According to EU regulators, Meta broke the rules by transferring user data from the bloc to the US for processing.<\/p>\n<p>The <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Facebook<\/a> owner made these transfers on the <span>basis of standard contractual clauses (SCCs), which govern the flow of personal data. But an EU investigation determined that SCCs don\u2019t provide enough protection from US surveillance.<\/span><\/p>\n<p>Andrea Jelinek, chair of the European Data Protection Board, called the infringement \u201cvery serious\u201d because the transfers were systematic, repetitive, and continuous.<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/fast.wistia.net\/embed\/iframe\/3yishpx6ry?videoFoam=true&amp;autoPlay=true\" title=\"\" allowtransparency=\"true\" frameborder=\"0\" scrolling=\"no\" class=\"wistia_embed\" name=\"wistia_embed\" allowfullscreen=\"\" msallowfullscreen=\"\" width=\"100%\" height=\"100%\"><\/iframe><\/p>\n<p>\u201cFacebook has millions of users in Europe, so the volume of personal data transferred is massive,\u201d she said. \u201cThe unprecedented fine is a strong signal to organisations that serious infringements have far-reaching consequences.\u201d<\/p>\n<p>Meta called the fine \u201cunjustified and unnecessary\u201d and said it would <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>eal the ruling.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Data_borders\"><\/span>Data borders<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The intervention could prove pivotal for data transfers more broadly. Lawmakers in the EU and US are currently developing a new transatlantic Data Privacy Framework that would clarify the requirements for moving information across borders.<\/p>\n<p>Nick Clegg, Meta\u2019s head of global affairs, said the new ruling had disregarded the progress being made on this issue. He called it \u201ca dangerous precedent\u201d for data transfers that imperils the foundations of an open internet.<\/p>\n<p>\u201cWithout the ability to transfer data across borders, the internet risks being carved up into national and regional silos,\u00a0restricting the global economy and leaving citizens in different countries unable to access many of the shared services we have come to rely on,\u201d said Clegg.<\/p>\n<p>Naturally, Clegg has a vested interest in easing data flows to the US, but he\u2019s not alone in wanting the removal of digital borders. According to Janine Regan, Legal Director for Data Protection at law firm <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.charlesrussellspeechlys.com\/en\/\">Charles Russell Speechlys<\/a>, there\u2019s political agreement on both sides of the Atlantic to resolve the issue.\u00a0<u\/><u\/><\/p>\n<p class=\"m_-7161793399795026768xmsonormal\"><u\/>\u201c<u\/>It\u2019s likely that an alternative transfer mechanism will be ready over the summer so that\u00a0<span class=\"il\">Meta<\/span> does not have to completely suspend transatlantic transfers, but this will be little consolation for a company facing such a record-breaking fine,\u201d she said.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Dangerous_times_for_data_violations\"><\/span>Dangerous times for data violations<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The new ruling also serves as a warning to other companies that transfer data. Chris Linnell, Principal Data Protection Consultant at cyber security firm <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/74n5c4m7.r.eu-west-1.awstrack.me\/L0\/https:%2F%2Fwww.bridewell.com%2F\/1\/010201884358bffa-e86a13a6-21b6-42c5-bad0-c232df628268-000000\/jFpWB9kkYkE4PHJYM_ALFbfxRAY=322\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/74n5c4m7.r.eu-west-1.awstrack.me\/L0\/https:%252F%252Fwww.bridewell.com%252F\/1\/010201884358bffa-e86a13a6-21b6-42c5-bad0-c232df628268-000000\/jFpWB9kkYkE4PHJYM_ALFbfxRAY%3D322&amp;source=gmail&amp;ust=1684846073817000&amp;usg=AOvVaw3jSSzayTZ-7rQnhI4H4oOI\">Bridewell<\/a> called it \u201ca stark reminder\u201d that SSCs alone don\u2019t adequately protect personal data.<\/p>\n<p>He advised all organisations to undertake transfer risk assessments when processing personal data outside of the EU. In addition, he recommends regular ongoing reviews of compliance and potential risks to data subjects.<\/p>\n<p>\u201cUltimately, contracts in place between parties will not act as a safeguard when recipient organisations have their own legal obligations to fulfil when it comes to national surveillance laws, such as <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/en.wikipedia.org\/wiki\/Foreign_Intelligence_Surveillance_Act\">FISA<\/a> in the United States,\u201d said Linnel.\n                        <\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
