Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ling with how to prevent future breaches.\u00a0<\/p>\n<p>The source of the draft abortion decision leak\u00a0may never be known, but investigators in an extensive probe identified security gaps in how sensitive documents circulate among dozens of the high court\u2019s employees.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>The court\u2019s justices \u2014 six conservatives and three liberals \u2014 must now decide whether to\u00a0act on the recommendations of their investigators, including curtailing document access, considering support of legislation regarding leaks and updating <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/technology\/\" data-internallinksmanager029f6b8e52c=\"4\" title=\"Technology\" target=\"_blank\" rel=\"noopener\">technology<\/a>.<\/p>\n<p>An unsigned court statement accompanying the Supreme Court marshal\u2019s report argued it remains \u201cessential that we deliberate with one another candidly and in confidence,\u201d calling the leak a \u201cgrave assault on the judicial process.\u201d<\/p>\n<p>Here\u2019s what investigators recommended to the justices:<\/p>\n<p><strong>Curtailing access to documents\u00a0<\/strong><\/p>\n<p>Many of the recommendations would scrutinize who receives access to draft opinions.<\/p>\n<p>The marshal suggested too many people have access to sensitive materials after the investigation revealed 82 employees possessed the draft Dobbs opinion when Politico published it.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>University of Richmond Williams Chair in Law Carl Tobias said he doesn\u2019t think the justices will restrict document flow to an extent that would impair the court\u2019s work.\u00a0<\/p>\n<p>\u201cI don\u2019t think [Chief Justice John] Roberts will allow it, and neither will the justices,\u201d he said. \u201cI think they will go forward with some tightened security, and there may be fewer people with access.\u201d\u00a0\u00a0\u00a0<\/p>\n<p>The investigation additionally revealed that multiple employees told their spouses about the draft opinion, which violates law clerks\u2019 code of conduct. The marshal recommended creating a universal policy for handling draft opinions and increased employee training.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>\u201cSeveral personnel told investigators they had shared confidential details about their work more <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a>ly with their spouses and some indicated they thought it permissible to provide such information to their spouses,\u201d the report states.\u00a0<\/p>\n<p><strong>Supporting legislation<\/strong><\/p>\n<p>The marshal\u2019s recommendations also include considering support of legislation to expressly prohibit unauthorized disclosures.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>A group of 12 House Republicans in the days following the abortion opinion leak\u00a0introduced a bill\u00a0that would bar Supreme Court employees and officers from knowingly disclosing confidential information, although the legislation would need to be reintroduced in the new Congress for consideration.\u00a0<\/p>\n<p>Stephen Vladeck, a law professor at the University of Texas at Austin, said previous justices have recommended reforms related to the court, but the practice has become increasingly unusual in recent years.\u00a0<\/p>\n<p>\u201cThere\u2019s no broader tradition of treating all closely held government information as a criminal offense if leaked, and I think that\u2019s a good thing,\u201d Vladeck said.<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p><strong>Updating Technology<\/strong><\/p>\n<p>The marshal also suggested various technological improvements so the court can enhance security and better track when employees view, share and destroy sensitive documents.<\/p>\n<p>Many printers, including some in justices\u2019 chambers, weren\u2019t connected to the court\u2019s networks and couldn\u2019t be tracked, according to the report.\u00a0Others didn\u2019t have sufficient tracking capabilities.<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>Legal observers acknowledged that many specifics of the court\u2019s response will likely remain private,\u00a0stressing that tradition gives justices some autonomy in running their own chambers.<\/p>\n<p>\u201cThe insular attitude reflected in the report is, I think, a symptom of a broader disease,\u201d Vladeck said.<\/p>\n<p>The scrutiny comes as justices reject growing perceptions that the court is fundamentally partisan.<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>\u201cI think it\u2019s going to ruffle some feathers and probably lead to perhaps some acrimony,\u201d Jared Carter, an assistant professor at Vermont Law and Graduate School, said of the fallout. \u201cBut I think that\u2019s small potatoes when you look at the broader implications of the public losing faith in the court.\u201d\u00a0<\/p>\n<p>The court is preparing to\u00a0hand down the first opinion\u00a0of this year\u2019s term on Monday, and it will mark the slowest-ever release of the court\u2019s first opinion, according to\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/empiricalscotus.com\/2022\/12\/26\/why-2022-is-already-a-term-like-no-other\/\">Empirical SCOTUS<\/a>\u00a0author Adam Feldman.\u00a0<\/p>\n<p>Some court observers acknowledged that increased security may be playing a role, while others noted a high number of emergency applications and divisive cases could be contributors.<\/p>\n<p>\u201cIt\u2019s late, and some are attributing that to the fact that there is a lack of trust or cooperation or collegiality,\u201d said Tobias, the University of Richmond professor.<\/p>\n<\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
