Lench is scheduled to sentence the 70-year-old Weinstein in a downtown Los Angeles courtroom on Thursday. She could give him up to 18 years in prison. Weinstein&#8217;s lawyers say Lench&#8217;s rejection of evidence they wanted to use at trial proved prejudicial to him.<\/p>\n<p>The defense attorneys argue that they ought to have been allowed to introduce private <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Facebook<\/a> messages that showed there was a sexual relationship between the Italian woman and Pascal Vicedomini, director of the Los Angeles Italia Film Festival, which she was attending when she said the attack occurred.<\/p>\n<p>The motion says the messages would have shown that both were lying under oath <a rel=\"nofollow noopener\" target=\"_blank\" data-i13n=\"cpos:7;pos:1\" href=\"https:\/\/apnews.com\/article\/harvey-weinstein-los-angeles-forensics-273239b08ffde41507b52e2a8075fb8f\" data-ylk=\"slk:when they testified that they were merely friends;cpos:7;pos:1\" class=\"link rapid-noclick-resp\">when they testified that they were merely friends<\/a> and colleagues. The court filing also says that such a relationship would have made it unlikely that Vicedomini would give Weinstein the number of her hotel room, where according to her testimony Weinstein <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>eared uninvited. And it says the messages would have bolstered the lawyers&#8217; contention the woman was spending the night with Vicedomini at another hotel on that night.<\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" data-i13n=\"cpos:8;pos:1\" href=\"https:\/\/apnews.com\/article\/harvey-weinstein-los-angeles-sexual-assault-559dc6580f44556ef1a3fca04607b0da\" data-ylk=\"slk:The defense argued in their closing;cpos:8;pos:1\" class=\"link rapid-noclick-resp\">The defense argued in their closing<\/a> that the two had a sexual relationship, but Lench allowed jurors to see only the messages between them that established her timing and location.<\/p>\n<p>The law gives Lench \u201cthe singular responsibility of setting right those prejudicial errors which often become apparent only with the benefit of hindsight,&#8221; the lawyers wrote in the motion.<\/p>\n<p>Lench has said she will move forward with the sentencing immediately if she rejects the defense motion.<\/p>\n<p>But legal uncertainties will remain on both coasts for Weinstein.<\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" data-i13n=\"cpos:9;pos:1\" href=\"https:\/\/apnews.com\/article\/new-york-harvey-weinstein-eae103d055013888317f92c6c0dfad6c\" data-ylk=\"slk:New York's highest court has agreed to hear his appeal;cpos:9;pos:1\" class=\"link rapid-noclick-resp\">New York&#8217;s highest court has agreed to hear his appeal<\/a> in his rape and sexual assault convictions there.
