Lawyers for the administration will be seeking to fend off challenges to block its plan to forgive up to $20,000 in student debt for qualifying borrowers.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>Rulings in the cases are expected by the summer. Here\u2019s a preview of the two big clashes.<\/p>\n<p><strong>Section 230<\/strong><\/p>\n<p>The justices on Tuesday will hear Gonzalez v. Google, which could upend protections internet companies have had throughout the nearly two-decade rise of social media.<\/p>\n<p>The plaintiffs, relatives of a victim who was among the more than 100 people killed in a <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/watch-movies-tv-seriess\/\" data-internallinksmanager029f6b8e52c=\"8\" title=\"Watch Movies &amp; TV Series\" target=\"_blank\" rel=\"noopener\">series<\/a> of attacks by Islamic State terrorists in\u00a0Paris\u00a0in November 2015,\u00a0sued Google under federal anti-terrorism laws.<\/p>\n<p>The family accused Google of aiding and abetting terrorism by purportedly recommending\u00a0pro-ISIS content to users on YouTube, but\u00a0Google argues that its recommendations are protected by Section 230, a controversial provision that shields internet companies from liability for content provided by a third-party user.\u00a0<\/p>\n<p>The tech industry contends that taking the family\u2019s side would dampen a critical shield that effectively allows the modern internet to function.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>\u201cRecommendation algorithms are what make it possible to find the needles in humanity\u2019s largest haystack,\u201d Google <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21-1333\/252127\/20230112144706745_Gonzalez%20v.%20Google%20Brief%20for%20Respondent%20-%20FINAL.pdf\">wrote in its\u00a0b<\/a>rief.\u00a0<\/p>\n<p>The dispute may also have broader impacts beyond the tech industry.\u00a0\u00a0<\/p>\n<p>On Wednesday, the justices will interpret the anti-terrorism law that the family believes makes Google liable in the first place.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>The court will take it up through Twitter v. Taamneh, a case brought by relatives of another ISIS terrorist attack victim that levies similar allegations against social media platforms.<\/p>\n<p>Google has suggested that siding with the tech industry in Taamneh would resolve both cases, because Google wouldn\u2019t have any liability to need Section 230\u2019s protections.<\/p>\n<p>Sen. Chuck Grassley (R-Iowa) and some legal scholars\u00a0argue taking Big Tech\u2019s position\u00a0would let terrorism sympathizers off the hook, while other observers contend that holding the companies liable would lead foreign countries to reciprocate in their courts against the U.S.<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p><strong>Student debt forgiveness<\/strong><\/p>\n<p>The Biden administration will attempt to save its student debt forgiveness program on Feb. 28, when the Supreme Court will\u00a0hear two challenges\u00a0to the plan.<\/p>\n<p>Six Republican-led states and two individual loan borrowers who did not qualify for the relief argue the administration should not be allowed to forgive up to $20,000 in debt for qualifying individuals.<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>Their lawsuits have stalled the program, and the justices now are poised to deliver the final verdict on whether Biden can move ahead with fulfilling one of his campaign promises.<\/p>\n<p>The administration asserts that neither group has standing, meaning the legal capacity to sue, so the justices shouldn\u2019t even consider the merits of their challenges.<\/p>\n<p>If the justices do reach the merits, they will weigh whether Education Secretary Miguel Cardona could forgive the debts using an authority connected to the national emergency established during the pandemic.<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>\u201cIt\u2019s going to help tens of millions of folks,\u201d Biden said last month. \u201cFolks on Pell Grants were hit financially because of the pandemic. Seventy percent of Black college students receive Pell Grants. For many Black students, the saving will be significant in my debt relief plan, including wiping out their student debt completely. That\u2019s a real <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/game\/\" data-internallinksmanager029f6b8e52c=\"7\" title=\"Game\" target=\"_blank\" rel=\"noopener\">game<\/a>-changer.\u201d\u00a0\u00a0<\/p>\n<p>Both groups of challengers contend Cardona overstepped his authority, arguing the plan would need clearer authorization from Congress.\u00a0<\/p>\n<p>\u201cThis case calls on the Court once again to stop the administration from unlawfully invoking COVID-19 to assert power beyond anything Congress could have conceived,\u201d the six Republican attorneys <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/22\/22-506\/253353\/20230127155912043_2023.01.27%20-%20Respondents%20Brief%20FINAL.pdf\">argued in their\u00a0b<\/a>rief.<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>The individual challengers also argue Cardona did not follow proper procedures and that they were denied their rightful opportunity to provide written comments on the plan.<\/p>\n<p><strong>Other cases<\/strong><\/p>\n<p>The student debt arguments are sandwiched by two lower-profile cases that week.<\/p>\n<p>On Monday, the justices will consider in Dubin v. United States the standard for committing aggravated identity theft, a federal crime that involves using another person\u2019s identity in connection with committing certain felonies.<\/p>\n<p>The case involves David Dubin, a psychological center executive who was convicted of health care fraud for submitting a false Medicaid claim.\u00a0<\/p>\n<p>Since he used his patient\u2019s name on the falsified document, lower courts also convicted Dubin of aggravated identity theft and sentenced him to two additional years in prison. Dubin argues he should be cleared of that charge, because the statute requires a nexus to the underlying crime and writing his patient\u2019s name was merely \u201cincidental.\u201d<\/p>\n<p>The justices will cap off the argument session on Wednesday with a case that was brought directly to the Supreme Court, because it is a dispute between two states: New York and New Jersey.<\/p>\n<p>New Jersey is attempting to withdraw from the Waterfront Commission Compact, which it signed in 1953 to address organized crime at the Port of New York and New Jersey.<\/p>\n<p>The case had been scheduled for a different day, but it was moved after the justices canceled an oral argument about Title 42, which limits migrants\u2019 ability to seek asylum in connection with the COVID-19 pandemic.<\/p>\n<p>A group of GOP-led states is seeking to intervene in the case to defend the policy, but the justices on Thursday\u00a0removed it from their calendar\u00a0without explanation.\u00a0<\/p>\n<p>That decision came days after the Biden administration suggested\u00a0the case may be moot\u00a0once the COVID-19 public health emergency expires in May.<\/p>\n<\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
