What happened?<span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p>WASHINGTON\u00a0\u2013\u00a0Heading into the winter months when COVID-19 cases spike, the Biden administration knew it had a problem.<\/p>\n<p>Fewer than half of nursing home residents across the country, who are at higher risk of seriousness illness and death from COVID-19, were up to date on their vaccines.<\/p>\n<p>While offering assistance to get more seniors in senior facilities boosted, the federal government\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cms.gov\/files\/document\/qso-23-03-all.pdf\">reminded nursing homes<\/a> they\u2019re required to\u00a0offer all vaccines, including boosters, to residents and staff and educate them on their benefits.<\/p>\n<p>Failure to do so could lead nursing homes to face greater oversight and\u00a0enforcement actions, the Biden administration said.<\/p>\n<p>Boosted rates went up from shortly before Thanksgiving to the start of the\u00a0year \u2013\u00a0but only by 5.5 percentage points \u2013 leaving roughly half the population of nursing home residents without ongoing protection from the deadly virus as winter set in.\u00a0Data released in the next two weeks will provide a clearer picture of whether a national spike in cases in nursing homes in mid-December led to serious illness, which is what vaccinations help prevent.\u00a0<\/p>\n<p>Meanwhile, state regulators reported only\u00a0378\u00a0instances of homes not meeting this requirement during 2022, according to a USA TODAY tabulation of violation reports.\u00a0Enforcement occurs at the state level, with inspections h<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ening about once a year\u00a0on a rolling basis for the nation\u2019s more than 15,000 nursing homes.<\/p>\n<p>For most of the year, inspectors issued an average of 36 citations a\u00a0month for not providing required vaccine education. Just 23 were issued in November and only seven in December, when the White House was pushing the\u00a0initiative.<\/p>\n<p>Only 24 of the citations in 2022 received a severity code high enough to trigger a fine, including one in November and one in December, according to USA TODAY&#8217;s analysis.<\/p>\n<p>\u201cYou can draw a reasonable conclusion from the fact the (vaccination) numbers are so low, that whatever you&#8217;re doing isn&#8217;t working,\u201d said Sam Brooks, director of public policy for the National Consumer Voice for Quality Long-Term Care.<\/p>\n<p><span class=\"exclude-from-newsgate\"><strong style=\"margin-right:3px\">&#8216;A red flag&#8217;: <\/strong>Biden administration targets antipsychotic drugs dispensed in nursing homes<\/span><\/p>\n<p><span class=\"exclude-from-newsgate\"><strong style=\"margin-right:3px\">More: <\/strong>This nursing home chain reported the highest COVID death rate. Then it deleted deaths.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" alt=\"White House COVID-19 Response Coordinator Ashish Jha speaks during the daily briefing at the White House in Washington, Thursday, Dec. 15, 2022.\" data-uuid=\"81caa5cc-8e95-35bf-b791-ec8032b137be\" height=\"683\" id=\"10905629002\" src=\"https:\/\/media.zenfs.com\/en\/aol_usatoday_us_articles_590\/ea530e72032b4b98b393f1d12119d530\" width=\"1024\"><\/p>\n<h2 class=\"presto-h2\"><span class=\"ez-toc-section\" id=\"States_with_lowest_boosted_rates_in_nursing_homes\"><\/span>States with lowest boosted rates in nursing homes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>There\u2019s considerable variation in vaccination rates across the country.<\/p>\n<p>In the five top states \u2013 South Dakota, Alaska, Hawaii, Delaware and North Dakota \u2013 more than 7 in 10 nursing home residents are up to date on vaccines.<\/p>\n<p>In the five worst states \u2013 Arizona, Florida, Nevada, Texas and Mississippi \u2013 fewer\u00a0than 37% are.<\/p>\n<p>.oembed-frame {width:100%;height:100%;margin:0;border:0;}<\/p>\n<div class=\"oembed-frame\"><\/div>\n<p>Nursing home associations say progress is being made and an all-hands-on-deck effort by the public and private sector continues to be needed to increase rates, particularly persuading seniors of their importance.\u00a0<\/p>\n<p>\u201cThe story is truly that nursing homes are trying, and in fact, they are making real progress at a time when the overall American public is less than enthusiastic about boosters,\u201d said Lisa Sanders, a spokeswoman for LeadingAge, the largest association for nonprofit nursing homes.\u00a0<\/p>\n<p>Among the 1.2 million people now living in nursing homes, the Centers for Medicare and\u00a0Medicaid Services (CMS) reports that 8% have declined a COVID-19 vaccination when offered. That counts only people who have received no shots. The number of people who decline boosters is not tracked.<\/p>\n<p>There are still about 1,000 nursing homes who have no vaccinated residents, Department of Health and Human Services Secretary Xavier Becerra reminded nursing home providers Wednesday. <\/p>\n<p>In Arizona, where about 31% of nursing home residents had\u00a0received the latest booster at the start of the year, the state health department is working\u00a0to improve that rate, according to spokesman Steve Elliott.<\/p>\n<p>When nursing homes said they were having trouble getting vaccination providers to visit a facility for just a handful of patients, the health department promoted state-funded clinics.<\/p>\n<p>\u201cWe will accommodate even if just one person at a home or facility wishes to get the booster,\u201d Elliott said in a detailed written response to USA TODAY.<\/p>\n<p>Still, some nursing homes report even that\u00a0is difficult\u00a0to arrange because\u00a0employees are\u00a0stretched thin with staffing, an early surge in influenza and RSV, and the pandemic.<\/p>\n<p>Other efforts to increase booster rates in Arizona include having surveyors\u00a0distribute information on free mobile clinics when\u00a0inspecting nursing homes and a new <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">social media<\/a> campaign promoting\u00a0expanded online information about getting boosted.<\/p>\n<p>\u201cThere obviously,\u201d Elliot said, \u201cis much more to be done.\u201d<\/p>\n<p>CMS administrator Chiquita Brooks-LaSure told USA TODAY in a statement that nursing homes need to \u201cmake this their number one\u00a0priority.\u201d\u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" alt=\"Tina Sandri, CEO of Forest Hills of DC senior living facility, center, greets residents Cherie Neville, left, and Catherine Doleman on Thursday, Dec. 8, 2022, in Washington. As nursing home leaders redouble efforts to get staff and residents boosted with the new vaccine version, now recommended for those 6 months and older, they face complacency, misinformation and COVID-19 fatigue.\" data-uuid=\"f9344517-3bf9-3616-b8a6-6399edabb01c\" height=\"682\" id=\"10900320002\" src=\"https:\/\/media.zenfs.com\/en\/aol_usatoday_us_articles_590\/eb42b0454ba476cc4796668b4c1ffa33\" width=\"1023\"><\/p>\n<h2 class=\"presto-h2\"><span class=\"ez-toc-section\" id=\"%E2%80%98Enforcement_is_the_weakest_link\"><\/span>&#8216;Enforcement is the weakest link&#8217;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cms.gov\/files\/document\/qso-21-19-nh.pdf\"> federal government began requiring <\/a>nursing homes to educate staff and residents about COVID-19 vaccines and to offer to help get them vaccinated in mid-2021.<\/p>\n<p>Even before COVID-19, when nursing homes became an epicenter of the pandemic, infection prevention and control was a persistent problem in nursing homes,<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.gao.gov\/assets\/gao-20-576r.pdf\"> according to the U.S. Government Accountability Office<\/a>, the independent oversight agency that recommended the vaccination requirement.<\/p>\n<p>But Brooks, of the National Consumer Voice for Quality Long-Term Care, said, reviewers can be reluctant to cite a violation if they don\u2019t see an immediate harm, such as a number of deaths from COVID-19.\u00a0<\/p>\n<p>And nursing homes are rarely fined when problems are found, which makes\u00a0it too easy to avoid requirements, he and other advocates argue.\u00a0<\/p>\n<p>\u201cEnforcement is the weakest link in the regulatory system,\u201d said Toby Edelman, senior policy attorney for the Center for Medicare Advocacy.<\/p>\n<p><span class=\"exclude-from-newsgate\"><strong style=\"margin-right:3px\">USA TODAY investigation: <\/strong>This nursing home chain stood out for nationally high death rates as pandemic peaked\u00a0<\/span><\/p>\n<p>A USA TODAY investigation\u00a0has detailed the challenges inspectors face gathering enough evidence to back up citations that might trigger fines, payment denials or other penalties.<strong><\/strong><\/p>\n<p>It is rare for nursing homes to be penalized with &#8220;payment denials&#8221; until they make corrections and even less common for them to lose their certification for federal\u00a0payments.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" alt=\"In this file photo, registered nurse Natalie O'Connor loads syringes with the Moderna COVID-19 vaccine at Hartford HealthCare at Home in Bloomfield, Connecticut on February 12, 2021, before heading out to see patients at their homes.\" data-uuid=\"d8763cde-d305-3e91-a819-d6be555f982f\" height=\"3280\" id=\"6441695001\" src=\"https:\/\/media.zenfs.com\/en\/aol_usatoday_us_articles_590\/1a1340d72c64d8f2cb28f8285fab1a2a\" width=\"4928\"><\/p>\n<h2 class=\"presto-h2\"><span class=\"ez-toc-section\" id=\"Biden_administration_leans_on_states\"><\/span>Biden administration leans on states\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Administration officials said they use progressive enforcement, and the first step of a correction plan for problems of lower severity is\u00a0a crucial tool\u00a0even if that doesn&#8217;t\u00a0result in a fine.\u00a0Regulation violations are also part of the public record that <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.medicare.gov\/care-compare\/\">consumers can check<\/a> when evaluating a nursing home.\u00a0<\/p>\n<p>In addition, the Biden administration has tried to get states to step up enforcement.<\/p>\n<p>At the start of the year, Brooks-LaSure wrote the governors of the five states with the lowest nursing home vaccination rates to ask for a meeting to discuss how the rates could be improved.<\/p>\n<p>And, officials said, they\u2019ve combined enforcement with assistance, including allowing nursing home staff to administer boosters directly as many had requested.<\/p>\n<p>Through the groups of health quality experts on contract with the federal government, CMS also offered individualized help to more than 85% of nursing homes. That led to more than 150 vaccination clinics across the country, serving 4,134 nursing homes residents, according to the agency.<\/p>\n<p>The administration also is encouraging hospitals to boost patients before they\u2019re discharged to nursing homes.<\/p>\n<p>The efforts helped. A common view that the booster shot isn\u2019t necessary, despite the evidence to the contrary, is \u201cthe number one problem,\u201d he said in a statement.<\/p>\n<h2 class=\"presto-h2\"><span class=\"ez-toc-section\" id=\"Few_nursing_home_workers_are_boosted\"><\/span>Few nursing home workers are boosted<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The nursing home staff that are required to educate residents about vaccinations aren\u2019t setting an example with their own behavior.
