{"id":576319,"date":"2023-05-28T00:59:07","date_gmt":"2023-05-27T21:59:07","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/texas-house-votes-to-impeach-ag-ken-paxton\/"},"modified":"2023-05-28T00:59:07","modified_gmt":"2023-05-27T21:59:07","slug":"texas-house-votes-to-impeach-ag-ken-paxton","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/texas-house-votes-to-impeach-ag-ken-paxton\/","title":{"rendered":"#Texas House votes to impeach AG Ken Paxton"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/05\/paxtonken_102222ap_texas.jpg?w=900\" \/><\/p>\n<div>\n<p>The Texas House on Saturday voted to impeach embattled state Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a>\u00a0Ken Paxton\u00a0(R).<\/p>\n<p>The vote was 121-23, with two present but not voting, and three who were absent from the chamber. He will be suspended from office pending a trial in the Senate.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>The impeachment represents\u00a0a sudden reversal for Paxton, who has twice cruised to reelection despite being under active federal indictment.<\/p>\n<p>On Thursday,\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/capitol.texas.gov\/tlodocs\/88R\/billtext\/html\/HR02377I.htm\">a state\u00a0House investigative\u00a0committee\u00a0recommended his impeachment<\/a>,\u00a0finding\u00a0that he\u00a0had\u00a0\u201cused, misused, or failed to use his official powers in\u00a0a\u00a0manner calculated to subvert the lawful operation of the government.\u201d<\/p>\n<p>The 20 counts in the resolution contained a grab bag of alleged in<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ropriate favors done for donors, interference in federal investigations and retaliation against whistleblowers.<\/p>\n<p>But at their centerpiece were sordid accusations of infidelity, bribery and abuse of official power \u2014 followed by an alleged campaign of retaliation against Paxton\u2019s deputies who say they attempted to bring it to light.<\/p>\n<p>Some elements of the account put forward by the committee were familiar from ongoing wrongful termination lawsuits by those deputies. They had charged that Paxton illegitimately intervened in litigation by one of his donors, Austin realtor Nate Paul \u2014 and that Paul had paid him back by remodeling his house and finding a make-work job for Paxton\u2019s affair partner, a former staffer in his wife\u2019s office.<\/p>\n<p>But other charges revealed to the state House on Wednesday were new. Paxton, the investigative team told the committee, had interfered with an FBI investigation. He had turned out subpoenas to threaten enemies of his donors, they alleged.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>And in one dramatic move,\u00a0they told the committee that Paxton issued a bespoke legal opinion blocking all foreclosure sales in Texas, citing COVID.\u00a0<\/p>\n<p>This, they noted, was an opinion his office published after just days instead of the usual weeks and had never officially posted, and that came out just in time to halt the foreclosure auction of 13 properties owned by Paul, who was going into bankruptcy.<\/p>\n<p>In March, Paxton agreed to a $3.3 million settlement with the deputies he allegedly fired for tipping off law enforcement about these events \u2014 money his office expected to be paid by the state legislature.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>Instead, both bodies refused to pay. And underSpeaker Dade\u00a0Phelan\u00a0(R), the Texas House began an investigation.<\/p>\n<p>Paxton fought against these charges with his usual pugnacity. He condemned them on Thursday as a politically motivated attack by \u201cliberal Speaker Dade Phelan.\u201d<\/p>\n<p>The speaker, Paxton elaborated on Thursday, \u201cwants nothing more than to sabotage our legal challenges to Biden\u2019s extremist agenda by taking me out as the state\u2019s Attorney General.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>As House proceedings warmed up on Friday afternoon, attorneys from Paxton\u2019s office circulated briefs decrying the \u201cunprecedented race to impeachment\u201d by the House.<\/p>\n<p>The attorneys argued that Paxton had been barred \u201cevery right and courtesy typically afforded to an accused in a system governed by the rule of law,\u201d including the ability to call witnesses in his own defense.<\/p>\n<p>But in documents delivered to the\u00a0state\u00a0House\u00a0on Friday afternoon, members of the committee pushed back. Paxton, they argued, did not get criminal protection because he was not facing criminal charges.<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>The letter\u00a0from the committee members further argued that both secrecy in the investigation and a speedy impeachment were necessary \u2014 not to punish Paxton, but to protect Texas from his future attempts to use his \u201csignificant power to further obstruct and delay justice.\u201d<\/p>\n<p>Finally, the committee suggested that Paxton had brought the investigation on himself:\u00a0His request for the legislature to foot the bill for his settlement had been the last straw, the members said.<\/p>\n<p>\u201cWe cannot over-emphasize the fact that, but for Paxton\u2019s own request for a settlement over his wrongful conduct, Paxton would not be facing impeachment by the House,\u201d they wrote.<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>Several prominent state and federal Republicans came to Paxton\u2019s\u00a0defense.<\/p>\n<p>\u201cThis sham impeachment is the result of the Phelan leadership team empowering Democrats, allowing them to hold leadership positions and letting them control the agenda,\u201d Matt Rinaldi of the Texas Republican Party\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/MattRinaldiTX\/status\/1662131156484235264?ref_src=twsrc%5Egoogle%7Ctwcamp%5Eserp%7Ctwgr%5Etweet\">wrote on Twitter<\/a>\u00a0Friday morning.<\/p>\n<p>The proceedings, Rinaldi added, \u201care but the latest front in the Texas House\u2019s war against Republicans to stop the conservative direction of our state.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>And former Trump aide Stephen Miller wrote on Thursday that \u201cfew in America have done more to advance the conservative legal movement, stop the lawless Biden executive onslaught, and defend our shared values\u201d than Ken Paxton.<\/p>\n<p>In the leadup to the House\u00a0committee\u2019s\u00a0recommendation to impeach him, Paxton supporters had launched\u00a0attacks\u00a0against Phelan. On Tuesday, Paxton\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/KenPaxtonTX\/status\/1661097919443881987\">alleged<\/a>\u00a0that the speaker had failed to put forth conservative priorities because of his \u201cdebilitating intoxication,\u201d after conservative <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">social media<\/a> accounts promoted a thirty-second video of Phelan <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/trip-and-travel\/\" data-internallinksmanager029f6b8e52c=\"10\" title=\"Trip &amp; Travel\" target=\"_blank\" rel=\"noopener\">trip<\/a>ping over his words while announcing a bill.<\/p>\n<p>On Thursday, as the House General Investigations Committee withdrew to consider impeachment charges on the set of blockbuster allegations revealed against the attorney general\u00a0a day earlier, a Paxton supporter\u00a0out to The Hill\u00a0to double down on the intoxication story.\u00a0<\/p>\n<p>The email contained a photo of a man working a bar in an official-looking hallway, with the \u201cCome and Take It\u201d cannon flag\u00a0visible\u00a0over his left shoulder as he mixed drinks.<\/p>\n<p>Conservative state Republicans \u2014\u00a0which in Texas have always included a large teetotaling Baptist contingent\u00a0\u2014\u00a0have also pointed to the accusations about Phelan being intoxicated\u00a0as a means of explaining why\u00a0House\u00a0Republicans haven\u2019t passed a raft of\u00a0Gov. Greg Abbott (R) and Dan Patrick\u2019s (R)\u00a0hard-right priorities.<\/p>\n<p>\u201cAlcoholism has run rampant throughout the Texas Legislature,\u201d the\u00a0Paxton supporter\u00a0wrote\u00a0to The Hill. \u201cIt\u2019s disappointing and largely explains why no effective bills have been passed this session.\u201d<\/p>\n<p>The Hill has reached out to Phelan for comment. On Wednesday, the Speaker dismissed Paxton\u2019s statement as \u201ca last-ditch effort to save face.\u201d\u00a0<\/p>\n<p>Paxton\u2019s multi pronged defense \u2014 and the willingness by Trump-aligned Republicans to accept it \u2014 comes amid a broader array of conflicts between\u00a0Texas\u2019s\u00a0Republican leaders.\u00a0<\/p>\n<p>That has spilled into a broader pileup in\u00a0legislation due to ongoing disagreements between the\u00a0state\u00a0House \u2014 which Phelan had built into an independent bulwark against Patrick and Abbott \u2014 and the Senate,\u00a0of which Patrick is the president and in which he exercises a great deal of authority.<\/p>\n<p>Conservative Republicans are frustrated that the House has routinely mothballed conservative legislation sent by the\u00a0Senate\u00a0\u2014 or passed it in sufficiently watered-down form as to neuter its original intent.<\/p>\n<p>In May, for example, the House passed a bill banning sexual performances in front of minors \u2014 a\u00a0type of legislation\u00a0other states have used to target all-ages drag shows, or events like drag queens reading stories at public libraries.<\/p>\n<p>On its face, this looked like a victory for Patrick, for whom the bill had been a priority.<\/p>\n<p>But unlike those other state bills, the final bill passed by the\u00a0Texas\u00a0House stripped the\u00a0legislation\u00a0of its specifically anti-drag language \u2014 which had originally defined \u201csexually explicit\u201d to mean\u00a0<strong>\u201c<\/strong>a male performer exhibiting as a female, or a female performer exhibiting as a male,\u201d the Texas Tribune reported.<\/p>\n<p>Other conservative priorities that have stalled\u00a0in the Texas legislature\u00a0include a raft of energy bills that seek to disadvantage the state renewable energy industry \u2014\u00a0one of the crown jewels of Republican rule in Texas\u00a0\u00a0\u2014 in favor of fossil fuels.\u00a0<\/p>\n<p>There\u2019s also a proposed school voucher system that would allow families to pull their money out of public schools along with their children \u2014 something that is anathema to even highly conservative rural districts, where public schools are a backbone of the community.\u00a0<\/p>\n<p>In\u00a0state\u00a0House deliberations on Thursday, discontent\u00a0in the body\u00a0bloomed into open acrimony as bill after bill returned to the chamber from the Senate laden with new amendments \u2014 leading to angry calls by representatives that the body was being disrespected.<\/p>\n<p>This reached such a pitch that one representative \u2014 presenting the Senate amendments on his own bill \u2014 pleaded with his colleagues not to \u201cchoose violence,\u201d and begged them not to automatically vote his bill down.<\/p>\n<p>The independent nature of the\u00a0House\u00a0has made the body\u00a0a major\u00a0obstacle to\u00a0legislation considered must-pass by both Abbott and Patrick,\u00a0and one\u00a0significant\u00a0unknown is whether the two \u2014 who have yet to speak publicly on the matter \u2014 will come to the attorney general\u2019s defense.<\/p>\n<p>On the one hand<strong>,<\/strong>\u00a0Paxton has been their staunch ally \u2014 repeatedly suing blue states and the Biden administration for taking climate action or softening Trump-era immigration laws, and\u00a0taking\u00a0his pursuit of Trump\u2019s claim that the 2020 election was stolen so far that the Texas Bar Association filed an official misconduct claim against him.<\/p>\n<p>At the same time, he has been increasingly viewed by state GOP leaders as an \u201cembarrassment,\u201d veteran Austin journalist Harvey Kronberg told The Hill.\u00a0<\/p>\n<p>In the 2022 Republican primary, Texans for Lawsuit Reform, the state\u2019s leading GOP Political Action Committee, supported his opponent, former state Supreme Court Justice Eva Guzman.<\/p>\n<p>That was a sign of broader frustration with Paxton among state GOP leaders \u2014 because the PAC is a key part of Abbott\u2019s coalition,\u00a0Kronberg\u00a0said.<\/p>\n<p>Whatever Abbott\u00a0decides to do,\u00a0the recommendation to impeach\u00a0from the House commitee\u00a0was\u00a0a clear shot across the governor\u2019s bow,\u00a0Kronberg added.<\/p>\n<p>The recommendation \u201cis a middle finger salute to the governor and the lieutenant governor that establishes the independence of the house \u2014 and the fact that the House is not to be trifled with,\u201d he said.<\/p>\n<\/div>\n<p>Copyright 2023 Nexstar Media Inc.
