{"id":570240,"date":"2023-04-14T23:04:26","date_gmt":"2023-04-14T20:04:26","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/supreme-court-grants-temporary-pause-on-abortion-pill-ruling\/"},"modified":"2023-04-14T23:04:26","modified_gmt":"2023-04-14T20:04:26","slug":"supreme-court-grants-temporary-pause-on-abortion-pill-ruling","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/supreme-court-grants-temporary-pause-on-abortion-pill-ruling\/","title":{"rendered":"#Supreme Court grants temporary pause on abortion pill ruling"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/12\/scotus_111522ap-patrick-semansky_student-debt.jpg?w=900\" \/><\/p>\n<div>\n<p>The Supreme Court briefly paused a ruling from a federal court that would severely restrict access to the abortion pill mifepristone.<\/p>\n<p>The short order from Justice Samuel Alito on the court\u2019s emergency \u201cshadow docket\u201d will keep the status quo in place until at least midnight Wednesday while the administration\u2019s emergency request for a stay is considered by the full court.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>After the 5th U.S. Circuit Court of <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>eals late Wednesday night essentially rolled the clock back to 2016 in imposing new limits on access to medication abortion, the Justice Department and the manufacturer of the brand name version of the pill separately asked the Court to temporarily allow full access to the drug, or to quickly schedule briefing and oral arguments to review the case before the court\u2019s term ends this summer.<\/p>\n<p>The appeals court on Wednesday ruled 2-1 that mifepristone may <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca5.213145\/gov.uscourts.ca5.213145.183.2_1.pdf\" data-type=\"URL\" data-id=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca5.213145\/gov.uscourts.ca5.213145.183.2_1.pdf\">remain on the market<\/a> as the federal government\u2019s appeal of a decision from Judge Matthew Kacsmaryk of the Northern District of Texas moves forward.\u00a0<\/p>\n<p>The appellate court scheduled oral arguments on the appeal for May 17.<\/p>\n<p>Last week, Kacsmaryk suspended the Food and Drug Administration\u2019s (FDA) 23 year-old approval of mifepristone. The appeals court put that part of his ruling on hold, but left in place another part of the ruling that blocked steps FDA has taken since 2016 to ease access to mifepristone.\u00a0<\/p>\n<p>Those changes include increasing the gestational age of when mifepristone can be used to up to 10 weeks of pregnancy, allowing the medication to be mailed to patients, allowing providers other than physicians to prescribe the drug and approving a generic version.<\/p>\n<p>Without the Supreme Court\u2019s intervention, those changes would have taken effect at 1 a.m. Saturday. <\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>At the same time, a judge in Washington state in a separate lawsuit ordered the FDA to leave in place the current mifepristone prescribing and dispensing rules for 17 blue states and D.C. <\/p>\n<p>Judge Thomas Rice said the FDA was prohibited from \u201caltering the status quo\u201d in those states, \u201cirrespective\u201d of what the Fifth Circuit appeals court said.<\/p>\n<p>Legal experts said the direct conflict between the rulings made it more likely that the Supreme Court would intervene.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>\u201cWe are pleased that the court took the only sensible action here, which was to hit pause on a profoundly dangerous decision that has been widely criticized as unprecedented and wholly unprincipled by experts across the ideological spectrum,\u201d the American Civil Liberties Union said in a Friday statement.<\/p>\n<p>\u201cToday\u2019s ruling is just the first step: Now the courts must put an end to this baseless case \u2014 which is part of anti-abortion extremists\u2019 plan to ban abortion nationwide. It threatens access not only to abortion and miscarriage care, but also to a wide swath of critical and life-saving medications.
