{"id":569301,"date":"2023-04-08T01:40:24","date_gmt":"2023-04-07T22:40:24","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/federal-judge-blocks-abortion-pill-approval\/"},"modified":"2023-04-08T01:40:24","modified_gmt":"2023-04-07T22:40:24","slug":"federal-judge-blocks-abortion-pill-approval","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/federal-judge-blocks-abortion-pill-approval\/","title":{"rendered":"#Federal judge blocks abortion pill approval"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/02\/d0be92510ee3481ab7668316baa2bf6d-e1676069883457.jpg?w=900\" \/><\/p>\n<div>\n<p>In an unprecedented decision, a federal judge in Texas has issued a stay that will shut down the prescribing and distribution of mifepristone in seven days, one of two drugs used for medication abortions that has been on the market in the U.S. for more than two decades.<\/p>\n<p>District Court Judge Matthew Kacsmaryk, an <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ointee of former President Trump, gave the government a weeklong window to appeal and seek emergency relief before his ruling goes into effect.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>The FDA appealed the decision to the conservative 5th Circuit Court of Appeals later on Friday.<\/p>\n<p>Separately on Friday, U.S. District Judge Thomas Rice, an appointee of former President Obama who sits in the Eastern District of Washington, blocked the FDA from \u201caltering the status quo and rights as it relates to the availability of Mifepristone\u201d in 17 states and Washington, D.C. that filed a lawsuit saying the drug was too tightly regulated.<\/p>\n<p>The\u00a0dueling\u00a0rulings\u00a0could have far-reaching implications for access to abortion nationwide, as well as the authority of the entire Food and Drug Administration.\u00a0The dispute could eventually reach the Supreme Court.<\/p>\n<p>Kacsmaryk sided with the antiabortion group that brought the lawsuit and said the agency\u2019s approval process was improperly rushed, and resulted in an unsafe drug regimen getting on the market.<\/p>\n<p>Kacsmaryk said that FDA\u00a0violated federal standards when it first approved mifepristone 23 years ago.<\/p>\n<p>\u201cThe Court does not second-guess FDA\u2019s decision-making lightly. But here, FDA acquiesced on its legitimate safety concerns \u2014 in violation of its statutory duty \u2014 based on plainly unsound reasoning and studies that did not support its conclusions.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>He also hinted the agency bowed to political pressure, and deliberately \u201cstonewalled\u201d any challenges to the drug\u2019s approval.<\/p>\n<p>\u201cWhy did it take two decades for judicial review in federal court? After all, Plaintiffs\u2019 petitions challenging the 2000 Approval date back to the year 2002, right? Simply put, FDA stonewalled judicial review \u2014 until now,\u201d he wrote. <\/p>\n<p>The drug was first approved in 2000, a process that took more than four years. It is indicated for use in abortions up to 10 weeks into a pregnancy. Mifepristone is also used by OB-GYNs to manage early miscarriages.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>But the stay means FDA\u2019s longstanding approval has been blocked, a move that the Justice Department argued was \u201cextraordinary and unprecedented.\u201d In court filings ahead of the March 15 hearing, the government said the lawsuit was based on false claims of severe complications from the drug.  <\/p>\n<p>The lawsuit was initially filed in November by the Alliance Defending Freedom (ADF), a powerhouse conservative legal group that has helped author states\u2019 anti-abortion laws and defended Mississippi in the case that led the Supreme Court to overturn the abortion protections granted in Roe v. Wade.\u00a0<\/p>\n<p>The lawsuit claims the drug is unsafe and alleges that the FDA failed to study it carefully enough. Legal experts said the argument was purely political and had no merit, but the lawsuit was strategically filed in the Northern District of Texas so that Kacsmaryk was guaranteed to hear it.<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>Medication abortion is the most common method for terminating a pregnancy, and ever since the Supreme Court\u2019s decision overturning Roe v. Wade in June, pregnant Americans have increasingly turned to abortion pills.\u00a0<\/p>\n<p><em>This story was updated at 7:05 p.m.<\/em><\/p>\n<p>Many of the country\u2019s leading medical organizations, including the American Medical Association and the American College of Obstetricians and Gynecologists, said medication abortion is safe and effective.\u00a0  <\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>Despite arguments from anti-abortion advocates, the medical groups said years of clinical evidence has shown there is a greater risk of complications or mortality for procedures like wisdom tooth removal, cancer-screening, colonoscopy, or the use of Viagra.<\/p>\n<p>Medication abortion in the U.S. is a two-step process. The first step involves taking mifepristone, which is followed up 24 hours later by a dose of misoprostol, a drug first approved in the 1970s for stomach ulcers.
