Clark<\/span><\/p><\/div>\n<div>\n                        A Queens restaurant is losing business to Long Island eateries just a block away \u2014 all because diners are allowed to feast indoors on the island but not in the city, a new lawsuit says.<\/p>\n<p>Little Neck\u2019s Il Bacco \u2014 which borders Nassau towns Great Neck and Lake Success \u2014 says its unfair that the Big <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>le doesn\u2019t allow indoor dining, and the coronavirus executive orders that began in March violate its constitutional rights, the Manhattan Supreme Court lawsuit alleges.<\/p>\n<p>\u201cIf a restaurant patron <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/trip-and-travel\/\" data-internallinksmanager029f6b8e52c=\"10\" title=\"Trip &amp; Travel\" target=\"_blank\" rel=\"noopener\">travel<\/a>s five hundred feet east or one city block east from [Il Bacco], patrons are in Nassau County and can enjoy indoor dining in an air conditioned room,\u201d the court papers filed Friday say. \u201cAccording to Governor [Andrew] Cuomo, it is dangerous to eat at [Il Bacco] in Little Neck, Queens, but it is safe to dine indoors a few hundred feet east.\u201d<\/p>\n<p>The 28-year-old Italian restaurant can\u2019t afford to keep operating unless it can resume indoor dining, according to the suit, which seeks an annulment of the pandemic executive order and\u00a0$2 billion in damages for Il Bacco and others that may want to join the lawsuit.<\/p>\n<p>Il Bacco \u201cis losing all of its customers to restaurants in Nassau County and is suffering irreparable harm,\u201d the suit says. \u201cThere is absolutely NO <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/sciencee\/\" data-internallinksmanager029f6b8e52c=\"5\" title=\"Science\" target=\"_blank\" rel=\"noopener\">SCIENCE<\/a> that will prove that \u201cindoor dining\u201d is safer one city bock east from [Il Bacco].\u201d<\/p>\n<p>\u201cAlthough the curve has been flattened for over three months now, the Governor has nonetheless issued stricter and confusing executive orders that unreasonably and unnecessarily interfere with Plaintiff\u2019s, and those similarly situated, constitutional rights,\u201d the court papers allege, calling the situation \u201crandom, arbitrary and unfair.\u201d<\/p>\n<p>The executive order on indoor dining in NYC affects, not only Il Bacco, but over 150,000 other NYC restaurants too \u2014 most of which can barely pay the rent, the suit says.<\/p>\n<p>Gov. Cuomo has OK\u2019ed indoor dining in every region of the state except New York City.<\/p>\n<p>The lawsuit is seeking a sweeping ruling from a judge that \u201cthe executive orders keeping people in their homes and away from their businesses \u2014 and all other orders, rules, and enforcement activity related to them \u2014 are unconstitutional,\u201d the court papers say.<\/p>\n<p>Il Bacco and the other potential plaintiffs, \u201cbring this lawsuit to define the limits of the State\u2019s and the City\u2019s police power. Whatever its limits, this legal term of art is not some principle that unlocks absolute executive power and casts our Constitution to the wind,\u201d the court filings say.<\/p>\n<p>Mayor Bill de Blasio said over a week ago that he doesn\u2019t have a plan to resume indoor dining in the city.<\/p>\n<p>\u201cWhat we need to do first and foremost is focus on the health and safety of New Yorkers and on bringing back our city smartly and not allowing the mistakes we\u2019ve seen in so much of the country and so much of the world,\u201d de Blasio said last Tuesday.<\/p>\n<p>Meanwhile, on Monday New Jersey Gov. Phil Murphy announced that indoor dining would begin in the Garden State this week at 25 percent capacity.<\/p>\n<p>The suit names, Gov. Cuomo, the mayor and the New York Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a> as defendants in the case.<\/p>\n<p>Richard Azzopardi, Senior Advisor to Gov.
