{"id":569281,"date":"2023-04-08T01:15:18","date_gmt":"2023-04-07T22:15:18","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/bidens-title-ix-proposal-draws-criticism-in-lgbtq-community\/"},"modified":"2023-04-08T01:15:18","modified_gmt":"2023-04-07T22:15:18","slug":"bidens-title-ix-proposal-draws-criticism-in-lgbtq-community","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/bidens-title-ix-proposal-draws-criticism-in-lgbtq-community\/","title":{"rendered":"#Biden&#8217;s Title IX proposal draws criticism in LGBTQ community"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/04\/LGBTQ_Kansas_AP.jpg?w=900\" \/><\/p>\n<div>\n<p>Some LGBTQ advocates this week slammed the Biden administration\u2019s proposed revision to Title IX, accusing the president of backtracking on his commitment to protecting transgender young people.<\/p>\n<p>The proposal,\u00a0released Thursday by the Education Department, would prohibit the adoption of policies that \u201ccategorically\u201d ban transgender athletes from school sports teams consistent with their gender identity, rebuking broad bans that have been\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.lgbtmap.org\/equality-maps\/sports_participation_bans\">implemented by 20 states<\/a>, and counting.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>But K-12 schools under the administration\u2019s proposal would still have the leeway to limit transgender athletes\u2019 participation in sports if they determine that including them will undermine competitive fairness or increase the risk of sports-related injuries, a senior Education Department official said Thursday.<\/p>\n<p>\u201cThe proposed regulation would give schools flexibility to identify their own important educational objectives,\u201d\u00a0rather than adopt a one-size-fits-all <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>roach,\u00a0the official said on a call with reporters.<\/p>\n<p>LGBTQ Americans and their allies have had mixed reactions to the administration\u2019s proposed changes. While some are celebrating the possibility of a new federal civil rights law prohibiting laws that bar transgender students from participating in school sports, others say the proposal is a disappointing departure from prior actions and statements made by the Biden White House in support of equal rights for transgender people.<\/p>\n<p>\u201cState lawmakers take note \u2014 discriminating against transgender athletes is wrong and a violation of federal law. This new rule makes that abundantly clear,\u201d said Kelley Robinson, President of the Human Rights Campaign, the nation\u2019s largest LGBTQ advocacy group.<\/p>\n<p>Robinson added, however, that the new rule should be updated to clarify that \u201call transgender students should be presumed eligible to participate in sports consistent with their gender identity.\u201d<\/p>\n<p>\u201cThe Biden Administration framed their proposal as a ban on blanket discrimination against trans athletes. But actually it provides guidelines for how schools and universities can ban trans athletes legally,\u201d Imara Jones, the founder and chief executive of TransLash <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Media<\/a>, said Friday.<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>\u201cIt\u2019s hard to have a \u2018middle ground\u2019 when it comes [to] supporting human rights for trans people, and I can\u2019t see how Joe Biden can straddle the fence here,\u201d she said.<\/p>\n<p>The White House declined to comment.<\/p>\n<p>Biden, during his time in office, has on multiple occasions promised to defend the rights of transgender Americans and has\u00a0condemned state bills\u00a0that seek to restrict how transgender young people may access health care, use the restroom and play sports.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>On his first day in office in 2021, Biden signed an\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/01\/20\/executive-order-preventing-and-combating-discrimination-on-basis-of-gender-identity-or-sexual-orientation\/\">executive order<\/a>\u00a0to combat discrimination based on sexual orientation and gender identity, writing, \u201cChildren should be able to learn without worrying about whether they will be denied access to the restroom, the locker room, or school sports.\u201d<\/p>\n<p>In a\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/Esqueer_\/status\/1644078990997504009?s=20\">Twitter post on Thursday<\/a>, Alejandra Caraballo, a transgender activist and instructor at Harvard Law School\u2019s Cyberlaw Clinic, called the proposed changes to Title IX a \u201cbackwards betrayal\u201d that distracts from more important issues, like\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.lgbtmap.org\/equality-maps\/healthcare\/youth_medical_care_bans\">statewide bans on gender-affirming health care<\/a>.<\/p>\n<p>\u201cHe could have just done nothing,\u201d Caraballo wrote. \u201cThis is legitimizing transphobia.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>Caraballo added that the rules outlined in the administration\u2019s proposal are \u201cmushy\u201d and are likely to have little impact over whether schools choose to categorically exclude transgender students from competitive athletics.<\/p>\n<p>On Thursday, the senior Education Department official said the department is \u201cready and eager\u201d to work with schools to develop policies that both satisfy Title IX and minimize harms for transgender students.<\/p>\n<p>This is not the first time Biden and his administration have been accused of backtracking on LGBTQ rights or not doing enough for the community, and advocacy groups following this year\u2019s State of the Union address said the president\u00a0missed a rare opportunity\u00a0to denounce anti-LGBTQ hate and violence in front of Congress and the nation.<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>Biden, during the roughly 73-minute\u00a0speech, referenced LGBTQ rights only twice, despite hundreds of bills targeting LGBTQ people under consideration in state legislatures nationwide and anti-LGBTQ violence so prevelant it was the subject of a\u00a0House Oversight hearing\u00a0last year.<\/p>\n<p>\u201cYou say trans youth are brave and claim to have their backs, and your administration has not done enough to sufficiently protect them,\u201d actress Angelica Ross said last year during an\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/LogoTV\/status\/1498704768633643012?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1498704768633643012%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fiframe.nbcnews.com%2Fdv0oWjD%3F_showcaption%3Dtrueapp%3D1\">LGBTQ State of the Union<\/a>. \u201cTalk is cheap. We need you to act.\u201d<\/p>\n<p>In a statement on Friday, Sean Ebony Coleman, the founder and executive director of Destination Tomorrow, a New York City-based LGBTQ center and advocacy group, said the administration\u2019s proposed rule is \u201cwholly underdeveloped.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>\u201cWhile it hypothetically prevents across-the-board bans, it offers enough gray area for discrete gender policing and demonization to occur, specifically on a local level,\u201d Coleman said Friday. \u201cWe need policymakers, especially on a national level, to completely rule out any option for this community to be further ostracized.\u201d<\/p>\n<p>In a\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/AOC\/status\/1644123142015660032?s=20\">post on Twitter<\/a>\u00a0late Thursday, Rep. Alexandria Ocasio-Cortez (D-N.Y.) called the proposal \u201cembarrassing\u201d and urged the Education Department to reverse course.<\/p>\n<p>\u201cAbsolutely no reason for the Biden admin to do this. It is indefensible and embarrassing,\u201d Ocasio-Cortez wrote. \u201cThe admin can still walk this back, and they should.
