In recent years, the bloc has doled out <\/span><span style=\"font-weight: 400;\">vast antitrust fines<\/span><span style=\"font-weight: 400;\"> to Silicon Valley giants, set <\/span><span style=\"font-weight: 400;\">global standards for data privacy<\/span><span style=\"font-weight: 400;\">, and proposed a raft of digital regulations. Yet critics say the rules have been ineffective.<\/span><\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4017504\"><span>Analysts claim<\/span><\/a><span> the legislation has failed to protect competition, while giving companies <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.theguardian.com\/commentisfree\/2022\/jun\/28\/i-saw-first-hand-tech-giants-seduced-eu-google-meta\"><span>routes to avoid enforcement<\/span><\/a><span>. In 2023, the bloc has grand ambitions to change that.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A key component of the plans is the new Digital Markets Act (DMA). The landmark legislation prohibits platforms from ranking their own products more favorably than those of third parties, and from processing data collected from different services. Fines for single infringements can reach 10% of the offenders\u2019 global turnover, and up to 20% for repeated violations. style=\"font-weight: 400;\">Hodgson, meanwhile, pointed to the effects on opening up access.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe DMA stipulates that big tech must open up its APIs to enable widespread interoperability,\u201d he said. \u201cIt\u2019s a huge step forwards, but the best interoperability comes from a widely adopted open standard rather than a tangle of bridges \u2014 as demonstrated by both the web and email.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><\/p>\n<blockquote class=\"c-richText__pullQuote\">\n<div class=\"c-richText__pullQuoteGradient\">\n<p class=\"c-richText__pullQuoteQuote\">\u201cThe DMA will force a change in behavior.\n            <\/div>\n<\/blockquote>\n<p><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Supporters and opponents alike agreed that the DMA will have deep repercussions.<\/span> <span style=\"font-weight: 400;\">Geoff Blaber, the CEO of analyst firm <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ccsinsight.com\/\"><span style=\"font-weight: 400;\">CCS Insight<\/span><\/a><span style=\"font-weight: 400;\">, envisions its influence extending far beyond European borders.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe predict that the DMA will force a change in behavior from large tech players in Europe that is likely to ripple through business operations globally,\u201d Blaber wrote in <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ccsinsight.com\/company-news\/ccs-insights-predictions-for-2023-and-beyond-revealed\/#:~:text=This%20year%20the%20research%20team,connected%20devices%20and%20virtual%20worlds.\"><span style=\"font-weight: 400;\">a recent report<\/span><\/a><span style=\"font-weight: 400;\">. \u201cIt will also further motivate US politicians keen to avoid a scenario in which Europe defines the antitrust agenda without US involvement. A degree of harmony and consistency between US and EU legislation would be a clear advantage but is by no means assured.\u201d<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Making_business_plans\"><\/span>Making business plans<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Increasing competition could leave gaps for European challengers to enter. The EU, however, has historically struggled to turn its world-leading research into big tech companies.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One barrier is the notoriously slow and inefficient transfer of IP from academia to the economy. This problem is illustrated by the EU producing more research papers than the US, but turning far fewer into commercial applications.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.linkedin.com\/in\/luigicongedo\"><span style=\"font-weight: 400;\">Luigi Congedo<\/span><\/a><span style=\"font-weight: 400;\">, a venture capitalist and Innovation Advisor at marketing firm <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/clarity.global\/?utm_term=clarity%20global&amp;utm_campaign=S_Brand_Global_EN&amp;utm_source=google&amp;utm_medium=cpc&amp;hsa_acc=4084961366&amp;hsa_cam=12356087710&amp;hsa_grp=150194557868&amp;hsa_ad=626974318007&amp;hsa_src=g&amp;hsa_tgt=kwd-878177048598&amp;hsa_kw=clarity%20global&amp;hsa_mt=e&amp;hsa_net=adwords&amp;hsa_ver=3&amp;gclid=Cj0KCQiA99ybBhD9ARIsALvZavXpDZavv9Z9JufLtDkJeML9W8kLnjo-NHU84adv3-MfuMSrQPMCvz0aAox-EALw_wcB\"><span style=\"font-weight: 400;\">Clarity<\/span><\/a><span style=\"font-weight: 400;\">, this weakness can be reduced by changing the EU\u2019s investment framework. This, he argues, could stimulate a more effective <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/technology\/\" data-internallinksmanager029f6b8e52c=\"4\" title=\"Technology\" target=\"_blank\" rel=\"noopener\">technology<\/a> transfer \u2014 and prevent promising startups from being acquired by Silicon Valley giants.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe need to create our Google, <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Facebook<\/a>, and Microsoft, and, in order to do it, create a better environment to compete and do business across the continent,\u201d he said. \u201cIf we fail in creating a real European platform for innovation and instead maintain the current \u2018country-based model,\u2019 all our emerging businesses will end up becoming M&amp;A targets for American multinational companies.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><\/p>\n<blockquote class=\"c-richText__pullQuote\">\n<div class=\"c-richText__pullQuoteGradient\">\n<p class=\"c-richText__pullQuoteQuote\">\u201cI expect more openness.\n            <\/div>\n<\/blockquote>\n<p><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another issue for tech businesses in the EU is integration across member states. Companies have long complained about the complexity of navigating the union\u2019s tax and employment requirements. While he welcomes the investment, he\u2019s worried that the bloc will wrap the sector in red tape.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cProviding funding for businesses in a supply-threatened environment offers some obvious fail-safes in times of trouble,\u201d he said. \u201cHowever, EU projects can become somewhat mired in bureaucracy, and the velocity can be sucked out as a result.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><\/p>\n<blockquote class=\"c-richText__pullQuote\">\n<div class=\"c-richText__pullQuoteGradient\">\n<p class=\"c-richText__pullQuoteQuote\">\u201cThis will help fuel innovation.\n            <\/div>\n<\/blockquote>\n<p><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another focus area for the EU is artificial intelligence. The European Parliament is currently finalizing its flagship AI Act, which will place stringent rules on high-risk artificial intelligence systems.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">IT companies hope the legislation boosts European innovation. Matt Peake, Global Director of Public Policy at <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/onfido.com\/\"><span style=\"font-weight: 400;\">Onfido<\/span><\/a><span style=\"font-weight: 400;\">, an ID verification firm, believes it could provide regulatory clarity, without the burdens of excessive compliance and operational costs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThis will ultimately help fuel innovation in AI, which helps to reduce bias, and drive more inclusive online services,\u201d he said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ultimately, the EU hopes to stimulate innovation by leveling the playing field.
