The proposed regulation would require schools to use the \u201cpreponderance of evidence\u201d standard\u00a0most of the time.<\/em><\/p>\n<p>A long-awaited Title IX rule directing\u00a0how federally funded schools and colleges handle\u00a0sex and gender discrimination\u00a0will become public\u00a0in May,\u00a0the\u00a0Education Department<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.reginfo.gov\/public\/do\/eAgendaViewRule?pubId=202210&amp;RIN=1870-AA16\"> said<\/a>,\u00a0though it&#8217;s unclear when it would take effect.<\/p>\n<p>Emma Grasso Levine\u00a0of the national group Know Your IX &#8211;<strong>\u00a0<\/strong>Advocates for Youth, and dozens of others like her,<b><\/b>have<strong>\u00a0<\/strong>been eager for a\u00a0revision of a Trump-era regulation, which critics argue expanded the rights of those accused of sexual misconduct,\u00a0to the detriment of their accusers.\u00a0<\/p>\n<p>They&#8217;ve been\u00a0frustrated by the\u00a0Biden administration&#8217;s timeline for rewriting the rules:\u00a0Until <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/docs\/titleix-regs-unofficial.pdf\">the regulation crafted by former Education Secretary Betsy DeVos<\/a> is replaced, it remains in effect.<\/p>\n<p>&#8220;We&#8217;re h<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>y to see the Biden administration update the regulations\u00a0to a May date, finally,&#8221; Grasso Levine said. &#8220;Reaching the final rule is really crucial to student survivors being failed by schools.&#8221;<\/p>\n<p><span class=\"exclude-from-newsgate\"><strong style=\"margin-right:3px\">Survivors bear the brunt: <\/strong>Despite men\u2019s rights claims, colleges expel few sexual misconduct offenders<\/span><\/p>\n<p><span class=\"exclude-from-newsgate\"><strong style=\"margin-right:3px\">Title IX rule rewrite: <\/strong>Biden administration proposes protections for transgender students and against sexual violence in schools<\/span><\/p>\n<p>President Joe Biden\u00a0pledged to change the Title IX\u00a0rules during his presidential campaign, but his administration\u00a0didn&#8217;t propose a rule\u00a0until\u00a0last June.\u00a0For the last five\u00a0months, the Education Department\u00a0has been reviewing <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.regulations.gov\/document\/ED-2021-OCR-0166-0001\">more than\u00a0238,000 public comments<\/a>\u00a0on the proposal.<\/p>\n<p>Many opponents complained about provisions that would\u00a0add\u00a0protections for students who accuse others of sexual assault or harassment, include new protections against sex discrimination for LGBTQ+ students and an\u00a0item that isn&#8217;t<strong>\u00a0<\/strong>even in the proposal: one that would allow transgender\u00a0students to participate on sports teams that align with their gender identity.<\/p>\n<p>&#8220;While parents across the country are demanding the rejection of &#8216;woke&#8217; policies, the Department of Education instead has chosen to hijack Title IX to force gender ideology on children without their parents\u2019 knowledge or approval,&#8221; one commenter\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.regulations.gov\/comment\/ED-2021-OCR-0166-1647\">said<\/a>.<\/p>\n<p><span class=\"exclude-from-newsgate\"><strong style=\"margin-right:3px\">Should access to period products be part of Title IX?\u00a0<\/strong>The Education Department is weighing input.<\/span><\/p>\n<h2 class=\"presto-h2\"><span class=\"ez-toc-section\" id=\"What_is_Title_IX\"><\/span>What is Title IX?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/docs\/tix_dis.html\">1972\u00a0law<\/a>\u00a0bans sex discrimination in\u00a0public schools, colleges and universities that receive federal funding.
