{"id":571458,"date":"2023-04-23T13:00:00","date_gmt":"2023-04-23T10:00:00","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/fox-news-faces-new-legal-threat-from-smartmatic\/"},"modified":"2023-04-23T13:00:00","modified_gmt":"2023-04-23T10:00:00","slug":"fox-news-faces-new-legal-threat-from-smartmatic","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/fox-news-faces-new-legal-threat-from-smartmatic\/","title":{"rendered":"#Fox News faces new legal threat from Smartmatic\u00a0"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/04\/dominion-trump_VM-GN-Getty.jpg?w=900\" \/><\/p>\n<div>\n<p>Fox <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">News<\/a> has settled a blockbuster case brought by Dominion Voting Systems, but the network\u2019s legal headaches are not over yet.\u00a0<\/p>\n<p>A separate\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/iapps.courts.state.ny.us\/fbem\/DocumentDisplayServlet?documentId=x16kEpoDU9eTb7qmlaLIYA==&amp;system=prod\">lawsuit<\/a>\u00a0from voting systems company Smartmatic similarly accuses Fox of maliciously giving Trump lawyers Sidney Powell and Rudy Giuliani a platform to air false claims about the 2020 presidential election.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>But unlike Dominion, Smartmatic is suing multiple hosts and Giuliani as individuals, in addition to Fox. The company is seeking at least $2.7 billion in damages, more than three times the size of Fox\u2019s recent\u00a0$787.5 million settlement\u00a0with Dominion last week. And the case will be tried in New York state court, rather than Delaware.<\/p>\n<p>\u201cDominion\u2019s litigation exposed some of the misconduct and damage caused by Fox\u2019s disinformation campaign,\u201d\u00a0 Erik Connolly, an attorney for Smartmatic, said in a statement shortly after the agreement with Dominion was announced.\u00a0<\/p>\n<p>\u201cSmartmatic will expose the rest. Smartmatic remains committed to clearing its name, recouping the significant damage done to the company, and holding Fox accountable for undermining democracy.\u201d\u00a0<\/p>\n<p>A trial in the Smartmatic case would still be months away, if not years. No date has been set, but Fox lost its first bid to toss Smartmatic\u2019s suit, allowing the case to move onto discovery.\u00a0<\/p>\n<p>\u201cWe will be ready to defend this case surrounding extremely newsworthy events when it goes to trial, likely in 2025,\u201d a spokesperson for the network said this week. \u201cAs a report prepared by our financial expert shows, Smartmatic\u2019s damages claims are implausible, disconnected from reality, and on its face intended to chill First Amendment freedoms.\u201d<\/p>\n<p>Still, some observers see the Smartmatic case ending in a similar fashion to how Dominion\u2019s lawsuit did last week.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>\u201cI don\u2019t see really any legal or factual way for Fox to have a different result in the Smartmatic litigation than it had in Dominion,\u201d said Rodney Smolla, president of Vermont Law and Graduate School, who served as a lawyer for Dominion in its defamation case.<\/p>\n<p>\u201cI know it issued the press release yesterday, saying it looked forward to defending itself, but my instinct is that\u2019s just settlement posturing,\u201d he added. \u201cIt doesn\u2019t reflect a realistic view of the law or facts.\u201d<\/p>\n<p>Fox defended itself in Dominion\u2019s suit in part by asserting that it was protected under a First Amendment \u201cneutral report\u201d privilege, arguing the allegations made by Trump and his associates, like attorneys Rudy Giuliani and Sidney Powell, were newsworthy and Fox had a journalistic duty to present them.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>But Smartmatic\u2019s case is in New York, where that neutral reporting privilege has previously\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/casetext.com\/case\/weiner-v-doubleday-co-1#p594\">been<\/a>\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/casetext.com\/case\/hogan-v-herald-company-1\">rejected<\/a>. When Fox asserted such a privilege in Dominion\u2019s case, the judge found the New York precedent was \u201cbinding on this court\u201d and rejected that defense, adding that even if it did <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ly, Fox could not leverage it because they did not conduct \u201cgood-faith, disinterested reporting.\u201d<\/p>\n<p>Fox is nonetheless expressing confidence in its chances in court against Smartmatic, insisting that the voting systems company cannot tie any damages it may have suffered to Fox\u2019s segments, because the voter fraud claims at issue were promoted in many other places.<\/p>\n<p>The Smartmatic case is just the latest chapter in a string of legal battles and negative headlines for the nation\u2019s largest cable network over its coverage of former president Trump and the 2020 election.<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>Days ahead of the Dominion settlement, Fox for an undisclosed amount\u00a0settled another defamation case\u00a0brought by a Venezuelan businessman against the network and host Lou Dobbs, who has since left the network. That suit referenced claims that the businessman rigged the presidential election using Smartmatic and Dominion voting machines.<\/p>\n<p>Notably in its statement on the settlement with Dominion, Fox acknowledged \u201cthe Court\u2019s rulings finding certain claims about Dominion to be false.\u201d\u00a0<\/p>\n<p>\u201cThis settlement reflects Fox\u2019s continued commitment to the highest journalistic standards,\u201d the network added.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>How the pair of big-money lawsuits will affect the network\u2019s reputation with its massive, largely conservative viewers remains to be seen.\u00a0<\/p>\n<p>Nielsen <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Media<\/a> Research data shows Fox has not experienced any significant dip in its outsized audience share during the Dominion suit and its leading ad executives have said its revenues have been unaffected by the lawsuits it faces.\u00a0<\/p>\n<p>\u201cWhile the left seems to be following and delighting in the lawsuit, among the Americans most impacted by Fox, conservatives and Republicans, most aren\u2019t really tuning in,\u201d said Chris Jackson, pollster and senior vice president of U.S. public affairs at\u00a0Ipsos.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>Still, legal experts say the Dominion settlement could serve as another watershed moment for both Fox and media coverage of controversial matters of public debate.\u00a0<\/p>\n<p>\u201cHaving settled in such a public way for such a big number, it\u2019s going to be even more difficult for Fox to find a jury that isn\u2019t at least somewhat aware of this earlier settlement on a very similar issue,\u201d said Chris Mattei, an attorney who helped win a historic $1.5 billion defamation case against conspiracy theorist Alex Jones on behalf of the families of Sandy Hook victims.\u00a0<\/p>\n<p>\u201cIt feels to me like the case against Jones and the case against Fox are very important moments in combating what is becoming an ever-increasing threat of disinformation spreading through the country.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p><em>\u2013Updated at 6:31 a.m.<\/em><\/p>\n<\/div>\n<p>Copyright 2023 Nexstar Media Inc.
