Judge slams senators\u2019 letter against FTX lawyers as \u2018inappropriate\u2019 &#8220;<span class=\"ez-toc-section-end\"><\/span><\/h1>\n<div class=\"post-content\" data-v-6ed77c39>The judge handling FTX\u2019s bankruptcy has reportedly slammed a joint letter from four United States senators calling for an independent examiner in the case.<\/p>\n<p>As reported by Cointelegraph, the senators sent a letter on Jan. 9 highlighting concerns about the ties between FTX and Sullivan &amp; Cromwell LLP, which as the lead law firm in the bankruptcy proceedings would be tasked with scrutinizing alleged past wrongdoing by the exchange.<\/p>\n<p>However, during a Jan. 11 hearing, Judge John Dorsey of the U.S. Bankruptcy Court for the District of Delaware called the letter \u201cin<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ropriate ex parte communication\u201d thathe would not take into account in his decision.<\/p>\n<p>\u201cI will make my decisions on the matters based only upon admissible evidence and the arguments presented in open court,\u201d he said during the hearing, according to a Law360 <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.law360.com\/fintech\/articles\/1564888\/senators-sullivan-cromwell-qualms-won-t-sway-ftx-judge\">report<\/a>\u00a0on Jan. 11.<\/p>\n<figure><img decoding=\"async\" src=\"https:\/\/s3.cointelegraph.com\/uploads\/2023-01\/56ed9f68-71af-41c4-b63b-7c1c323f7184.png\"><figcaption style=\"text-align: center;\"><em>Cast your vote now!<\/em><\/figcaption><\/figure>\n<p>Ex parte refers to an action taken by one party in a legal proceeding without participation from the opposing party.<\/p>\n<p>The\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/restructuring.ra.kroll.com\/FTX\/Home-DownloadPDF?id1=MTQzNzUzNA==&amp;id2=-1\">letter<\/a>\u00a0was sent to Judge Dorsey on Jan. 9 by a bipartisan group of senators \u2014 John Hickenlooper, Thom Tillis, Elizabeth Warren and Cynthia Lummis\u00a0\u2014 questioning the appointment of Sullivan &amp; Cromwell and supporting a motion for the\u00a0appointment of an independent examiner.<\/p>\n<p>The motion was\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/restructuring.ra.kroll.com\/FTX\/Home-DownloadPDF?id1=MTM1Mzg3OA==&amp;id2=-1\">filed<\/a> by the U.S. Trustee on Dec. 12.<\/p>\n<p>In the letter, the senators noted that the law firm has previously provided FTX with legal advice and that members of the law firm had left to take positions at FTX, prompting one of the senators to suggest there could be a conflict of interest.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">Get this: FTX\u2019s legal advisors *pre-collapse* want to be appointed to oversee investigations INTO the collapse.<\/p>\n<p>I\u2019m no legal expert, but that sounds like a conflict of interest. With <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/SenThomTillis?ref_src=twsrc%5Etfw\">@SenThomTillis<\/a> <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/SenWarren?ref_src=twsrc%5Etfw\">@SenWarren<\/a> <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/SenLummis?ref_src=twsrc%5Etfw\">@SenLummis<\/a><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/t.co\/iz3k9yP1uT\">https:\/\/t.co\/iz3k9yP1uT<\/a><\/p>\n<p>\u2014 Senator John Hickenlooper (@SenatorHick) <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/SenatorHick\/status\/1612821398237450243?ref_src=twsrc%5Etfw\">January 10, 2023<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>A spokesperson from Sullivan &amp; Cromwell told Cointelegraph that the law firm met the definition of \u201cdisinterested\u201d under the U.S. Bankruptcy Code and had \u201cnever served as primary outside counsel to any FTX entity.&#8221;<\/p>\n<p><strong>Related: <\/strong><strong><em>FTX customers names will remain sealed for now, rules judge<\/em><\/strong><\/p>\n<p>The judge\u2019s dismissal of the senators\u2019 letter does not mean that he will reject the motion to appoint an independent examiner or approve Sullivan &amp; Cromwell as counsel to FTX.<\/p>\n<p>The judge will still need to review the objection to the Sullivan &amp; Cromwell appointment from FTX creditor Warren Winter, whose representatives filed an amended <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/restructuring.ra.kroll.com\/FTX\/Home-DownloadPDF?id1=MTQzNzQ4Ng==&amp;id2=-1\">objection<\/a> on Jan. 10 claiming that the appointment could undermine the public\u2019s faith in the bankruptcy process and the law firm itself was a \u201ctarget for investigation\u201d regarding its own \u201cpotential liability.\u201d<\/p>\n<p>Independent examiners are often appointed by bankruptcy courts to investigate details of complex cases brought before them and are able to present information to the courts from an independent point of view.<\/p>\n<p>They have been appointed in other high-profile bankruptcy cases such as Lehman Brothers during the subprime mortgage crisis and the crypto exchange Celsius.<\/p>\n<p><template data-name=\"subscription_form\" data-type=\"markets_outlook\"><\/template><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
