The preventive services mandate is extremely popular and ending it could impact more than100 million Americans.\u00a0\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>Here are five things to know about the ruling.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"The_immediate_impacts_are_unclear\"><\/span><strong>The immediate impacts are unclear\u00a0<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The ruling is effective im<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a>tely, but it\u2019s not likely to have an immediate impact.<\/p>\n<p>\u201cI think this will play out over time. I don\u2019t think it will result in precipitous changes in coverage in most cases,\u201d said Larry Levitt, vice president of health policy at the Kaiser Family Foundation.<\/p>\n<p>Health insurers price their plans on a yearly basis and are required to notify beneficiaries when there\u2019s a coverage change. If the ruling is upheld, plans likely won\u2019t change until next calendar year.<\/p>\n<p>The insurance industry\u2019s main lobbying group also sought to reassure people.\u00a0<\/p>\n<p>\u201cWe want to be clear: Americans should have peace of mind there will be no immediate disruption in care or coverage,\u201d said Matt Eyles, president and CEO of AHIP.<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>Of course, experts noted there isn\u2019t a law that prohibits insurance companies from changing their policies mid-year, it\u2019s just a logistically complex decision\u2014 especially for a policy that may get overturned or changed on <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>eal.\u00a0<\/p>\n<p>O\u2019Connor also invalidated ObamaCare\u2019s mandate for free coverage of HIV prevention drugs for adults who are at high risk of infection, so some plans may immediately drop that coverage.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"More_preventive_services_could_be_at_risk_during_the_appeal\"><\/span><strong>More preventive services could be at risk during the appeal<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The Justice Department on Friday officially filed its appeal of the decision, but the plaintiffs are appealing as well.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>O\u2019Connor ruled against the preventive services mandate, but rejected arguments that would have eliminated the law\u2019s contraceptive coverage mandate, as well as requirements that insurers cover other services like vaccines.\u00a0<\/p>\n<p>Those could be overturned on appeal.\u00a0<\/p>\n<p>\u201cNobody\u2019s happy with this decision,\u201d said Laurie Sobel, associate director for women\u2019s health policy at the Kaiser Family Foundation. \u201cThe administration will be appealing, the plaintiffs are appealing \u2026 so all of the preventative services are kind of up for grabs as we go through the appeal process.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>The case now advances to the Fifth Circuit Court of Appeals, which is known as one of the most conservative in the country.\u00a0<\/p>\n<h2><span class=\"ez-toc-section\" id=\"It_impacts_many_preventive_services_but_not_all\"><\/span><strong>It impacts many preventive services, but not all<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Part of what makes the impact so uncertain is that\u00a0O\u2019Connor\u2019s decision applies only to preventive care recommendations adopted after 2010, when the Affordable Care Act was\u00a0<\/p>\n<p>passed. Those include anxiety screening for kids, statins for cardiovascular disease and high-risk breast cancer screenings.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>Many important recommendations, including mammograms to screen women over the age of 50 for breast cancer,\u00a0as well as certain cervical cancer screenings, were adopted before 2010. But over the years those recommendations have been updated, so insurers will be operating in an outdated landscape.\u00a0<\/p>\n<p>O\u2019Connor upheld the authority of two other parts of the Department of Health and Human Services; one that sets standards for how to use vaccines, and another that recommends reproductive health services.\u00a0\u00a0<\/p>\n<p>Under ObamaCare, health insurers can\u2019t require patients to pay anything out of pocket for preventive care services that have an A or a B rating from the U.S. Preventive Services Task Force, a federal advisory committee. O\u2019Connor said the task force is unconstitutional, as is the requirement to cover any recommendation made since the ACA became law.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<h2><span class=\"ez-toc-section\" id=\"Theres_not_a_lot_that_states_can_do_to_protect_employees\"><\/span><strong>There\u2019s not a lot that states can do to protect employees\u00a0<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>\u201cThere are real limits to what states can do here,\u201d said KFF\u2019s Levitt.\u00a0\u201cSo states I think can and will move to fill in some of the gaps that this ruling leaves, but there are still big gaps remaining.\u201d<\/p>\n<p>States can regulate private insurance, but self-insured employer plans, which cover most people with private insurance, can\u2019t be touched by state regulations, he said.\u00a0<\/p>\n<p>There are currently 15 states with laws on the books requiring individual market insurers to cover, without cost sharing, the same categories of preventive services required by the ACA.<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<h2><span class=\"ez-toc-section\" id=\"It_gives_Democrats_new_political_ammo\"><\/span><strong>It gives Democrats new political ammo<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Democratic leaders in Congress swiftly condemned the ruling, though it puts them in a familiar position of defending ObamaCare from GOP attacks.<\/p>\n<p>\u201cYet again, a Republican activist judge has issued a ruling based on MAGA ideology and not the law, that would decimate our healthcare system and is opposed by a vast majority of Americans,\u201d Senate Majority Leader Chuck Schumer (D-N.Y.) said in a statement.<\/p>\n<p>Levitt said Congress could easily fix the problem with a simple one-line bill. But the politics of the ACA, even 13 years after it passed, make it unlikely anything would pass.<\/p>\n<p>\u201cIt would not require a lot of words to fix this in legislation, but it potentially requires very difficult politics,\u201d Levitt said.<\/p>\n<p>Protecting ObamaCare was a key part of Democrats\u2019 messaging that helped them win control of the House in 2018, and Thursday\u2019s decision puts the law front and center again for 2024.<\/p>\n<p>\u201cThis case is yet another attack on the Affordable Care Act \u2013 which has been the law of the land for 13 years and survived three challenges before the Supreme Court,\u201d White House Press Secretary Karine Jean-Pierre said in a statement Friday after DOJ filed its appeal.<\/p>\n<p>\u201cPreventive care saves lives, saves families money, and protects and improves our health. Because of the ACA, millions of Americans have access to free cancer and heart disease screenings.
