<\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>       So, what\u2019s the story with former President Donald Trump possibly getting arrested this week over hush money payments to two women \u2014 including a porn star \u2014 who claim that he had sexual encounters with them several years ago?\u00a0\u00a0<\/p>\n<p> It\u2019s been more than six years since Trump\u2019s lawyer, Michael Cohen, paid off two women who alleged that they had extramarital dalliances with the former reality star-turned-president. These payments came during Trump\u2019s 2016 presidential campaign, and Cohen served prison time after pleading guilty in 2018 to federal charges, including campaign finance violations, for arranging the payments. Trump has denied any wrongdoing, including having the extramarital affairs.\u00a0<\/p>\n<div class=\"paywall\">\n       Well, then \u2026 case closed, right?\u00a0<\/p>\n<p><a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>arently not. Trump has claimed that his arrest is imminent as a New York grand jury investigates these hush money payments. But it\u2019s been a minute since 2016, and you could be forgiven for being rusty on the details, or wondering why this is coming back to bite Trump now.\u00a0<\/p>\n<p>So here\u2019s a quick recap explaining why Trump could be indicted as early as this week, and what charges he could be facing.\u00a0<\/p>\n<h6><span class=\"ez-toc-section\" id=\"Who_is_Stormy_Daniels_and_who_paid_her_in_2016\"><\/span><strong>Who is Stormy Daniels, and who paid her in 2016?\u00a0<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>Stephanie Clifford, aka Stormy Daniels, is an adult film star who has alleged she had a sexual encounter with Trump during his \u201cThe Apprentice\u201d days. Trump\u2019s lawyer, Cohen, paid her $130,000 through a shell company to keep the alleged encounter quiet. And Cohen was reimbursed by Trump, whose Trump Organization put the payment down as a legal expense.\u00a0<\/p>\n<p>And this wasn\u2019t the only such payout. Earlier in 2016, Playboy model Karen McDougal also claimed she had an affair with Trump. But <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/apnews.com\/article\/north-america-donald-trump-us-news-elections-american-media-inc-1beb4bf23d0043eab87396ec56054814\" class=\"icon none\">Cohen arranged for McDougal to be paid $150,000 by the National Enquirer\u2019s publisher<\/a> for the rights to her story \u2014 which the tabloid then suppressed until after Trump won the 2016 election.\u00a0\u00a0<\/p>\n<p>And Cohen pocketed $360,000 plus a $60,000 bonus, for a total of $420,000.<\/p>\n<h6><span class=\"ez-toc-section\" id=\"So_whats_legally_problematic_about_these_hush_money_payments\"><\/span><strong>So, what\u2019s legally problematic about these hush money payments?\u00a0<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>In Cohen\u2019s case, the Trump Organization \u201cgrossed up\u201d Cohen\u2019s reimbursement for the Daniels payment for \u201ctax purposes\u201d \u2014 according to federal prosecutors who filed criminal charges against Cohen in connection with the payments in 2018. (This means they increased the payment to Cohen to cover the taxes he would owe on it, since the payment would be characterized as income to Cohen.)\u00a0<\/p>\n<p>Cohen pleaded guilty to violating federal campaign finance law in connection with the payments. Federal prosecutors said the payments amounted to illegal, unreported assistance to Trump\u2019s campaign \u2014 but they didn\u2019t file charges against Trump.<\/p>\n<div id=\"cx-membership-tile\"><\/div>\n<p>But now, Manhattan District Attorney Alvin Bragg\u2019s team appears to be looking at whether Trump or anyone committed crimes in arranging the payments, or in the way that they accounted for the payments internally at the Trump Organization. Legal experts have said that prosecutors could make the case that Trump falsified business records by putting Cohen\u2019s hush money payment to Daniels down as legal fees. This would be a misdemeanor \u2014 unless prosecutors could prove that it was done to conceal another crime.<\/p>\n<p><strong>Read more: <\/strong>Manhattan D.A. says rhetoric won\u2019t intimidate his office, as Trump charges loom<\/p>\n<p>Cohen said that Trump told him to arrange the Daniels payment. And he also recorded a conversation between him and Trump where they spoke about arranging to pay McDougal through the National Enquirer.\u00a0<\/p>\n<p>Trump has denied any wrongdoing. And his campaign sent out a statement on Tuesday morning stating, \u201cBarricades are being set up around Manhattan Criminal Court \u2014 as our nation awaits an announcement on whether President Donald J. Trump will be INDICTED despite having committed NO CRIME.\u201d\u00a0<\/p>\n<p><strong>Related:<\/strong> DeSantis on possible Trump arrest: \u2018I don\u2019t know what goes into paying hush money to a porn star\u2019<\/p>\n<p>No former U.S. president has ever been charged with a crime.<\/p>\n<h6><span class=\"ez-toc-section\" id=\"Is_Trump_getting_arrested\"><\/span><strong>Is Trump getting arrested?\u00a0<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>This remains unclear. Trump claimed on Truth <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Social<\/a> on Saturday that he \u201cwill be arrested on Tuesday of next week\u201d \u2014 meaning March 21, which passed without the former president being indicted \u2014 citing \u201cillegal leaks\u201d from the Manhattan District Attorney\u2019s office. But it should be noted that there has been no public announcement of any time frame for the grand jury\u2019s work in the case.\u00a0<\/p>\n<p>Also, if Trump is indicted, he would only be arrested if he refused to surrender.
