{"id":573500,"date":"2023-05-07T22:00:39","date_gmt":"2023-05-07T19:00:39","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/14th-amendment-emerges-as-last-ditch-fix-to-ward-off-default\/"},"modified":"2023-05-07T22:00:39","modified_gmt":"2023-05-07T19:00:39","slug":"14th-amendment-emerges-as-last-ditch-fix-to-ward-off-default","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/14th-amendment-emerges-as-last-ditch-fix-to-ward-off-default\/","title":{"rendered":"#14th Amendment emerges as last-ditch fix to ward off default"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/04\/bidenjoe_042423gn16_w.jpg?w=900\" \/><\/p>\n<div>\n<p>Top political figures are swirling the possibility that President Biden could use the powers of a clause in the 14th Amendment as a last-ditch effort to ward off the looming threat that the U.S. could default on its debt as soon as next month.\u00a0<\/p>\n<p>When asked about possibility of invoking the amendment, President Biden as recently as Friday <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>eared to leave such an option on the table when he told MSNBC in an interview he had \u201cnot gotten there yet.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>But Treasury Secretary Janet Yellen on Sunday sounded the alarm, calling it a \u201cconstitutional crisis\u201d should the president rely on the 14th Amendment, which obscurely addresses the nation\u2019s debt in a way that legal scholars believe allows the president to continue issuing debts without lifting or suspending the ceiling.<\/p>\n<p>\u201cThere is no way to protect our financial system in our economy, other than Congress doing its job and raising the debt ceiling and enabling us to pay our bills and we should not get to the point where we need to consider whether the President can go on issuing debt. This would be a constitutional crisis,\u201d Yellen said on ABC\u2019s \u201cThis Week.\u201d\u00a0<\/p>\n<p>The Treasury Secretary said she doesn\u2019t want to \u201cconsider emergency options\u201d and warned that, if Congress doesn\u2019t act to solve the issue, \u201cwe will have an economic and financial catastrophe that will be of our own making, and there is no action that President Biden and the U.S. Treasury can take to prevent that catastrophe.\u201d<\/p>\n<p>But Biden technically can take action, and White House aides have <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2023\/05\/02\/us\/politics\/debt-limit-14th-amendment.html\">reportedly<\/a> looked at the possibility in order to avoid a default.<\/p>\n<p>Lawmakers have insisted a deal to avoid default can only be reached between Biden and Speaker Kevin McCarthy (R-Calif.), who are meeting on Tuesday for the first time since February in an attempt to hash out a deal.<\/p>\n<p>Biden and his administration have spent the past few months insisting they won\u2019t negotiate and want a \u201cclean\u201d debt limit increase but Republicans won\u2019t budget on the stance that an increase has to come with a promise of spending cuts, though the GOP has been short on details on just where they want to see the federal budget be slashed.<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>The impasse has Washington bracing for what Yellen called a potential \u201ccatastrophe.\u201d The nation has never defaulted on its debt in history.<\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.archives.gov\/milestone-documents\/14th-amendment#:~:text=No%20State%20shall%20make%20or,equal%20protection%20of%20the%20laws.\">The amendment<\/a> chiefly extended the Bill of Rights liberties to formerly enslaved people, but also includes a section saying \u201cthe validity of the public debt of the United States \u2026 shall not be questioned.\u201d<\/p>\n<p>Even some Republicans acknowledge invoking the 14th Amendment isn\u2019t an alternative.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>Sen. James Lankford (R-Okla.), appearing after Yellen on \u201cThis Week,\u201d said invoking the amendment is \u201ccertainly not a good option.\u201d<\/p>\n<p>\u201cShe rightfully said it would be a constitutional crisis because the Constitution is very clear that spending \u2014 all those details around spending and money actually has to come through Congress,\u201d Lankford said.\u00a0<\/p>\n<p>At a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/press-briefings\/2023\/05\/03\/press-briefing-by-press-secretary-karine-jean-pierre-31\/\">press briefing<\/a> last week, White House press secretary Karine Jean-Pierre said the administration won\u2019t \u201centertain scenarios\u201d when asked if the 14th Amendment option was one being considered by Biden or one that was even brought to his desk yet.<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>Jean-Pierre stressed that Congress needs to act \u2014 a sentiment the White House stresses almost daily on the matter and repeated by OMB Director Shalanda Young when she was asked about the possibility of the move during a separate <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/press-briefings\/2023\/05\/04\/press-briefing-by-press-secretary-karine-jean-pierre-nsc-coordinator-for-strategic-communications-john-kirby-and-omb-director-shalanda-young\/\">briefing<\/a>. <\/p>\n<p>\u201cOh, well, let me be very clear: Congress needs to do its job.\u00a0 Tomorrow, they could put a bill on the floor to make sure we don\u2019t default. This is of people\u2019s own making. \u2026 This is made up drama,\u201d Young said. When pressed on whether the move was on the table, she repeated that it\u2019s \u201cCongress\u2019s duty to do.\u201d<\/p>\n<p>Meanwhile, another option lawmakers and the White House aren\u2019t ruling out is agreeing on a short-term fix.<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>House Minority Leader Hakeem Jeffries (D-N.Y.) on NBC\u2019s \u201cMeet the Press\u201d didn\u2019t rule out agreeing to correlating a debt limit increase with the deadline for when federal government spending will run out.<\/p>\n<p>\u201cIs the obvious solution here a short term punt?\u201d host Chuck Todd asked. \u201cAnd it looks like this: you essentially raise the debt ceiling through September 30 and make the debt ceiling and the budget deadlines converge.\u201d<\/p>\n<p>\u201cI don\u2019t think the responsible thing is to kick the can down the road,\u201d Jeffries said.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>\u201cBut we, of course, are open to having a discussion about what type of investments, what type of spending, what type of revenues are appropriate in order to protect the health and safety and economic well-being of the American people.
