According to court docs obtained by <em>US Weekly<\/em> last week, she\u2019s trying to nullify the non-disclosure agreement she signed when she first started dating Tiger in 2017. The docs read:<\/p>\n<blockquote><p>\u201cBecause of the aggressive use of the Woods NDA against her by the Defendant and the trust under his control, the Plaintiff is unsure whether she may disclose, among other things, facts giving rise to various legal claims she believes she has. She is also currently unsure what other information about her own life she may discuss or with whom. There is therefore an active dispute between the Plaintiff and the Defendant for which the Plaintiff needs a clarifying declaration from the court.\u201d<\/p>\n<\/blockquote>\n<div class=\"clear\"><\/div>\n<p>Not only was there the ominous comment about the \u201caggressive use\u201d of the NDA, she went on in the filings to cite the Speak Out Act \u2014 which \u201cprohibits the judicial enforceability of a nondisclosure clause or nondisparagement clause agreed to before a dispute arises involving sexual assault or sexual harassment in violation of federal, tribal, or state law.\u201d Yeah. Sexual assault or sexual harassment!<\/p>\n<div style=\"min-height:120px;width:100%;float:none;\">\n<div id=\"section-6410bac8aa770-paragraph-slot\" class=\"lazyload-unit\"><\/div>\n<\/div>\n<p>It turns out Erica is not accusing him of sexual assault but is nevertheless using the act as part of her argument, as she doesn\u2019t believe she should be silenced either. It\u2019s unclear just what she will accuse him of if released from the NDA. What we have heard already is that he allegedly tricked her into going on a vacation and then had his people dump her for him at the airport \u2014 and change the locks on the home where they lived together! In new court documents obtained by <em>People<\/em> on Monday, the 47-year-old\u2019s lawyers blasts Erica\u2019s argument:<\/p>\n<div style=\"min-height:120px;width:100%;float:none;\">\n<div id=\"section-6410bac8aa777-paragraph-slot\" class=\"lazyload-unit\"><\/div>\n<\/div>\n<blockquote>\n<p>\u201cMs. Herman\u2019s position is utterly meritless. It is a transparent abuse of the judicial process that undermines the purpose of the federal statute and those whom the statute seeks to protect.\u201d<\/p>\n<\/blockquote>\n<p>The golfer\u2019s Trust points out there isn\u2019t \u201ca single reference to an allegation of sexual harassment or sexual assault\u201d in Erica\u2019s filings, and that she\u2019s just a \u201cjilted\u201d ex:<\/p>\n<blockquote>\n<div class=\"clear\"><\/div>\n<p>\u201cMs. Herman is not a victim of sexual assault or abuse. Rather, Ms. Herman is a jilted ex-girlfriend who wants to publicly litigate specious claims in court.\u201d<\/p>\n<div style=\"min-height:120px;width:100%;float:none;\">\n<div id=\"section-6410bac8aa77d-paragraph-slot\" class=\"lazyload-unit\"><\/div>\n<\/div>\n<\/blockquote>\n<p>Whoa! Tiger\u2019s legal team didn\u2019t hold back\u2026<\/p>\n<p>The filing went on to explain the 38-year-old signed the NDA in 2017 \u201cas consideration for\u201d the opportunity \u201cto continue to spend time with Mr. Woods.\u201d Tiger\u2019s attorney claimed \u201cfor more than six years, Ms. Herman enjoyed the benefits of her agreement\u201d and that she\u2019s just \u201cmaking salacious and insidious implications\u201d of claims relating to sexual assault disputes.<\/p>\n<div class=\"clear\"><\/div>\n<p>A source close to the father of two agreed Erica is just bitter about the breakup, claiming their relationship \u201cwas stale\u201d for a while before the inevitable end. According to the insider, she helped her then-boyfriend a lot through his recovery after his 2021 car accident, but things quickly went downhill. Tiger was experiencing \u201cfrustration over the injuries, some of which are not going to get much better\u201d and pushed the relationship toward the exit while Erica was looking for something long-term:<\/p>\n<div style=\"min-height:120px;width:100%;float:none;\">\n<div id=\"section-6410bac8aa783-paragraph-slot\" class=\"lazyload-unit\"><\/div>\n<\/div>\n<blockquote>\n<p>\u201c[She] was more serious about a long-term commitment. [She] was there for him throughout the whole thing so she thinks that kind of loyalty is worth something.\u201d<\/p>\n<\/blockquote>\n<p><a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>arently the pro golfer was also getting \u201crestless\u201d in the relationship even before the accident:<\/p>\n<blockquote>\n<div class=\"clear\"><\/div>\n<p>\u201c[The relationship] deteriorated further after he recovered from the accident.\u201d<\/p>\n<div style=\"min-height:120px;width:100%;float:none;\">\n<div id=\"section-6410bac8aa78a-paragraph-slot\" class=\"lazyload-unit\"><\/div>\n<\/div>\n<\/blockquote>\n<p>Yeesh. Sounds like this whole thing is messy! But\u2026 legally? If she\u2019s not making a claim of sexual misconduct it does seem like a rather sensationalistic use of the law.
