{"id":581232,"date":"2023-07-03T20:03:18","date_gmt":"2023-07-03T17:03:18","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/man-denies-making-request-cited-in-landmark-supreme-court-lgbtq-case\/"},"modified":"2023-07-03T20:03:18","modified_gmt":"2023-07-03T17:03:18","slug":"man-denies-making-request-cited-in-landmark-supreme-court-lgbtq-case","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/man-denies-making-request-cited-in-landmark-supreme-court-lgbtq-case\/","title":{"rendered":"#Man denies making request cited in landmark Supreme Court LGBTQ case"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2023\/07\/APSUPREMECOURTFile.jpg?w=900\" \/><\/p>\n<div>\n<p>As website designer Lorie Smith battled Colorado\u2019s public accommodation law, she claimed that one day after filing her lawsuit, a man requested she design a website for his upcoming same-sex marriage.<\/p>\n<p>But the man, identified in the request as \u201cStewart,\u201d says he has been married to a woman for more than a decade and never submitted the inquiry.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\"><\/aside>\n<p>The Supreme Court on Friday handed Smith a victory in her pre-enforcement lawsuit, ruling along ideological lines that\u00a0Colorado could not compel the evangelical Christian to design same-sex wedding websites\u00a0if she expanded her business to offer them for opposite-sex couples. The ruling was one of a handful of landmark cases the court considered this term \u2013 one that struck a significant blow to LGBTQ rights.\u201d<\/p>\n<p>The justices\u2019 opinions made no reference to the supposed request, and Smith only briefly mentioned it in filings at the Supreme Court.<\/p>\n<p>But the development has raised new scrutiny of Smith and her conservative lawyers\u2019 years-long effort to claw back LGBTQ+ protections, as they had cited the request on multiple occasions in the lower courts while asserting that she had authority to challenge Colorado\u2019s law.<\/p>\n<p>\u201cI\u2019m just really dis<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ointed in the ongoing and sustained attacks on the LGBTQ community in this country, and I\u2019m also disappointed and concerned about the lack of rigor that\u2019s been shown by the lawyers in this case,\u201d said Stewart, who agreed to be interviewed by The Hill on the condition that his last name not be used.<\/p>\n<p>\u201cThere\u2019s some evidence there which is easily refutable and easily proven to be incorrect and has been in the case filings for the last five plus years,\u201d he continued. \u201cSo it\u2019s concerning that that could make it all the way to the Supreme Court without anybody checking.\u201d<\/p>\n<p>Two Democratic-appointed judges and one Republican-appointed judge on a lower appeals court panel all agreed that Smith had authority to bring her lawsuit regardless of the request.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\"><\/aside>\n<p>The lower court went on to uphold Colorado\u2019s law as constitutional in a divided ruling, leading Smith to appeal to the Supreme Court.\u00a0<\/p>\n<p>The high court\u2019s justices did not weigh in on the legal standing issue, as they only agreed to hear Smith\u2019s free speech claims. The court\u2019s six conservatives sided with the web designer Friday, dealing a significant blow to LGBTQ protections in one of the biggest cases of the term.<\/p>\n<p>Stewart said he only learned of his purported connection to the case when contacted last week by <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/newrepublic.com\/article\/173987\/mysterious-case-fake-gay-marriage-website-real-straight-man-supreme-court\">The New Republic<\/a>, which first reported the man\u2019s denial.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\"><\/aside>\n<p>He confirmed the email and phone number listed on the supposed request belonged to him, but he said he has been married to a woman for more than a decade.\u00a0<\/p>\n<p>Like Smith, Stewart also runs a website and graphic design company. The request listed the sender\u2019s IP address, which corresponds to the San Francisco area, where Stewart lives.<\/p>\n<p>\u201cI did not submit the request. I don\u2019t know who did. I don\u2019t know what their motivations would be,\u201d said Stewart.<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\"><\/aside>\n<p>Alliance Defending Freedom (ADF), the Christian legal organization that represented Smith, said in a statement that the designer doesn\u2019t do background checks on incoming requests to determine if they are genuine, and that it doesn\u2019t impact the outcome because her lawsuit was a pre-enforcement challenge.<\/p>\n<p>\u201cWhether Lorie received a legitimate request or whether someone lied to her is irrelevant,\u201d the group said. \u201cNo one should have to wait to be punished by the government to challenge an unjust law. Moreover, Lorie has received other wedding requests and has been unable to respond to any request because that put her at risk of punishment for violating Colorado\u2019s unjust law.\u201d<\/p>\n<p>Friday\u2019s win was the latest and most significant development of ADF\u2019s years-long fight against Colorado\u2019s law, which prevents businesses that serve the public from discriminating on protected characteristics, including sexual orientation.<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\"><\/aside>\n<p>The group also represented cake baker Jack Phillips, whom Colorado investigated more than a decade ago when he refused to make a cake for a same-sex wedding, in violation of the law.<\/p>\n<p>Phillips also brought his challenge to the Supreme Court in 2018, but the justices <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/docs.google.com\/document\/d\/1HTIEc3D-bAfQ4H42X9yJ4qftu0ihrjFNdqF6I_rnXyE\/edit\">disposed of it on narrower grounds<\/a>, ruling that the investigation had impermissibly shown hostility toward Phillips\u2019s religious beliefs.<\/p>\n<p>ADF had filed Smith\u2019s pre-enforcement challenge to Colorado\u2019s law roughly two years prior to that decision.<\/p>\n<aside class=\"ad-unit ad-unit--mr6_ab\"><\/aside>\n<p>The designer had not yet offered wedding websites, but her lawsuit said she wanted to expand her business, 303 Creative, because she \u201cbelieves that God is calling her to promote and celebrate His design for marriage.\u201d<\/p>\n<p>The purported request was sent to Smith\u2019s company one day after she filed her lawsuit in September 2016, according to court filings.\u00a0<\/p>\n<p>\u201cMy wedding. My name is Stewart and my fiancee is Mike. We are getting married early next year and would love some design work done for our invites, placenames etc. We might also stretch to a website,\u201d the request read.<\/p>\n<aside class=\"ad-unit ad-unit--mr7_ab\"><\/aside>\n<p>Smith cited the supposed request as part of her argument that she had authority to sue, saying she faced a credible threat of enforcement.\u00a0<\/p>\n<p>Colorado contended that she had no legal standing and that the supposed request was irrelevant because it was sent after the lawsuit began. The 10th Circuit U.S. Court of Appeals sided with Smith on the standing issue, but its reasoning did not depend on the request.<\/p>\n<p>\u201cAssuming Appellants offer wedding-related services to the public as they say they will, there is no reason to then conclude that Appellants will fail to attract customers. Nor is there reason to conclude that only customers celebrating opposite-sex marriages will request Appellants\u2019 services. In short, we find nothing \u2018imaginary or speculative\u2019 about Appellants\u2019 apprehensions that they may violate CADA if they offer wedding-based services in the manner that they intend,\u201d wrote the two judges, who were appointed in the Clinton era.<\/p>\n<p>At a Friday <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">news<\/a> conference following the Supreme Court\u2019s ruling, Colorado Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a> Phil Weiser (D) said he didn\u2019t know any details about the man\u2019s denial of sending the request.<\/p>\n<p>\u201cOur position in this case has been there is no website development happening, there is no business operating,\u201d he said. \u201cThis was a made-up case without the benefit of any real facts or customers.
