnite\u201d back into the App Store after booting it roughly two weeks ago \u2014 a decision that sparked Epic\u2019s lawsuit over Apple\u2019s practice of taking a 30 percent cut of purchases made through iPhone apps.<\/p>\n

Apple removed \u201cFortnite\u201d \u2014 a popular battle game with millions of players \u2014 after Epic introduced a system to accept payments directly. With respect to \u201cFortnite,\u201d Rogers said Epic\u2019s \u201ccurrent predicament appears of its own making\u201d given that the company \u201cstrategically chose to breach its agreements with Apple.\u201d<\/p>\n

\u201cEpic Games moves this Court to allow it to access Apple\u2019s platform for free while it makes money on each purchase made on the same platform,\u201d Rogers wrote. \u201c\u2026 Not even Epic Games gives away its products for free.\u201d<\/p>\n

Neither Epic nor Apple immedia<\/a>tely responded to requests for comment Tuesday morning.<\/p>\n

The case is one of the highest-profile challenges yet to Apple\u2019s steep commissions on in-app purchases, which Epic has called \u201coppressive\u201d and anticompetitive. Several other tech firms have sided with Epic, including Facebook, Spotify and Tinder owner Match Group.<\/p>\n

Apple has said it looks forward to working with Epic to bring \u201cFortnite\u201d back to the App Store even though it broke Apple\u2019s rules.\n <\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/div>\n
