Franklin\u00a0sued Behar in April 2019, alleging his colleague fabricated and twisted information and gave it to the <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a> and Warner Bros. in an effort to get him thrown off the show. <\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n    Behar filed a special motion to strike the complaint under California\u2019s\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.scribd.com\/document\/510637835\/Franklin-v-Behar-Motion-to-Strike\">anti-SLAPP statute<\/a>, which brings an early end to lawsuits arising from protected activity like free speech unless the plaintiff can prove they\u2019re likely to prevail. Behar said Warners approached him and his statements to the company investigator about Franklin are \u201cindisputably\u201d activity in furtherance of his right of free speech. While he maintains he didn\u2019t talk to the press he argues that, if he had, that would also be protected by the First Amendment.<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n    L.A. County Superior Court Judge Craig Karlan granted the motion, first finding that the matter is clearly of public interest, as it involved sexually charged comments in the workplace that were reported at the height of the #MeToo movement and Franklin\u2019s firing was widely covered by <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">news<\/a> outlets.<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n    Having met that standard under the statute, Karlan then turned his analysis to whether Franklin is likely to prevail on his claim for intentional interference with prospective economic advantage.<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n    Judge Karlan isn\u2019t convinced Franklin can prove Behar got him fired. <\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n    The judge notes that Warners\u2019 investigator said Behar\u2019s statements weren\u2019t a \u201csubstantial factor\u201d in the determination that Franklin had created a toxic work environment and merely \u201ccorroborated some of the statements made by the other witnesses.\u201d She also testified that Behar was reluctant to participate in the process and that this wasn\u2019t the first investigation into Franklin\u2019s conduct on the show.<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n    \u201cSimply put, Plaintiffs present insufficient evidence that Behar was a substantial factor in the termination of the relationship between Plaintiffs and Warner Bros.,\u201d writes Karlan. \u201cHowever, even if Plaintiffs had established the possibility that Behar\u2019s statements to Warner Bros. resulted in Franklin\u2019s termination, his statements are privileged under Civil Code section 47, subdivision (c), as they constitute communications regarding sexual harassment made as part of a workplace investigation.\u201d<\/p>\n<p class=\"paragraph larva \/\/  a-font-body-m     \">\n    He continues, \u201cFinally, the Court notes that Plaintiffs present no admissible evidence that Behar made statements to the press.
