{"id":572758,"date":"2023-05-02T19:24:39","date_gmt":"2023-05-02T16:24:39","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/durbin-slams-supreme-courts-response-to-ethics-issues-as-oblivious\/"},"modified":"2023-05-02T19:24:39","modified_gmt":"2023-05-02T16:24:39","slug":"durbin-slams-supreme-courts-response-to-ethics-issues-as-oblivious","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/durbin-slams-supreme-courts-response-to-ethics-issues-as-oblivious\/","title":{"rendered":"#Durbin slams Supreme Court\u2019s response to ethics issues as \u2018oblivious\u2019 \u00a0\u00a0"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2022\/09\/DurbinDick_091522_AP.jpg?w=900\" \/><\/p>\n<div>\n<p>Senate Judiciary Committee Chairman Dick Durbin (D-Ill.) scolded Supreme Court Chief Justice John Roberts at a hearing Tuesday for what he called the court\u2019s \u201coblivious\u201d response to the <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>earance of \u201cobvious\u201d ethical conflicts facing its members.\u00a0<\/p>\n<p>He chastised the high court for not adopting the same judicial code of conduct binding every other federal court and warned it had undermining public confidence in the court. \u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>\u201cThe highest court in the land shouldn\u2019t have the lowest ethical standards.\u00a0That reality is driving a crisis in public confidence in the Supreme Court.\u00a0The status quo must change,\u201d he said in his opening statement at a hearing on Supreme Court ethics reform.\u00a0<\/p>\n<p>Roberts himself was not in attendance at the hearing, having declined an invitation from Durbin to appear.<\/p>\n<p>A Gallup poll conducted in December found the Supreme Court had a 58 percent disapproval rating, the worst Gallup had measured in more than 20 years of surveys. \u00a0<\/p>\n<p>Durbin noted that over the course of several decades Congress and most of the federal judiciary has created a system of ethics to promote transparency and disclosure of potential conflicts but the Supreme Court does not consider itself bound by these rules. \u00a0<\/p>\n<p>And he dismissed the court\u2019s \u201cStatement on Ethics Principles and Practices,\u201d which Roberts sent to the Judiciary Committee last week along with a letter declining an invitation to testify before the committee, as a troubling response to growing ethical concerns.\u00a0<\/p>\n<p>\u201cIt makes clear that, while the Justices are fine with\u00a0consulting\u00a0certain authorities on how to address ethical issues, they do not feel\u00a0bound\u00a0by those authorities,\u201d Durbin said.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>\u201cMuch of the document explains why Justices think they should\u00a0not\u00a0be treated the same as other federal judges when it comes to ethics standards. And it stresses that recusal decisions are made by individual Justices alone, with no review of their discretion,\u201d he said.\u00a0<\/p>\n<p>\u201cThe Chief Justice\u2019s letter and statement of principles are a defense of the status quo.\u00a0But they are\u00a0oblivious to the obvious,\u201d Durbin added. \u00a0<\/p>\n<p>\u00a0Durbin scheduled the hearing in response to two bombshell reports published by ProPublica last month detailing luxury <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/trip-and-travel\/\" data-internallinksmanager029f6b8e52c=\"10\" title=\"Trip &amp; Travel\" target=\"_blank\" rel=\"noopener\">trip<\/a>s conservative Justice Clarence Thomas <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.propublica.org\/article\/clarence-thomas-scotus-undisclosed-luxury-travel-gifts-crow\">received from Texas billionaire<\/a> Harlan Crow over more than two decades, as well as the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.propublica.org\/article\/clarence-thomas-harlan-crow-real-estate-scotus\">sale of a property<\/a> in which Thomas owned a third interest to one of Crow\u2019s companies. \u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>Thomas did not disclose trips he took on the real estate magnate\u2019s Bombardier Global 5000 jet or the real estate transaction as he was required under the 1978 Ethics in Government Act. \u00a0<\/p>\n<p>Durbin said Thomas \u201chas faced no apparent consequences under the court\u2019s ethics principle.\u201d\u00a0<\/p>\n<p>\u201cWe wouldn\u2019t tolerate this from a city council member or alderman. It falls short of the ethical standards we expect of any public servant in America.\u00a0And yet the Supreme Court won\u2019t even acknowledge it\u2019s a problem.\u00a0The Chief Justice\u2019s letter doesn\u2019t mention it,\u201d he said. \u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>Durbin\u2019s opening statement received a sharp response from Sen. Lindsey Graham (R-S.C.), the ranking member of the Judiciary panel, who accused Democrats of trying to intimidate conservative members of the court.\u00a0<\/p>\n<p>Graham cited Senate Majority Leader Chuck Schumer\u2019s (D-N.Y.) warning to conservative Justices Brett Kavanaugh and Neil Gorsuch during a rally outside the Supreme Court in March of 2020 that they would release \u201cthe whirlwind\u201d and \u201cpay the price\u201d \u00a0<\/p>\n<p>\u201cI think here\u2019s what you\u2019re trying to do on the Democratic side. Remember when Sen. Schumer went to the court and started yelling everybody in the court? Not everybody, but just pretty much our folks,\u201d Graham said. \u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>He said Wednesday\u2019s hearing is part of \u201ca concentrated effort by the left to delegitimize this court and to cherry pick examples to make a point.\u201d \u00a0<\/p>\n<p>He pointed to a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2023\/04\/30\/us\/supreme-court-scalia-law-school.html\">recent article in The New York Times<\/a> about perks conservative justices received from George Mason University\u2019s law school to teach classes in tourist destinations such as Padua, Italy, Rome and London.\u00a0<\/p>\n<p>Graham said, however, that the Times failed to balance its reporting with examples that liberal Justice Sonia Sotomayor\u2019s travel to Florence, Italy, paid by New York University and former centrist Justice Anthony Kennedy\u2019s trip to Salzburg, San Francisco and Aspen paid for by the Aspen Institute and University of the Pacific.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>He accused liberals of waging an \u201cassault\u201d on Thomas.\u00a0<\/p>\n<p>\u201cIt is about trying to delegitimize a conservative court that was appointed through the traditional process,\u201d he said, and accused liberals of wanting to wanting to \u201cexpand the number of justices to dilute the conservative majority that exists today.\u201d\u00a0<\/p>\n<p>\u201cFrom our point of view, this is not going to work,\u201d he said. \u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>Graham also pointed out that liberal Justice Elena Kagan, the former dean of Harvard University\u2019s law school, has raised \u201chalf a billion dollar for the law school.\u201d\u00a0<\/p>\n<p>\u201cAfter she left, she\u2019s been trying to raise money for Harvard Law School.
